Summary Statement:
The City received five bids for the Bodega Avenue Improvement Project ranging from $2,339,803 to
$2,539,472.. The project involves various infrastructure improvements in Bodega Avenue from North
Webster Street to the City limit, including aesthetic treatments,such as street trees, historic street lights,
wood fencing, sand-washed sidewalks, brick-like-textured asphalt left-turn lane, and red epoxy coated
bicycle lanes.

FOR
BODEGA AVENUE?IMPROVEMENT PROJECT
1. EXECUTIVE SUMMARY:
The City received five bids for the Bodega Avenue.Improvement,Project.ranging from
$2,339,803 to $2,539,472. The project involves various infrastructure•improvements in Bodega
Avenue from North Webster Street to the.Citylimit, including aesthetic treatments such as street
trees, historic streetlights, wood fencing, sand-washed sidewalks, brick-like textured asphalt
left-turn lane, and red epoxy coated bicycle,lanes.
2. BACKGROUND: •
The City Council approved the project on March 22, 1999 (Exhibit `B"). The proposed
improvements include a new traffic signal at Bantam Way, a modified traffic signal at North
Webster Street, a two-way left turn,.bike.lanes, sidewalks, curb ramps, street trees, the upgrade
of utilities such as storm drainage,.water.and sanitary sewer mains;.asphalt overlay, and historic
style street lights.
The Bodega Avenue Improvement:Project will address an,existing,safety issue related to left turn
movements in the area. The projectalso advances the City's General Plan policies to construct
bike lanes, pedestrian walkways, and:install street trees along arterial roads. In addition to
making the road safer, the project's'aesthetic improvements will serve as traffic calming
measures to slow motorists.
The West View Estates Subdivision frontage improvements are•no.longer combined with the
Bodega Avenue Widening Projectand will be constructed separately by the developer.
The residents along Bodega Avenue have indicated they have•been waiting for the,improvements
• for a long time and are anticipating the construction to occur this;summer. The plans and
specifications prepared by Carlenzoli.and'Associates are available for review at the Department
of Public Facilities and Services.
Bids were opened on April 3,2001 for the Bodega Avenue Improvement Project. The following
is the summary of the bids:

4. FINANCIAL IMPACTS:
The estimated total project cost, including planning -design;_construction, inspection,
administration, testing and projectrcontingency is $3,399,000. This project is,listed in the Streets
Section of the 5-Year Street Capital ImprrovementPlan for transportation improvements. This
project is funded by the Traffic'Mitigation Fees, Transportation.Funding for Clean Air Act
(TFCA), Water Fund, Storm Drainage'Mitigation Fees, and Water Pollution Control Fund.
5. CONCLUSION:
City personnel believe that the City-received good bids since the low bid was close to the
Engineer's estimate.
Following the award, the contractor will enter into a contract withihe.City and submit the
required contract documents; bonds and insurance. The Bodega Avenue Improvement Project
will begin immediately after the construction contract is executed-and'construction is anticipated
to start in June, 2001 and be completed'March, 2002.
6. OUTCOMES OR PREFORMANCEMEASUREMENTS'THAT WILL IDENTIFY SUCCESS OR.
COMPLETION:
•
The contractor will start construction of the Bodega Avenue improvements.
7. RECOMMENDATION:
Adopt the resolution approving the plans and .specifications, prepared by Carlenzoli and
Associates; and award the contract to the low bidder, North Bay Construction, for $2,339,803
and authorize the Contractor to purchase signal materials once the bonds, insurance and
agreement have been approved by,the Director of Public;'Facilities and Services, City of
Petaluma Attorney and Director of Human Resources/Risk ;Management, but prior to the

Street, Petaluma, CA 94954, in the amount of$2,339,803;
3. The project budget of$3,399,000 from a combination finding of Traffic Mitigation Fees
($2,362,000), Transportation Funding for Clean Air Act ($92,000), Water Fund
($444,000),Storm Drainage Mitigation Fees ($288,000), and Water Pollution Control
Fund'($213,000) is hereby approved for planning, design, administration,construction,
inspection, and project contingency,

4. Since-there is a long lead time for the delivery of the signal light material,and
the long lead°time may affect the completion of the project in a timely manner; and
the Contractor is hereby authorized to purchase materials once the bonds, insurance and
agreementfhave been approved by the Director of Public Facilities and Services, City •
Attorney andthe.Director of Human Resources/Risk Management, but prior to the
execution of the agreement by the Director of Finance, the City Manager and the City
Clerk.
BE IT FURTHER RESOLVED that the City Manager is hereby authorized to execute the
contract.with North Bay Construction subject to the review and approval of all contract
documents, insurance certificates and bonds by the City Attorney.

