AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING
ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND
REZONING A 20.2 ACRE PARCEL WITHIN THE CORONA ELY SPECIFIC PLAN
AREA FROM PLANNED COMMUNITY DISTRICT "PCD" TO PLANNED UNIT
DISTRICT "PUD" TO ALLOW THE DEVELOPMENT OF 79 SINGLE FAMILY
RESIDENTIAL LOTS KNOWN AS CORONA CREEK
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
29 Section 1. The City Council finds that the Planning Commission filed with the City Council
30 on March 21, 1994 its report set forth in its minutes of February 22, 1994 (File REZ93014)
31 recommending the adoption of an amendment to the Zoning Ordinance No. 1072 N.C.S.,
32 as amended, by reclassifying and rezoning certain lands being more particularly described
33 as Assessor's Parcel Number 137-060-95 as shown on "Exhibit A", attached.

35 Section 2. The City Council further finds that said Planning Commission held a public
36 hearing on said proposed amendment on February 22, 1994, after giving notice of said
37 hearings, in the manner, for the period and in the form required by said Ordinance No.
38 1072 N.C.S.; as amended.

40 Section 3. The City Council further finds that the requirements of the California
41 Environmental Quality Act have been satisfied through the preparation and certification of
42 an Environmental Impact Report for the Corona Ely Specific Plan (Certified approved and
43 adopted by Resolution No. 89-122 N.C.S.) and pursuant to section 15182 of the CEQA
44 guidelines, no further environmental review is necessary.

1 Section 4. Pursuant to the Provisions of Zoning Ordinance No. 1072 N.C.S., as amended
2 the City Council finds as follows:
Rezoning Findings:
1. The development plan as conditioned results in a more desirable use of the land and
a better physical environment than would be possible under any single zoning
district by allowing the construction of smaller single family units with substantial
areas of landscaping along the creek and in separate open space parcels.
2. The plan for the proposed development, as conditioned, presents a unified and
organized arrangement of buildings which are appropriate in relation to nearby
properties and the PUD plan will be reviewed by SPARC to insure compatibility.
3. The development of the Corona Creek property in the manner proposed by the
applicant, and as conditioned by the City, will not be detrimental to the public
welfare, will be in the best interest of the City, and will be in keeping with the
general intent and spirit of the Corona Ely Specific Plan, the Zoning Regulations
and the General Plan of the City of Petaluma.
4. Tl~e circulation pattern of the proposed Planned Unit Development Plan has been
reviewed in the context of the development of the adjacent Colabianchi, Liberty
Farms and California Countryside II properties, and has been designed to be
compatible with the adjacent circulation patterns. C~.imulative traffic impacts from
the development of the Corona/Ely area have been addressed and mitigated
through the implementation of the Corona/Ely Specific Plan.
5. The proposed project has complied with the requirements of CEQA pursuant to
Section 15182 of the Guidelines, through preparation and certification of the EIR
for the Corona/Ely Specific Plan on May 1st, 1989 (Resolution No. 89-123 N.C.S.),
which addressed the potential environmental impacts associated with the
development of the Corona Creek parcel, and no further environmental analysis is
necessary.
6. Allowing the maintenance road on the southeast side of "Street E" to function as the
pedestrian sidewalk within the Corona Creek flood corridor will not be inconsistent
with the purpose of the flood control corridor but will improve access to the creek.
The reduction in the creek corridor width by 5' will not negatively impact the
hydrology of the creek corridor. The purpose of the corridor to mitigate the loss of
open space and mitigate the biological impacts of the Corona Ely Specific Plan will
be insured through the careful examination by SPARC of the landscaping plan
proposed for this area.

7. The natural and scenic qualities of the site will be protected through the
improvement, dedication and preservation of the Corona Creek corridor in
conformance with the Corona/Ely Specific Plan. The development plan provides
for adequate public open space along the creek and adequate private open space in
the individual front and rear yards.
IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
any reason held to be unconstitutional by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this ordinance. The City Council of
the City of Petaluma hereby declares that it would have passed and adopted this ordinance
and each and all provisions thereof irrespective of the fact that any one or more of said
provisions be declared unconstitutional.
