Introduced by Vice Mavor Read Seconded by Carole Barlas AN ORDINANCE OF THE COUNCIL OF THE CITY OF PETALUMA AMENDING TITLE 4 "REVENUE AND FINANCE" OF THE PETALUMA 1VIUNICIPAL CODE BY RENUMBERING EXISTING SECTION 4.04.100 "INSPECTION AND TESTING" TO 4.04.110, ADDING A NEW SECTION 4.04.100 "COOPERATIVE PURCHASING PROGRAMS", AND MODIFYING SECTION 4.04.050 "BIDDING" BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. Section 4.04.100 "Inspection and Testing" of the Petaluma Municipal Code is hereby renumbered as 4.04.110. Section 2. A new Section 4.04.100 "Cooperative Purchasing Programs" of the Petaluma. Municipal Code is hereby added and shall read as follows: 4.04.100 Cooperative purchasing programs. Purchases of supplies and equipment made under a cooperative purchasing program with the state, county or other public agencies are exempt from the requirements of this chapter. Cooperative purchases joined will have been competitively awarded, and documentation as to the advantage of the cooperative purchase will be retained. Section 3. Section 4.04.050 of the Petaluma Municipal Code is hereby amended to read as follows: Section 4.04.050 Bidding. Purchases of supplies and equipment shall be by procedures pursuant to Sections 4.04.080, 4.04.090 and 1 Ord. 1938 NCS ~.. `~ t 1 4.04.100. Bidding shall be dispensed with only when an 2 emergency requires that an order be placed with the nearest 3 available source of supply, when the amount involved is less than 4 three thousand dollars, when the commodity can be obtained 5 from only one vendor, or when cooperative purchasing with the 6 state, county or other public agencies would result in a significant 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 economic or other advantage. Section 4. If any section, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional. Section 5. The City Clerk is hereby directed to postJpublish this ordinance for the period and in the manner required by the City Charter.