9 WHEREAS, the City of Petalutria is the proponent,for a project to improve Bodega Avenue
0 from the intersection at.North Webster Street to the city Iiinits (approximately 200 hundred feet.
ii past Bantam Way). The proposed imptovements include replacing::the signal at North Webster
12 Street; and install a new traffic Signal at Bantam Avenue,.a middle turn lane to provide for left-
13 turn movements, bike lanes, sidewalks, pedestrian ramps,.planter strips and street trees. The

14 project also includes the..replace/tent- of utilities including storm'drains, water and sewer lines
if and an asphalt overlay, Some right.-of-way acquisition is required on certain properties, and

17 WHEREAS, a. Neighborhood Wor'.kshop. was held on November 20, 1997, to meet with the
0 3 residents in the project area and assess any special concerns they may have and their preference
, for either separated or monolithic sidewalk in.front of their property, and

1 WHEREAS, a subsequent'meetina:was held on December 17, 1997, with the owners of the six
22 parcels (401-551 Bodega Avenue) on.the south side Of Bodega Avenue west of North Webster
2 3 Avenue to address the location of the sidewalk, and

WHEREAS, other meetings were'held on January 7 and September 23, 1998, with Mr. Gilardi
26 and the tenants of the market/bait;shop, floor covering and.dairy supply at 384 Bodega Avenue

30 WHEREAS, on Feorua:y 4, 1993, the Site Plan and Architectural Committee (SPARC)

31 reviewed and approved the design plans for improvements to irelude a street tree'planrer strip or

approval are incorporated inahe,approval.of'this impro,:fernent'project, and

WHEREAS, an Initial Study was prepared and the results of the study indicated that the
3 proposed Bddega Avenue Widening Project, as mitigated, will not cause any significant adverse
4 environmental impacts; and all mitigations are incorporated into the approval of the project,.and

6 WHEREAS, the City Council held a•noticed public hearing on the Bodega Avenue Widening
7 Project on December 7, 1998, and considered all written and verbal communications concerning •
s potential environmental impacts resulting from the project before rendering:a decision.

10 NOW, THEREFORE, BE IT RESOLVED that the Ciry Council approves the Mitigated
11 Negative Declaration and Bodega Avenue Widening Project from North Webster Street to the
12 city limits (approximately 200 feet past Bantam Way), subject to the following, Findings and

26 each direction..shall be maintained at all times through the construction period, unless a
27 temporary detourplan is submitted and approved by'the Ciri Traffic Engineer. During
23 non-working hours, open trenched and construction hazards shall be provided with
29 signage, flashers, and'baricades approved by the street superintendent to warn oncoming
=n motorists, bicyclists, and pedestrians of potential safety hazards.

_PROJECT SCOPE
Widen Bodega.Avenue from No. Webster to City limits•in accordance with a plan line study
(scheduled in FY 91-98)which will determine geometries based upon public hearings and
environmental.reyiew. The proposed project will include two through lanes, one dual left turn
center lane, and bike lanes on both4sides of the street.
The West View subdivision has been approved along this section of roadway. Conditions for
approval of the subdivision require that the roadway be widened fronting'the subdivision. City
staff has met with the developer who is considering combining his project with the construction
' of the City's widening project. The advantage of a combined project is that the construction will
impact the neighborhood once, and costs may be lower because of a larger project.
The City Council has expressed as their:first priority, the undergrounding of all overhead utilities
along Bodega Ave. from the City limits to-Howard St. (3,600 feet). Although the
undergrounding will.occur after the,Bodega widening improvements have been completed, the
widening improvements will include:the:installation of empty ducts across Bodega Ave. for the
undergrounding of the future service crossings. The County has'approvedd a request by the City
to participate in a joint undergrounding;project on,Bodega Ave. Under this proposal, the Count,/
will form an underground utility district on'the,portion of Bodega Ave. in the County, from the
City limits to Cleveland Lane (1.300 feet). Both the City and the County's underground utility
• districts would be designed and constructed as one project. It is anticipated that the districts will
be fouled in FY 2000 to 2002, with the utilities being undergoing approximately two to three
years later.
The County widened Bodega Ave. from the City limits to Cleveland Lane in 1997. Funds were
included in FY 96-97 to reimburse the County for roadway transition work in the City at the
City's limit.
Phase II. the widening Bodega Ave. from Howard to No Webster, is included in the anticipated
project-list as a future project when funds become available.

