AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S.,

416 PAYRAN STREET, APN 007-690-026, FROM M-L, LIGHT INDUSTRIAL
DISTRICT TO PUD, PLANNED UNIT DISTRICT
HOSPICE OF PETALUMA
24 BE IT ORDAINED by the Council of the City of Petaluma as follows:

26 Section 1. The City Council finds that the Planning Commission filed with the City
27 Council on April 25, 1995, its report as set forth in its minutes of April 11, 1995,
28 recommending the adoption of an amendment to the Zoning Ordinance No. 1072 N.C.S.,
29 by reclassifying and rezoning certain lands being more particularly described as a 0.48 acre
30 parcel of land located at 416 Payran Street, APN 007-690-02b, from M-L, Light Industrial
31 District, to PUD, Planned Unit District.

33 Section 2. The City Council further finds that said Planning Commission held a public
34 hearing on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., as amended,
35 on April 11, 1995, after giving notice of said hearing in a manner, for the period and in the
36 form required by said Ordinance No. 1072 N.C.S., as amended.

38 Section 3. The City Council finds that the requirements of the California
39 Environmental Quality Act Guidelines have been satisfied and hereby incorporates by
40 reference the Mitigated Negative Declaration prepared and approved by the City Council
41 by Resolution g5-110 NC~n conjunction ~vith said rezoning and subsequent development of
42 a PUD Development Plan for an administrative office facility for Hospice of Petaluma

1 including ancillary facilities for individual and group counseling, and associated site
2 improvements.

4 Sectaon 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as
5 amended, the City Council finds the proposed amendment in general conformity with the
6 Petaluma General Plan, and further, that the public interest, convenience and general
7 welfare will be furthered by the proposed amendment.

9 Section 5. Pursuant to the provisions of the Zoning Ordinance No. 1072 N.C.S., as
10 amended, and based upon the evidence it has received and in accordance with the
11 following findings made, the City Council hereby adopts the amendment to said Zoning
12 Ordinance No. 1072 N.C.S. so as to reclassify and rezone said property hereinbefore
13 referred to in accordance with the recommendation of the Planning Commission.
P.U.D. Rezone Findings:
1. The rezoning to PUD and the PUD Development Plan, as conditioned, results in a
more desirable use of the land and a better physical environment than would be
possible under the current M-L district or any single zoning district by appropriately
defining the principally permitted uses and the fairly unique ancillary/accessory uses
of Hospice, and allow for reduced setbacks for site and building improvements
necessary to accommodate the intensive site demands of the use.
2. The circulation pattern of the proposed PUD has been largely dictated by the
development of Payran Street and adjacent facilities, and has been desi~ned to have
a suitable relationship to said circulation system. The existing circulation system is
adequate to accommodate the additional traffic impacts generated from the
proposed development.
3. The plan for the proposed development, as conditioned, presents a unified and
orgaruzed arrangement of buildings and site improvements which are appropriate in
relation to nearby properties. Adequate landscaping and screening will be reviewed
by SPARC to insure compatibility.
4. There are no significant scenic qualities of the site that wanant specific site design
alterations to insure their preservation. The plan will provide adequate available
outdoor/garden space as designated on the Development Plan.
5. The development of Hospice of Petaluma in the manner proposed by the applicant,
and as conditioned by the City will not be detrimental to the public welfare, will be
in the best interest of the City, and will be in keeping with the general intent and
spirit of the zoning regulations and General Plan of the City of Petaluma.
Section 6. The City Clerk is hereby directed to post this Ordinance for the period and in
the manner required by the City Charter.

IF ANY SEC"TION, subsection, sentence, clause or phrase or word of this ordinance is for
any reason held to be unconstitutional by a court of competent jurisdiction, such decision
shall not affect the validity of the remainin~ portions of this ordinance. The City Council of
the City of Petaluma hereby declares that it would have passed and adopted this ordinance
and each and all provisions thereof irrespective of the fact that any one or more of said
provisions be declared unconstitutional.
