TIIE COA~IPATIBILITY OF SERVICE AS A LOCAL GO~ERAi VIEIVT
OFFICIAL AND AS A IVIEA~IBER OF THE BOARD OF DIRECTORS
OF TIIE BURBANK DOUSING DEVELOPII~ENT CORPORATION
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUIVIA AS
FOLLOWS:

25 Section 1. The purpose of this ordinance is to abrogate the common law rule of
26 incompatibility of offices established in People ex rel. Chapman v. Rapsey (1940) 16 C.. 636,
27 640-641 as that rule may apply to membership on the board of directors of the Burbank
28 Housing Development Corporation, a California non-profit public benefit corporation
29 incorporated on November 28, 1992 with principle offices in Santa Rosa.

31 Section 2. The Petaluma City Council finds and determines that service as a City of
32 Petaluma public officer or employee is not incompatible with service as a member of the board
33 of directors of the Burbank Housing Development Corporation.

35 Section 3. Any Petaluma public officer or employee may serve as a member of the
36 board of directors of the Burbank Housing Development Corporation without terminating his
37 or her office or employment.

39 Section 4. If any section, subsection, sentence, clause or phrase or word of this
40 ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction,
41 such decision shall not affect the validity of the remaining portions of this ordinance. The City
42 Council of the City of Petaluma hereby declares that it would have passed and adopted this
43 ordinance and each and all provisions thereof irrespective of the fact that any one or more of
44 said provisions be declared unconstitutional.

Section 5. The City Clerk is hereby directed to post/publish this ordinance for the
period and in the manner required by the City Charter.
Section 6. This ordinance shall take effect thirty (30) days after its passage.
INTRODUCED and ordered posted/published this 19th day of January ,
1993.