Lane.

I. EXECUTIVE SUMMARY:
The City received four bids for the Bodega Avenue Improvement Project ranging from
$1,934,644 to $2,279,587. Of the four bids, the two lowest bids have deficiencies that make
them non-responsive bids. The project as bid included various infrastructure improvements in
Bodega Avenue from North Webster Street to the City limit, for both the City's.project as well as
the required frontage improvements for the West View Estates Subdivision. The type of
improvements included aesthetic treatments such as street trees, historic street lights, wood
fencing, sand-washed sidewalks, brick-like textured asphalt left-turn lane. and red epoxy coated
bicycle lanes. The City Council approved the project on Mareli.22, 1999 (Exhibit-1").
2. BACKGROUND:
Bids were opened on February 24, 2000.for the Bodega Avenue;Improvement.Project. The City
Council approved the project on March 22, 1999. The proposed'improvements include a new
traffic signal at Bantam Way„a,modified traffic signal at North:Webster Street, a two-way left
turn, bike lanes, sidewalks, curb ramps, streettrees,•the upgrade of utilities such as stoup
drainage, water and sanitary sewer mains, asphalt overlay, and historic style street lights.
The Bodega Avenue Improvement Project would address an esistingsafety issue related to left
turn movements in the area. Thepfoject.also advances the City's General Plan policies to
construct bike lanes, pedestrian"walkways,;and install street,trees along arterial roads. In
addition to making the rdad`saferthe project's aesthetic improvements will serve as traffic
calming measures to slow'motorists.
Following.receipt of the bids, the third low.bidder,North Bay Construction Inc., protested that
the low bidder, Argonaut Constructors, did not list subcontractors for bid items Fl through F15
(landscaping items) and B23rthrough B25 (street imprinting/texturing.items).
They also protested that ,Argonaut did not initial two crossed out unit bid items on the bid
proposal. North Bay Construction also protested that the second low bidder, Ghilotti Brothers
Construction, Inc., did not fill.in:both the,unit bid price and the total price columns;for two bid
items on the bid proposal, did not list a subcontractor for bid item B49 (joint trench item) or B23
through B25 (street imprinting/textured items), and did not fill out the list of material suppliers
(see Exhibit"C" for North Bay Construction's bid protest).
• The third low bidder, North.Bay Construction, Inc., also made'one.error on his bid. Forbid item
F5 North Bay Construction wrote down $2, 130.00 instead of 32,432.00 in the total price column
for this item.

The fourth low bidder did not list a subcontractor for bid items B23 through B25 (street •
imprinting/texturing).
In response to North Bay Construction's protest, Argonaut Constructors defended that: a) it
inadvertently omitted to list the name of their landscape subcontractor from whom they received
a quotation prior to the bid opening and requested that he be allowed to add Bauman Landscape
Inc. to the subcontractor list. In the event that their request for adding their landscape
subcontractor is denied, as a class A licensed contractor,Argonaut Constructors is fully qualified
by law to perform the landscaping work by its own forces without the need to subcontract the
work;.and b) he contended that it did list Oak Grove Construction, a certified/ licensed:installer
for,street=imprinting/texturing bid items on the subcontractor list but incorrectly referenced bid
;item numbers B27 through B29 instead of B23 through B25 (see Exhibit "D" for Argonaut's
response to North Bay's bid protest).
The second 1ow bidder did.not submit his response to the protest.

The City Attorney's office has reviewed,the bids and the bid protest and has determined that the
bids of Argonaut Constructors,and Ghilotti Brothers,;Inc. do:not appear to be responsive, and
that the deficiencies in the two lowest bids cannot be waived. Therefore, it is recommended that
the City Council reject all bids. In addition to the bid irregularities, a key factor for not awarding
this project at•this-time of the year is that the construction would be partially complete when
winter arrives. This may result in the project to be shutdown over the winter. Depending on the
severity of the winter, the partially completed work could become a nuisance to the community
and nearby residents. There will also be unknown added costs associated with a project delay.

