AN ORDINANCE AMENDING ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY
RECLASSIFYING AND REZONING THE PROJECT KNOWN AS CORONA RANCH
(ASSESSOR'S PARCEL NUMBER 137-060-59) FROM PCD TO PUD
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
23 Section L The City Council finds that the Planning Commission considered and
24 recommended approval of an application by Eden Housing to amend Zoning Ordinance
25 No. 1072 N.C.S., as amended, to reclassify and rezone certain a 5.14 acre parcel on the
26 northwest corner of the newly constructed intersection of Sonoma Mountain Parkway and
27 Ely Road, during a public hearing on August 11th, 1992; after giving notice of said hearing
28 in the manner, for the period, and in the form required by said Ordinance.

30 Section 2. Upon recommendation of the Planning CJ1T1rn1SSlOn, the City Council has
31 adopted Resolution No. 92-254 approving a Mitigated Negative Declaration of
32 EnvironmentalImpacts.

34 Section 3. Upon the Recommendation of the Planning Commission, pursuant to the
35 provisions of Ordinance No. 1072 N.C.S., as amended, the City Council .finds the following:

37 Findings:
38 1. The proposed Corona Ranch PUD, as conditioned, is in compliance with the goals
39 and objectives of the General Plan and the Corona/Ely Specific Plan.

41 2. The development 1?lan, as conditioned, results in a more desirable use of the land
42 ar.d a better physical envirom:ne:nt than would be possible under any single zoning;
43 district by providing affordable knits in a creative design..

2 3. The plan for the proposed development, as conditioned, presents a unified and
3 organized arrangement of buildings and service facilities which are appropriate in
4 relation to nearby properties, and adequate landscaping and screening will be
5 reviewed by SPARC to insure compatibility.

7 4. The development of the Corona Ranch project, in the manner proposed by the
8 applicant, will not be detrimental to the public welfare but will provide much
9 needed affordable housing, will be in the best interest of the City, and will he in
10 keeping with the general intent and spirit of the zoning regulations and General
Ll Plan of the City of_Petaluma.

13 5. The circulation pattern of the proposed PUD plan, as conditioned, has been found
14 to have suitable relationship to the adjacent circulations system as conditioned.
15 Cumulative traffic impacts from the development of the Corona/Ely area have been
16 addressed and mitigated through the implementation of the Corona/Ely Specific
17 Plan.

19 6. The development of the subject property, in the manner proposed by the applicant
20 and conditionally approved, shall continue to provide affordable housing for
21 families, as required by Section 2 of the Option Agreement between the City of
22 Petaluma and Eden Housing; Inc. dated February 26, .1992 and recorded on March 10,
23 1992, Series No. 0025533 of Sonoma County Records.

25 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended,
26 and based upon the evidence it has received and in accordance with the findings made, the
27 City Council hereby adopts amendment to said Zoning Ordinance No. 1072 N.C.S. so as to
28 reclassify and rezone said property herein before referred to; and

30 Section 5. The City Clerk is hereby directed to post this Ordinance for the period and
31 manner required by the City Charter.

33 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
34 any reason held to be unconstitutional by a court of competent jurisdiction, such decision
35 shall not affect the validity of the remaining portions of this ordinance. The City Council of
36 the City of Petaluma hereby declares that it would have passed and adopted this ordinance

and each and all provisions thereof irrespective of the fact that any one or more of said
provisions be declared unconstitutional.
