Page 1 of 2 Resolution No. 2025-113 N.C.S. of the City of Petaluma, California RESOLUTION RECOMMENDING THAT THE WATER ADVISORY COMMITTEE SUPPORT THE SONOMA-MARIN WATER SUPPLY AGREEMENT UPDATE WHEREAS, the City of Petaluma is a signatory to the 2006 Restructured Agreement for Water Supply with Sonoma Water and a participating member of the Water Advisory Committee (WAC) and Technical Advisory Committee (TAC); and WHEREAS, Marin Municipal Water District (“Marin Water”) receives water from Sonoma Water under agreements that expired on June 30, 2025, prompting the need for an updated and consolidated agreement; and WHEREAS, Sonoma Water and Marin Water have collaboratively developed a Draft Amended and Restated Water Supply Agreement, Attachment 4 to the Staff Report, that integrates and simplifies prior agreements while maintaining core provisions and addressing modern operational and climate realities; and WHEREAS, the Draft Agreement includes a revised 15-year term, refined delivery provisions, a new lump sum contribution from Marin Water to support regional water resiliency projects, and affirms Marin Water’s participation in renewal discussions regarding the 2006 Restructured Agreement; and WHEREAS, Petaluma staff have actively participated in reviewing the proposed agreement to ensure consistency with the 2006 Restructured Agreement, in coordination with the TAC Chair, Vice Chair, and other member agencies; and WHEREAS, the TAC, including Petaluma representatives, voted at its June 2, 2025 meeting to recommend approval of the Draft Agreement, recognizing its benefits for operational clarity, fairness, and interagency cooperation; and WHEREAS, supporting the Sonoma-Marin Water Supply Agreement Update reinforces the City’s commitment to regional water resiliency, sustainability, and long-term planning as outlined in the City Council’s environmental and climate action goals. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Petaluma as follows: 1. Declares the above recitals to be true and correct and are incorporated into this resolution as findings of the City Council. 2. Finds that this item is exempt from the California Environmental Quality Act (CEQA) in accordance with CEQA Guidelines Section 15061(b)(3), which established the general rule for projects concerning which it can be seen with certainty that there is no possibility that the activity in question may have a significant effect Docusign Envelope ID: AF8F24BC-2269-4808-AD97-93DD7DD4F77D Resolution No. 2025-113 N.C.S. Page 2 of 2 on the environment. Here City Council is providing direction to the WAC liaison about how to vote on an item before the WAC, which is the lead agency under CEQA. 3. Supports the Sonoma-Marin Water Supply Agreement Update, attachment 4 to the concurrent staff report, and that the Water Advisory Committee vote to Adopt the Agreement. Under the power and authority conferred upon this Council by the Charter of said City.