The undergrounding of utilities on Bodega Avenue was a key item,of discussion for the City
Council at`their March 22, 1999 meeting. The Council requested:
1) that City personnel look into the City forming an underground utility district for the
Bodega Avenue corridor,
2) that the utilityundergrounding required as a condition of the frontage improvements for
West View Estates be combined with a larger future City underground district; and
3) conduits (empty ducts) be installed across'Bodega Avenue as part of the current road
widening improvements. Theseconduitswould provide the crossings for future
.undergroundectservices.
Following,the Council's request City personnel received'approval from Sonoma County to-do a
joint City/County underground district alon g.Bodega Avenue from Howard Street on the east, to
Cleveland Lane in.the County on the west (Exhibit t"J"). 'The undergrounding of tte utilities is
scheduled for.year`2004 or 2005 (see Exhibit "J").
In-lieu of the.West View Estates undergrounding their frontage at this time West View Estates
has agreed to deposit an estimated 5212.195 with the City to underground their frontage with the
City/County underground district in the future. This cost includes the installation of the empty
MIF
conduits across Bodega Avenue for the future underground utility district. The funds will be

deposited within60',days Of adoption the resolution,by the City Council that amends the
•0subdivision agreement. Undergrounding the City, County ,and subdivision at'the same time is
the preferred project'iaccordtng^to'the utility'companies. West View Estate's share was estimated
' by the three affected,utility companies.

3. ALTERNATIVES:
1. Reject all bids and re-advertise for bids in 2001 with the City's,portion of improvements
only and without the West View Estates Subdivision improvements (see Resolution.
Exhibit K-1). Also amend West View Estates Subdivision.Agreement (see Resolution,
Exhibit K-2) to allow the subdivisioato contribute $212195 to the City's undergound
0 utility fund for the future,:undergroundingof utilities along'Bodega Avenue, in lieu of
undergrounding their utilities.along Bodega Avenue with the construction of the
subdivision's frontage improvements,and require the subdivision to modify their frontage
improvements along Bodega Avenue to match the City's future roadway improvements.
Under this alternative,the developer of West View Estates;'Subdivision would move
forward with completing their required frontage improvements along Bodega Avenue,
except for the undergrounding of utilities. The subdivision's improvements would
include the same aesthetic treatments as-the City's project.
2. Reject all bids•and re-advertise for bids in 2001, without,the West View Estates
Subdivision improvements (see Exhibit B-1). Require the West View Estates
Subdivision to move forward with their required frontage improvements immediately.

3. Approve the plans and specifications prepared by Mogel Engineering Inc'., reject the low

combined City project and the frontage improvements for West View Estates
Subdivision. As previously mentioned, awardingla,project at this•time of the year would
result in the construction being partially complete when winter arrives. This may require
that the project to be shut down over.the winter.

4. FINANCIAL IMPACTS: •
Financial impacts for alternative 1:
The cost'to.revise the City plans and re-advertise the project',in 2001 is estimated at $40,000.
This cost includes revising the City's plans and re-advertising ($15.000), and modifying the
frontage improvements of West View Estates Subdivision to incorporate the City's future
improvements ($25,000). It was always intended that the City would pay for these modifications
The total cost for are-advertised project that is constructed in 2001 may be hishernext year
because of inflation. For example, if the:construction costs were to rise by 5%, the added cost to
the bids would be approximately $31,000. However, this is an unknown factor.

The increase in the.bidcost from the low'bid to the third.loiv bid is $102.774. However, of this
amount, West View Estates' share of the above cost is $61294, for a net increase cost to the City
of$41,430. To this cost must be added the unknown delay cost to shut the project down during
•the winter, and to winterize the site.
5. CONCLUSION:
The bids from all;four contractors had irregularities. The low bid and second low bid had
irregularities that cannot be waived. Since the third low bid was above the engineer's estimate.
and since awarding a,contract at this time would cause the work to extend into and beyond the
winter, it would be best for the project to be re-advertised and constructed in 2001. West View
Estates,Subdivision should be required to complete their frontage improvements separate from
the City improvements so that they are completed in a timely fashion along With the.
development.
6. RECOMMENDATION:
It is recommended that the City Council adopt a resolution rejecting all bids for the Bodega
Avenue Improvement Project and authorize City personnel to re-advertise for bids in 2001 with
the City's portion of improvements only and without the West View Estates Subdivision
frontage improvements. It is also recommended that the City Council adopt a resolution
amending West View Estates' _Subdivision. Agreement to allow the subdivision to contribute
$212,195 to the City's;Underground Utility Fund for the future undergrounding of utilities,along
Bodega Avenue, in lieu of undergrounding their utilities along Bodega Avenue: with the
construction of the'subdivision's frontage improvements: require the subdivision to modify their •
frontage improvements along Bodega Avenue to match the City's future roadway improvements;
