Seconded by Councilmember Read AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S. BY RECLASSIFYING AND REZONING ASSESSOR'S PARCEL NUMBER 137-060-69 (7.5 ACRE PORTION) KNOWN AS SONOMA GLEN ESTATES SUBDIVISION FROM PCD (PLANNED COMMUNITY DISTRICT) TO PUD (PLANNED UNIT DISTRICT), LOCATED ON CORONA ROAD WEST OF ELY ROAD BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: 27 Section 1. The City Council finds that the Planning Commission filed with the City Council 28 on October 13, 1992, its report as set forth in its minutes of October 13, 1992, 29 recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., by 30 reclassifying and rezoning a 7.5 acre portion of Assessor's Parcel Number 137-060-69 from 31 PCD to PUD (Planned Unit District). 32 33 Section 2. The City Council further finds that said. Planning Commission held a public 34 hearing on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., on October 35 13, 1992, after giving notice of said hearing in the manner, for the period and in the form 36 required by said Ordinance No. 1072 N.C.S. 37 38 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., the City 39 Council finds that the proposed amendment is in general conformity with the Petaluma 40 General Plan, and further, that the public interest, convenience and general welfare will be 41 furthered by the proposed amendment. 42 43 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended, 44 and based. upon the evidence it has received and in accordance with the findings made, the 45 City Council hereby adopts amendment to said Zoning Ordinance No. 1072 N.C.S. so as to 1 Ord. 1910 NCS A.~ >; 4 1 reclassify and rezone said property hereinbefore referred to in accordance with the 2 recommendation of the Planning Commission. 3 4 Section 5. The City Council finds that the requirements of the California Environmental 5 Quality Act Guidelines have been satisfied through the preparation and certification of the 6 Corona/Ely Specific Plan Environmental Impact Report, and that the proposed Sonoma 7 Glen Estates project will conform to applicable provisions of the Corona/Ely Specific Plan, 8 and is therefore exempt from further Environmental review pursuant to Section 15182 of 9 the CEQA Guidelines. 10 11 Section 6. The City Clerk is hereby directed to post this Ordinance for the period and in 12 the manner required by the City Charter. 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional.
