27 BE IT ORDAINED by the Council of the City of Petaluma makes certain findings as
28 follows:

30 Section 1. The City Council finds that the Planning Commission filed with the City
31 Council on October 12, 1993, its report as set forth in its minutes of September 28, 1993,
32 recommending the adoption of an amendment to the Zoning Ordinance No. 1072 N.C.S.,
33 by reclassifying and rezoning certain lands being more particularly described as a 1.05 acre
34 area of land located at 1393 Mountain View Avenue, AP No. 019-232-04 from R-1 20,000
35 (One Family Residential District) to R-1 8,000 (One Family Residential District).

37 Section 2. The City Council further finds that said Planning Commission held a public
38 hearing on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., as amended,
39 on September 28, 1993, after giving notice of said hearing in a manner, for the period and
40 in the form required by said Ordinance No. 1072 N.C.S., as amended.

42 Section 3. The City Council finds that the requirements of the California
43 Environmental Quality Act Guidelines have been satisfied and hereby incorporates by
44 reference the Negative Declaration prepared and approved by the City Council by

1 Resolution No.93-296 NC~n conjunction with said rezoning and subsequent development
2 of single family homes.

4 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as
5 amended, the City Council finds the proposed amendment in general conformity with the
6 Petaluma General Plan, and further, that the public interest, convenience and general
7 welfare will be furthered by the proposed amendment.

9 Section 5. Pursuant to the provisions of the Zoning Ordinance No. 1072 N.C.S., as
10 amended, and based upon the evidence it has received and in accordance with the
11 following findings made, the City Council hereby adopts the amendment to said Zoning
12 Ordinance No. 1072 N.C.S. so as to reclassify and rezone said property hereinbefore
13 referred to in accordance with the recommendation of the Planning Commission.

16 R-18,000 Rezone Findings:

18 1. T'he proposed rezoning is consistent with the Urban Standard land use designation
19 of the General Plan Land Use Map and with the policies of the General Plan
20 encouraging efficient use of available residential in-fill lands.

22 2. Public necessity, convenience and general welfare of the City of Petaluma clearly
23 permit the adoption of the proposed rezoning.

25 3. The proposed rezoning will serve as a transition for residential development
26 between the Mountain View Estates Subdivision and the Rancho Lindo Subdivision.

28 Section 6. The City Clerk is hereby directed to post this Ordinance for the period and in
29 the manner required by the City Charter.

31 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
32 any reason held to be unconstitutional by a court of competent jurisdiction, such decision
33 shall not affect the validity of the remaining portions of this ordinance. The City Council of
34 the City of Petaluma hereby declares that it would have passed and adopted this ordinance
35 and each and all provisions thereof irrespective of the fact that any one or more of said
36 provisions be declared unconstitutional.
