Page 1 of 2 Resolution No. 2025-080 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING STAFF TO SUBMIT AN APPLICATION TO RECEIVE THE FY 25/26 ALLOCATION OF STATE OF GOOD REPAIR PROGRAM FUNDS WHEREAS, Senate Bill 1 (SB1), the Road Repair and Accountability Act 2017, established the State of Good Repair (SGR) Program to fund eligible transit maintenance, rehabilitation and capital project activities that maintain the public transit system in a state of good repair; and WHEREAS, the City of Petaluma is an eligible project sponsor and may receive and distribute State Transit Assistance – State of Good Repair Program funds to eligible transit capital projects; and WHEREAS, the Department of Transportation distributes SGR funds to eligible project sponsors (local agencies) under its regional jurisdiction; and WHEREAS, the Department of Transportation concurs with and approves the rehabilitation and repair of a bus engine project for the SGR Program funds; and Program funds; and WHEREAS, the City of Petaluma has been allocated up to $9,336 in SGR funds for FY25/26; and WHEREAS, the City of Petaluma wishes to submit a project in order to apply these funds towards “Repair and Rehabilitation” on the fixed-route bus fleet; and WHEREAS, the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in that the usage of the SGR funds for repair and rehabilitation does not meet CEQA's definition of a “project,” because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment, and additionally the specific use of the funds will be reviewed under CEQA, but will likely be exempt pursuant to CEQA Guidelines Section 15301, repair of existing facility. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Petaluma hereby: 1. Declares the above recitals are hereby declared to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that the proposed action is exempt from the requirements of the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15378, in the usage of the SGR funds for Repair and Rehabilitation does not meet CEQA's definition of a “project,” because the action does not have the potential for resulting in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. Relatedly, the proposed action is exempt under the common-sense exemption, CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the proposed action could have a significant impact on the environment. Moreover, any repair work done with the funds would be exempt pursuant to CEQA Guidelines Section 15301 (Existing Facilities) As the work would be to repair existing roads. Directs the City Manager or their designee is authorized to execute and file appropriate SGR applications, together with all necessary supporting documents, with the Metropolitan Transportation Commission and Department of Transportation for an allocation of SGR funds in FY 25/26. Under the power and authority conferred upon this Council by the Charter of said City.
