Seconded by Councilmember Carole Barlas AN ORDINANCE OF THE CITY OF PETALUMA APPROVING AMENDMENTS TO THAT PORTION OF THE DEVELOPMENT AGREEMENT BETWEEN THE CITY OF PETALUMA AND DUFFEL FINANCIAL AND CONSTRUCTION CO. WHICH HAS BEEN ASSIGNED TO J.GRANDE INCORPORATED (NOW KNOWN AS J.G. ORRIS) RELATING ONLY TO UNIT II, PHASE 2 OF THE ADOBE CREEK GOLF AND COUNTRY CLUB PROPERTY (FORMERLY KNOWN AS MUIRWOOD GOLF AND COUNTRY CLUB) BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. The City hereby finds that the provisions of the amended Development Agreement (incorporated herein by reference) to incorporate an amendment to the Planned Unit Development Plan to: a. Amend the design of homes on the 159 unbuilt lots and modify setbacks and lot configurations involving some minor modifications to the lots lines and the open space easement boundaries adjacent to the golf course; and b. Substitute a private common area (park), for use by the homeowners, for a previously approved gold course lake; and C. Undertake creek (Adobe Creek) restoration, bank stabilization, and replanting measures is consistent with the General Plan and other applicable plans, policies and regulations of the City of Petaluma. Section 2. The City hereby approves the terms and conditions of said amended Development Agreement. Section 3. The Mayor or City Manager of the City of Petaluma is hereby authorized and directed to sign said amended Development Agreement on behalf of the City of Petaluma. 1 Ord. 1980 NCS 1�5. lob '�— i 1 2 3 4 5 6 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 Section 4. The City Clerk is hereby directed to post this Ordinance for the period and the manner specified by law. IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional.
