AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING
ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND
REZONING AN 6.3 ACRE PARCEL LOCATED AT 745 MCDOWELL BOULEVARD
NORTH FROM LIGHT INDUSTRIAL °M-L" TO PLANNED UNIT DISTRICT "PUD"
TO ALLOW THE DEVELOPMENT OF 132 AFFORDABLE RESIDENTIAL UNITS
KNOWN AS ROUNDWALK VILLAGE (APN 048-080-037)
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
Section 1. The City Council finds that the Planning Commission filed with the City Council
on March 21st, 1994 its report set forth in its minutes of February 23, 1994 and March 8,
1994 (File REZ93013) recommending the adoption of an amendment to the Zoning
Ordinance No. 1072 N.C.S., as amended, by reclassifying and rezoning certain lands being
more particularly described as Assessor's Parcel Number 048-080-037 as shown on "E~ibit
A", attached.
35 Section 2. The City Council further finds that said Planning Commission held a public
36 hearing on said proposed amendment on March 8, 1994, after giving notice of said
37 hearings, in the manner, for the period and in the form required by said Ordinance No.
38 1072 N.C.S.; as amended.

40 Section 3. The City CounciT further finds that the requirements of the California
41 Environmental Quality Act have been satisfied through the preparation and Certification
42 of an Environmental Impact Report for the Roundwalk Village Project (Certified approved
43 and adopted by Resolution No. 94-63 N.C.S.) and the adoption of a Resolution No. 94-64
44 N.C.S. making specific findings, adopting specific mitigation measures and adopting a
45 monitoring plan for each mitigation.

2 Section 4. Pursuant to the Provisions of Zoning Ordinance No. 1072 N.C.S., as amended
3 the City Council finds as follows:
I~ezoning FindYn~s:
1. The proposed Roundwalk Village PUD, as conditioned, is in compliance with the
goals and objectives of the General Plan.
2. The public necessity, convenience and general welfare clearly permit the adoption
of the proposed Rezoning.
3. The development plan, as conditioned, results in a more desirable use of the land
and a better physical environment than would be possible under any single zoning
district by providing affordable units in a creative design.
4. The plan for the proposed development, as conditioned, presents a unified and
organized arrangement of buildings and service facilities which are appropriate in
relation to nearby properties, and adequate landscaping and screening will be
reviewed by SPARC to insure compatibility.
5. The development of the Roundwalk Village project, in the manner proposed by the
applicant, will not be detrimental to the public welfare, provide much needed
affordable housing, will be in the best interest of the City, and will be in keeping
with the general intent and spirit of the zoning regulations and General Plan of the
City of Petaluma.
6. The circulation pattern of the proposed PUD plan, as conditioned, has been found
to have suitable relationship to the adjacent circulations system as conditioned. All
circulation and traffic impacts of the project can be mitigated through the
incorporation of specific mitigation measures identified in the FEIR prepared for
the project.
7. T'he development of the subject property, in the manner proposed by the applicant
and conditionally approved, shall continue to provide affordable housing for
families.
8. The natural and scenic qualities of the site will be preserved through the
incorporation of the biological mitigation measures identified in the DEIR prepared
for the project.

1 9. All requirements of CEQA have been adhered to through the preparation and
2 Certification of an Environmental Impact Report (EIR) which identified impacts
3 and proposed mitigations to avoid or mitigate all impacts to a level of insignificance.

5 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
6 any reason held to be unconstitutional by a court of competent jurisdiction, such decision
7 shall not affect the validity of the remaining portions of this ordinance. The City Council of
8 the City of Petaluma hereby declares that it would have passed and adopted this ordinance
9 and each and all provisions thereof irrespective of the fact that any one or more of said
0 provisions be declared unconstitutional.
