16 AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S.
17 BY REZONING THE PROPERTY LOCATED WEST OF SONOMA MOUNTAIN
18 PARKWAY, BETWEEN RIESLING ROAD AND MADEIRA CIRCLE KNOWN
19 AS SONOMA GLEN TOWNHOMES (A PORTION OF THE SONOMA GATEWAY
20 SUBDIVISION), AP No's 137-220-01 THROUGH 29, 137-220-31
21 THROUGH 33, AND 137-060-83

24 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
25 FOLLOWS:

27 Section 1. The City Council finds that the Planning Commission filed with the City Council
28 on November 10, 1992, its report as set forth in its minutes of October 27, 1992,
29 recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., by
30 rezoning Assessor's Parcel Numbers 137-220-01 through 29, 137-220-31 through 33, and
31 137-060-83 from Planned Unit Development (P.U.D.) to P.U.D.

33 Section 2. The City Council further finds that said Planning Commission .held a public
34 hearing on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., on October
35 27, 1992 after giving notice of said hearing in the manner, for the period and in the form
36 required by said Ordinance No. 1072 N.C.S.

38 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., the City
39 Council finds that the proposed amendment is in general conformity with the Petaluma
40 General Plan, and further, that the public interest,. convenience and general welfare will be
41 furthered by the proposed amendment.

43 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended,
44 and based upon the evidence it has received and in accordance with the findings made as
45 follows, the City Council hereby adopts amendment to said Zoning Ordinance No. 1072

1 N.C.S. so as to rezone said property hereinbefore referred to in accordance with the
2 recommendation of the Planning Commission.

4 Findings for P.U.D. Rezoning:
5 1. The development plan as conditioned results in a more desirable use of the land and
6 abetter physical environment than would be possible under any single zoning
7 district by providing the opportunity for attached units of a unique style and
8 configuration.

10 2. The circulation pattern of the proposed PUD has been dictated by the development
11 of adjacent neighborhoods which include Glenbrook Phase 1-A, Sonoma Glen
12 Phase 2-A and Sonoma Mountain Parkway, and has been designed to have suitable
13 relationship to the adjacent circulations system. Cumulative traffic impacts from the
14 development of the Corona Ely area have been addressed and mitigated through
15 the implementation of the Corona/Ely Specific Plan.

17 3. The plan for the proposed development, as conditioned, presents a unified and
18 organized arrangement of buildings and service facilities which are appropriate in
19 relation to nearby properties and adequate landscaping and screening will be
20 reviewed by SPARC to insure compatibility.

22 4. There are no significant scenic qualities of the site that warrant specific site design
23 alterations to insure their preservation, but the plan will provide adequate available
24 public and private spaces designated on the Development Plan.

26 5. The development of the Sonoma Glen townhomes (Sonoma Glen 2-A, Parcel A and
27 Phase 2-B) in the manner proposed by the applicant, and as conditioned by the City
28 will not be detrimental to the public welfare, will be in the best interest of the City,
29 and will be in keeping with the general intent and spirit of the zoning regulations
30 and General Plan of the City of Petaluma.

32 Section 5. The City Council finds that the proposed project is exempt from the
33 requirements of the California Environmental Quality Act (CEQA) pursuant to Section
34 15182 since the project with recommended conditions of approval is in conformance with
35 the Corona/Ely Specific Plan and corresponding Environmental Impact Report.

Section 6. The City Clerk is hereby directed to post this Ordinance for the period and in
the manner required by the City Charter.
Section 7. If any section, subsection, sentence, clause or phrase or word of this ordinance is
for any reason held to be unconstitutional by a court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions of this ordinance. The City
Council of the City of Petaluma hereby declares that it would have passed and adopted this
ordinance and each and all provisions thereof irrespective of the fact that any one or more
of said provisions be declared unconstitutional.
11 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
12 any reason held to be unconstitutional by a court of competent jurisdiction, such decision
13 shall not affect the validity of the remaining portions of this ordinance. The City Council of
14 the City of Petaluma hereby declares that it would have passed and adopted this ordinance
15 and each and all provisions thereof irrespective of the fact that any one or more of said

provisions be declared unconstitutional.
