Introduced by Councilmember Vice Mayor Sobel. Seconded by Councilmember Jane Hamilton AN EXTENSION TO THE INTERIM ORDINANCE OF THE PETALUMA MUNICIPAL CODE PROHIBITING THE ESTABLISHMENT OR EXPANSION OF CARDROOMS WITHIN THE CITY LIMITS AND DECLARING THE URGENCY THEREOF, TO TAKE EFFECT IMMEDIATELY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. Chapter 6.20 of the Petaluma Municipal Code and the Zoning Ordinance provide regulations for the operation of cardrooms within the City of Petaluma. ection 2. The City Council found on February 16, 1993 that the provisions of Chapter 6.20 of the Petaluma municipal Code and the findings and considerations of a Conditional Use Permit established in Section 21-300 of the Zoning Ordinance insufficiently address the special nature of cardroom operations and that cardrooms present a significant demand for public services, particularly Police services. Section 3. The City Council found that the establishment of additional cardroom operations within the City will significantly affect the ability of the Police Department to provide service to other commercial uses as well as to residential areas of the City. Section 4. The City Council found that due to the potential degradation of the Police level of service to the communityresented by the establishment of additional cardrooms, an imminent danger to the public health, safety and welfare exists. The City Council therefore adopted as an urgency measure an Interim Ordinance suspending action on the establishment or expansion of cardrooms within the City for 45 days. Section 5. The City Council finds that specific regulations and standards should be established and adopted in the Zoning Ordinance to regulate cardroom operations and. that time is needed to review, establish, and adopt said regulations and standards and that therefore an extension of the Interim Ordinance for a period not to exceed 120 days is necessary to allow the establishment and adoption of these regulations. Section 6. Government Code Section. 65858 allows a legislative body to extend an Interim Ordinance after providing appropriate notice. Ord. 1920 NCS 1 Section 7. Notwithstanding any other provisions of the Petaluma Municipal Code or any 2 other Ordinance or regulations of the C>ty of Petaluma to the contrary, no application for 3 cardrooms shall be accepted, processed, approved or granted while this Ordnance is in 4 effect. 5 6 Section 8. With regard to an~ application for cardrooms under review by the City on the 7 date of the adoption of this Ordinance, no further processing shall occur. 8 9 Section 9. This Interim Ordinance shall in no way affect any cardroom in use or which 10 has received approval of a Conditional Use Permit prior to the date of the adoption of this 11 Ordinance. 12 13 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for 14 any reason held to be unconstitutional by a court of competent jurisdiction, such decision 15 shall not affect the validity of the remaining portions of this ordinance. The City Council of 16 the City of Petaluma hereby declares that it would have passed and adopted this ordinance 17 and each and all provisions thereof irrespective of the fact that any one or more of said 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 provisions be declared unconstitutional.
