BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS

28 Section l. Sections 3.08.020 "Safekeeping for Six Months", 3.08.030 "Redemption by
29 Owner - Charges", 3.08.040 "Delivery to Finder" and 3.08.050 "Disposition of Unclaimed
30 Money" of Chapter 3.08 "Disposal of Unclaimed Property" of the Petaluma Municipal Code are
31 hereby amended to read as follows:

33 3.08,020 - Safekeepireg for three months.
34 Property received as provided by Section 3.08.010 shall be
35 stored in a safe place and money so received shall be deposited with
36 the city treasurer for a period of three months, unless sooner
37 claimed by the true owner, and shall then be deemed to be

1 unclaimed property or unclaimed money and be subject to disposal
2 as provided in this chapter.

4 3.08.030 - Redemption by owner - Charges.
5 During the three-month period specified by Section
6 3.08.020, such property may be delivered or such money paid to
7 the true owner. Such property shall be delivered upon proof of
8 ownership satisfactory to the chief of police after ten days' notice
9 by mail to the person who delivered such property and to others
10 who have asserted a claim of ownership at any address given by
ll such persons. Such money shall be paid to the true owner upon
12 written order to the city auditor and city treasurer from the chief of
13 police. The chief of police shall make such order upon the same
14 proof of ownership and with the same notice as prescribed in the
15 case of property. Charges for the care of the property or money
16 not exceeding ten percent of the value of the property or the
17 amount of money may be charged for its safekeeping. If ownership
18 cannot be determined to the satisfaction of the chief of police he
19 may refuse to deliver such property or order the payment of such
20 money to anyone until ordered to do so by a court having
21 jurisdiction.

23 3.Q8.040 - Delivery to finder.
24 If the true owner of the property or money regulated by this
25 article does not appear during the three-month period and claim the
26 property or money, it may be delivered back to the person who
27 delivered it to the chief of police if, at the time of delivery, such
28 person indicated in writing that he wished to assert a claim to the
29 property or money as a finder. Charges may be imposed as
30 provided in Section 3.08.030.

3.08.050 - Disposition of unclaimed money.
All money received by the chief of police as provided by this
chapter and not delivered to the true owner during the three-month
period or to the finder shall within thirty days thereafter be
deposited in the general fund of the city.
Section 2. If any section, subsection, sentence, clause or phrase or word of this ordinance
is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this ordinance. The City Council of the
City of Petaluma hereby declares that it would have passed and adopted this ordinance and each
and all provisions thereof irrespective of the fact that any one or more of said provisions be
declared unconstitutional.
Section 3. The City Clerk is hereby directed to publish/post this ordinance for the period
and in the manner required by the City Charter.
