Introduced by Councilmember Lori Shea Seconded by Councilmember Bonnie Nelson AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND REZONING AN 18 ACRE PARCEL WITHIN THE CORONA ELY SPECIFIC PLAN AREA FROM PLANNED COMMUNITY DISTRICT "PCD" TO PLANNED UNIT DISTRICT "PUD" TO ALLOW THE DEVELOPMENT OF 82 SINGLE FAMILY RESIDENTIAL LOTS KNOWN AS SONOMA GLEN V(AKA CALIFORNIA COUNTRYSIDE II) BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: 32 Section 1. The City Council finds that the Planning Commission filed with the City Council 33 on September 20, 1993 its report set forth in its minutes of July 27, 1993 and August 24, 34 1993 (File REZ93005) recommending the adoption of an amendment to the Zoning 35 Ordinance No. 1072 N.C.S., as amended, by reclassifying and rezoning certain lands being 36 more particularly described as and 18 acre portion of Assessor's Parcel Number 137-060-86 37 as shown on "Exhibit A", attached. 38 39 Section 2. The City Council further finds that said Planning Commission held a public 40 hearing on said proposed amendment on July 27th, 1993, after giving notice of said 41 hearings, in the manner, for the period and in the form required by said Ordinance No. 42 1072 N.C.S.; as amended. 43 44 Section 3. The City Council further finds that the requirements of the California 45 Environmental Quality Act have been satisfied through the preparation and Certification 46 of an Environmental Impact Report for the Corona Ely Specific Plan (Certified approved Urd. 1q41 NCS 1 ~• 1 and adopted by Resolution No. 89-122 N.C.S.) and pursuant to section 15182 of the CEQA 2 guidelines, no further environmental review is necessary. 3 4 Section 4. Pursuant to the Provisions of Zoning Ordinance No. 1072 N.C.S., as amended 5 the City Council finds as follows: Rezoning and PUD Findin~s: 1. The development plan as conditioned results in a more desirable use of the land and a better physical environment than would be possible under any single zoning district by allowing the construction of smaller single family units with substantial areas of landscaping along the creek and Sonoma Mountain Parkway. 2. The plan for the proposed development, as conditioned, presents a unified and organized arrangement of buildings which are appropriate in relation to nearby properties and the PUD plan will be reviewed by SPARC to insure compatibility. 3. The development of the Sonoma Glen V property in the manner proposed by the applicant, and as conditioned by the City, will not be detrimental to the public welfare, will be in the best interest of the City, and will be in keeping with the general intent and spirit of the Corona Ely Specific Plan, the Zoning Regulations and the General Plan of the City of Petaluma. 4. The circulation pattern of the proposed PUD has been reviewed in the context of the development of the adjacent Colabianchi, Liberty Farms and remaining Sonoma Glen Properties, and has been designed to be compatible with the adjacent circulation patterns. Cumulative traffic impacts from the development of the Corona/Ely area have been addressed and mitigated through the implementation of the Corona/Ely Specific Plan. 5. The proposed project has complied with the requirements of CEQA pursuant to Section 15182 of the Guidelines, through preparation and certification of the EIR for the Corona/Ely Specific Plan on May lst, 1989 (Resolution No. 89-123), which addressed the potential environmental impacts associated with the development of the Sonoma Glen V parcel, and no further environmental analysis is necessary. 6. Allowing the sidewalk on the northwest side of "Street A" to be constructed within the Corona Creek flood corridor will not be inconsistent with the purpose of the flood control corridor but will function as an attractive design addition to the neighborhood. The purposed of the corridor to mitigate the loss of open space and mltigate the biological impacts of the Corona Ely Specific Plan will be insured through the careful examination by SPARC of the landscaping plan proposed for this area. 7. Allowing a reduction in the width of the corridor on the northwest side of the creek is not inconsistent with the policies and mitigation measures ado~ted with the Corona Ely Specific Plan because the conditions of project approval insure that the balance of the creek will be maintained on the southeast side of the creek. 8. The natural and scenic qualities of the site will be protected through the improvement, dedication and preservation of the Corona Creek corridor in Ord. 1q41 NCS 2 s 1 2 3 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 ~ 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 conformance with the Corona/Eiy Specific Plan. The development plan provides for adequate public open space along the creek and adequate private open space in the individual front and rear yards. The scenic qualities of the site will be further protected through conditions of project approval which require that opportunities for views of the creek and the Sonoma Mountains are provided through the trees and over the single-story homes. IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portians of this ordinance. 'I he City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional.
