HomeMy WebLinkAboutOrdinances 1918 02/16/1993t ~ 1 6 9~~3 3+ 4 5 6 7 8 9 10 ORDINANCE NO. 1918 N.C.S. 11 12 Introduced by Councilmember Seconded by Councilmember 13 14 Barlas Nelson 15 16 17 AN INTERIM ORDINANCE OF THE PETALUMA MUNICIPAL CODE 18 PROHIBITING THE ESTABLISHMENT OF CARDROOMS WITHIN 19 THE CITY LIMITS 20 21 22 BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS 23 FOLLOWS: 24 25 Section 1. Chapter 6.20 of the Petaluma Municipal Code and the Zoning Ordinance 26 provide regulations for the operation of cardrooms within the City of Petaluma. 27 28 Section 2. The Zoning Ordinance allows cardrooms, a type of commercial recreation, to be 29 established in any of three zoning districts upon the approval of a Conditional Use Permit. 30 31 Section 3. The City Council finds that the provisions of Chapter 6.20 of the Petaluma 32 Municipal Code and the findings and considerations of a Conditional Use Permit 33 established in Section 21-300 of the Zoning Ordinance insufficiently address the special 34 nature of cardroom operations. 35 36 Section 4. The City Council finds that cardrooms present a significant demand for public 37 services, particularly Police services. 38 39 Section 5. The City Council finds that the establishment of additional cardroom operations 40 within the City will significantly affect the ability of the Police Department to provide 41 service to other commercial uses as well as to residential areas of the City. 42 43 Section 6. The City Council finds that due to the potential degradation of the police level 44 of service to the community presented by the establishment of additional cardrooms, an Urd. 1918 NCS 1 1 imminent danger to the public health, safety and welfare exists. This Ordinance is declared 2 to be an Urgency Ordinance enacted for the preservation of the public health, safety or 3 welfare and shall go into effect immediately upon its adoption. 4 5 Section 7. The City Council finds that specific regulations and standards should be 6 established and adopted in the Zoning Ordinance to regulate cardroom operations and 7 that time is needed to review, establish, and adopt said regulations and standards and that 8 approval of any cardrooms could well result in cardrooms that were .inconsistent with 9 regulations and standards to be developed. 10 11 Section 8. Government Code Section 65858 allows a legislative body to adopt as an 12 urgency measure an Interim Ordinance prohibiting any use which may conflict with 13 contemplated zoning proposals. 14 15 Section 9. Notwithstanding any other provisions of the Petaluma Municipal Code or any 16 other Ordinance or regulations of the City of Petaluma to the contrary, no application for 17 cardrooms shall be accepted, processed, approved or granted while this Ordinance is in 18 effect. 19 20 Section 10. With regard to any application for cardrooms under review by the City on the 21 date of the adoption of this Ordinance, no further processing shall occur. 22 23 Section 11. This Interim Ordinance shall in no way affect any cardroom in use or which has 24 received approval of a Conditional Use Permit prior to the date of the adoption of this 25 Ordinance. 26 27 28 IF ANY SECTION, subsection, .sentence, clause or phrase or word of this Ordinance is for 29 any reason held to be unconstitutional by a court of competent jurisdiction, such decision 30 shall not affect the validity of the remaining portions of this Ordinance.
