Introduced by Councilmember Jack Cavanagh Seconded by Councilmember Michael Davis AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND REZONING THE LANDS KNOWN AS CRANE GLEN SUBDIVISION (APN 136-120- 24) FROM PCD TO PUD BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. The City Council finds that the Planning Commission filed with the City Council on May 18, 1992 its report set forth in its minutes of April 14, 1991 (File REZ91016) recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., as amended, by reclassifying and rezoning certain lands being more particularly described as Assessor's Parcel Number 136-120 (attached as "Exhibit A") from Planned Community District to Planned Unit Development. Section 2. The City Council further finds that said Planning Commission held public hearings on said proposed amendment on February 25th, March 10th and April 14th, 1992, after giving notice of said hearings, in the manner, for the period and in the form required by said Ordinance No. 1072 N.C.S.; as amended. Section 3. The City Council further finds that the requirements of the California Environmental Quality Act have been satisfied through the preparation and certification of an Environmental Impact Report for the project as a part of the Corona/Ely Specific Plan Area (certified by Resolution No. 89-122 N.C.S.) and the a preparation of an Initial Study/Mitigated Negative Declaration to address the project specific impacts (issued by Resolution No. 92-118 N.C.S. Section 4. Pursuant to the Provisions of Zoning Ordinance No. .1072 N.C.S., as amended the City Council finds as follows: 1. The development plan as conditioned results in a more desirable use of the land and a better physical environment than would be possible under any single zoning district by providing the opportunity for small detached units of a unique style. 2. The plan for the proposed development, as conditioned, presents a unified and organized arrangement of buildings and service facilities which are appropriate in Ord. 1889 N.C.S. relation to nearby properties and adequate landscaping and screening will be reviewed by SPARC to insure compatibility. 3. The loss of the scenic qualities of the site will be mitigated through an intensive replanting plan, which will he subject to approval by SPARC. 4. The development of the Crane Glen (Swan) property in the manner proposed by the applicant, and as conditioned by the City to mitigate visual impacts from the loss of trees, will not be detrimental to the public welfare, will be in the best interest of the City, and will be in keeping with the general intent and spirit of the zoning regulations and General Plan of the City of Petaluma. 5. The circulation pattern of the proposed PUD has been dictated by the development of the adjacent Mountain Valley and has been designed to have suitable relationship to the adjacent circulations system. Cumulative traffic impacts from the development of the Corona Ely area have been addressed and mitigated through the implementation of the Corona/Ely Specific Plan. IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional.
