AN ORDINANCE AMENDING CHAPTER 20.34.190 OF THE PETALUMA
MUNICIPAL CODE TO PROVIDE CLARIFICATION OF PARK AND
RECREATION LAND IMPROVEMENT FEE CALCULATION.
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
26 Section 1. Petaluma Municipal Code Section 20.34.190, first paragraph, is hereby
27 amended as follows (additions noted in italics):

29 20.34.190 Payment of fees - I)isposition -~ime.
30 Park fees shall be paid in the amounts specified in this chapter, computed on a per
31 dwelling basis on the date the final map is approved. In tlaose cases where no
32 subdivision of land is involved, this fee shall be computed on the date tlae fzrst building
33 permit for the project is issued. The monies collected from this fee shall be deposited
34 in the office of the city treasurer prior to the issuance of any residential building
35 permits for the building site or sites from which fees are to be derived.

37 All park fees paid to the City shall be used to provide for the acquisition and
38 improvement of neighborhood, or community parks which serve the future owners
39 and residents of the property from which the fees were derived, and shall be
40 recorded in a special account reserved for such purpose.

42 Section 2. The City Clerk is hereby directed to publish/post this Ordinance for the
43 period and in the manner as required by the City Charter.

IF ANY SEC'TION, subsection, sentence, clause or phrase or word of this ordinance is for
any reason held to be unconstitutional by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this ordinance. The City Council of
the City of Petaluma hereby declares that it would have passed and adopted this ordinance
and each and all provisions thereof irrespective of the fact that any one or more of said
provisions be declared unconstitutional.
