Seconded by Councilmember Lynn Woolsey AN ORDINANCE OF THE CITY OF PETALUMA AMENDING SECTION 6.20.020 OF THE PETALUMA MUNICIPAL CODE TO DELETE SUBSECTION RESTRICTING OPERATING HOURS FOR CARDROOMS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. Chapter 6.20 of the Petaluma Municipal Code regulates the operation of cardrooms, a type of commercial recreation. Section 6.20.020 of this Chapter establishes operating regulations. Subsection (B) requires that cardrooms cease operations and be vacated everyday between 2 AM and 9 AM. Section 2. Ms. Patti Gaeir applied to amend Section 6.20.020 of the Municipal Code to delete subsection (B), thereby eliminating restrictions to the hours of operation for cardrooms. Section 3. The City Council considered the request by Ms. Gaeir on October 19, 1992. Following discussion, the Council agreed that an amendment is reasonable and directed staff to prepare an amendment to the Municipal Code section. Section 4. The City Council finds that pursuant to Section 15061 (b)(3) of the California Environmental Quality Act (CEQA) Guidelines, the proposed amendment is exempt from CEQA. Section 5. The City Council finds as follows: 1. Interest exists within the community to permit appropriately licensed cardrooms to operate 24 hours/day. 2. Sufficient opportunities exist for staff and public review of cardroom application through the Conditional Use Permit process to guarantee that cardroom operations do not create conflicts in proposed locations. 3. The amendment to the Municipal Code to delete restriction upon operating houses for cardrooms will not be detrimental to the public health, safety and welfare. 4. The amendment to the Municipal Code conforms to intent and policies of the Petaluma General Plan. Ord. 1912 NCS ,,j.. ~ ' 1 Section 6. The City Council hereby amends 6.20.020 of the Municipal Code as follows: 6.20.020 Operating Regulations. A. A copy of this section, bearing the title "Operating Regulations", shall be posted conspicuously in every room in the establishment of such person in which card tables are used. B. No person who is intoxicated or under the influence of alcohol shall be permitted to participate either directly or indirectly in any game conducted or permitted or any of his employees. C. The fees charged by the operator to players shall be posted conspicuously in letters at least one inch high. (Ord. 1417 NCS 1, 1980: Ord. 1024 NCS : Ord. 32 NCS 7: prior code 8.2) 19 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for 20 any reason held to be unconstitutional by a court of competent jurisdiction, such decision 21 shall not affect the. validity of the remaining portions of this ordinance. The City Council of 22 the City of Petaluma hereby declares that it would have passed and adopted this ordinance 23 and each and al] provisions thereof irrespective of the fact that any one or more of said 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 provisions be declared unconstitutional.
