Introduced by Carole Barlas Seconded by Ross Parkerson AN O1tDINANCE ESTABLISHING AND AIVI~NDING CER'~AIN TIME I,IIVII'I'ATIONS WI'I'I~ RESPEC'I' TO THE REDEVEL~`PIVIENT PY~AN FOR TI~~ CEN'I'RAL BUSINESS DISTRICT REl)EVEL~PMENB' PROJEC'~' 1 BE IT ORDAINED BY THE Council of the City of Petaluma as follows: 2 Section I 3 A. The City Council of the City of Petaluma adopted Ordinance #1221 N.C.S. on the 27th 4 day of September, 1976 approving and adopting the Redevelopment Plan for the Central 5 Business District Project Area. 6 B. The Petaluma Community Development Commission (commission) of the City of 7 Petaluma has been designated the official redevelopment agency to carry out the 8 functions and requirements of the Comnlunity Redevelo.pment Law, State of California 9 (Health and Safety Code Section 33000 et sec) and to implement the Redevelopment 10 Plan. Pursuant to Community Redevelopment Law, the City Council adopted certain limits 2 with respect to initiation of plan activities as contained in Section VII of the 3 Redevelopment Plan. 4 D. Section 33333.6 of the Community Redevelopment Law established certain limitations 5 on the incurrence of and repayment of indebtedness and the duration of redevelopment 6 plans which limitations apply to every redevelopment plan adopted on or before 7 December 31, 1993. 8 E. Section 33333.6 further provides that unless a redevelopment plan adopted prior to said 9 date already contains limitations which comply with that section, the legislative body 10 shall adopt an ordinance on or before December 31, 1994 to amend the Redevelopment 11 Plan either; 1) to amend an existing time limit that exceeds the applicable time limit 12 established by that section, or 2) to establish time limits that do not exceed the provisions 13 of that section. 14 Section II 15 The time limit (duration) of the Redevelopment Plan is through September 27, 2001 and, 16 therefore, is in compliance with Section 33333.6 of the Community Redevelopment Law. 17 Section III 18 No time limit on the establishing of loans, advances, and indebtedness is set forth in the CBD 19 Plan adopted by Ordinance #1221 N.C.S., therefore, Section IV B.2.e. is hereby added to the 20 CBD Redevelopment Plan to read " The commission shall not establish or incur loans, adyances Ord. 197 3 NCS Page 2 of 4 I " ~ , 1 or indebtedness to finance, in whole or in part, the Central Business District Project after 2 September 27, 2001. 3 Section IV 4 The agency shall not pay indebtedness or receive property taxes pursuant to Health and Safety 5 Code 33670 after 10 years from the termination of the effectiveness of the Redevelopment Plan. 6 Therefore, based upon the termination of the effectiveness (duration) of the Redevelopment Plan 7 set forth in Section II above, Section IV B, l.c. is hereby added to the CBD Redevelopment Plan 8 to read "the agency shall not pay indebtedness nor receive property taxes in furtherence of the 9 CBD Redevelopment Project after September 27, 2011". 10 Section V 11 This ordinance amending the Redevelopment Plan is adopted pursuant to Health and Safety Code 12 Section 33333.6 in addition to the specific limitations established and amended as provided in 13 Sections II, III and IV of this ordinance, this ordinance hereby incorporates, by reference, those 14 provisions of subsections g and h of said Section 33333.6. 15 Section VI 16 The City Clerk is hereby directed to send a certified copy of this ordinance to the Petaluma 17 Community Development Coinmission. 18 Section VII 19 This ordinance shall be in full force and effect on the 31 st day following its adoption. Ord. 197 3 NCS Page 3 of 4 .~ 1 Section VIII 2 If any part of this ordinance is held to be invalid for any reason, such decision shall not affect the 3 validity of the remaining portion of this ordinance and the City Council hereby declares that it 4 would have passed the remainder of the ordinance if such invalid portion thereof had not been 5 deleted.
