AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S.,
BY RECLASSIFYING AND REZONING A 2.11 ACRE AREA OF LAND LOCATED AT
729 & 731 NORTII WEBSTER STREET, APNs 006-441-23, 24 & 006-371-20, FROM R-1
6,500 (ONE FAMILY RESIDENTIAL DISTRICT)
PLANNED UNIT DEVELOPMENT (PUD)
KINGSFIELD SUBDIVISION
23 BE IT ORDAINED by the Council of the City of Petaluma makes certain findings as
24 follows:

26 Section 1. The City Council finds that the Planning Commission filed with the City
27 Council on July 19, 1993, its report as set forth in its minutes of June 22, 1993,
28 recommending the adoption of an amendment to the Zoning Ordinance No. 1072 N.C.S.,
29 by reclassifying and rezoning certain lands being more particularly described as a 2.11 acre
30 area of land located at 729 & 731 North Webster Street, APNs 006-441-23, 24 & 006-371-
31 20 from R-1 6,500 (One Family Residential District) to Planned Unit Development (PUD).

33 Section 2. The City Council further finds that said Planning Commission held a public
34 hearing on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., as amended,
35 on June 22, 1993, after giving notice of said hearing in a manner, for the period and in the
36 form required by said Ordinance No. 1072 N.C.S., as amended.

38 Section 3. The City Council finds that the requirements of the California
39 Environmental Quality Act Guidelines have been satisfied and hereby incorporates by
40 reference the Mitigated Negative Declaration prepared and approved by the City Council
41 by Resolution g3=202NCSin conjunction with said rezoning and subsequent development of
42 a Single Family PUD.

1 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as
2 amended, the City Council finds the proposed amendment in general conformity with the
3 Petaluma General Plan, and further, that the public interest, convenience and general
4 welfare will be furthered by the proposed amendment.

6 Section 5. Pursuant to the provisions of the Zoning Ordinance No. 1072 N.C.S., as
7 amended, and based upon the evidence it has received and in accordance with the
8 following findings made, the City Council hereby adopts the amendment to said Zoning
9 Ordinance No. 1072 N.C.S. so as to reclassify and rezone said property hereinbefore
0 referred to in accordance with the recommendation of the Planning Commission.
P.U.I). Rezone Findings:
1. The rezoning to PUD and the PUD Development Plan, as conditioned, results in a
more desirable use of the land and a better physical environment than would be
possible under any single zoning district by providing the opportunity for smaller
lots of a unique style and configuration.
2. The circulation pattern of the proposed PUD has been dictated by the development
of the adjacent neighborhoods along North Webster Street, and existing access
easements for adjacent homes, and has been designed to have a suitable
relationship to the adjacent circulations system. The existing circulation system is
adequate to accommodate the additional traffic impacts generated from the
proposed development.
3. The plan for the proposed development, as conditioned, presents a unified and
organized arrangement of buildings which are appropriate in relation to nearby
properties. Adequate landscaping and screening will be reviewed by SPARC to
insure compatibility.
4. There are no significant scenic qualities of the site that warrant specific site design
alterations to insure their preservation, but the plan will provide adequate available
public and private spaces designated on the Development Plan.
5. The development of the Kingsfield Subdivision in the manner proposed by the
applicant, and as conditioned by the City will not be detrimental to the public
welfare, will be in the best interest of the City, and will be in keeping with the
general intent and spirit of the zoning regulations and General Plan of the City of
Petaluma.
Section 6. The City Clerk is hereby directed to post this Ordinance for the period and in
the manner required by the City Charter.
IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
any reason held to be unconstitutional by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this ordinance. The City Council of
the City of Petaluma hereby declares that it would have passed and adopted this ordinance
and each and all provisions thereof irrespective of the fact that any one or more of said
provisions be declared unconstitutional.
