13 THE PETALUMA MUNICIPAL CODE BY ADDING CHAPTER 11.9®
14 TRIP REDUCTION ORDINANCE

16 WHEREAS, Government Code Section 65089.3(2) requires that each city and the
17 county adopt and implement a Trip Reduction Ordinance (TRO); and
18 WHEREAS, in order to be in compliance with the adopted Congestion Management
19 Program (CMP) and therefore, eligible for Section 2105 monies, each jurisdiction must adopt
20 an ordinance developed to meet minimum standards adopted by the Sonoma County
21 Transportation Authority; and
22 WHEREAS, Trip Reduction Ordinance programs reduce peak hour traffic; and
23 WHEREAS, reducing vehicle trips correspondingly reduces traffic congestion, energy
24 consumption, and noise levels; and
25 WHEREAS, reducing vehicle trips reduces vehicle emissions; and
26 WHEREAS, implementation of a Trip Reduction Ordinance Program will contribute to
27 making the City of Petaluma more attractive.
28 NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
29 PETALUMA AS FOLLOWS:

31 Section l: Title 11 of the Petaluma Municipal Code is hereby amended by adding
32 Chapter 11:90 thereto to read as follows:

1 Section 11.90.010 -Purpose.
2 The purpose of this chapter is to promote the development of trip reduction ordinance
3 programs at employer work sites with one hundred or more employees during the afternoon
4 peak traffic period, 4:00 p.m. to 6:00 p.m., in order to reduce traffic impacts within the city.

6 Section 11.90..020 -Authority.
7 Government Code Section 65089.3 requires cities and counties to adopt and implement
8 a trip reduction and travel demand ordinance.

10 Section 1.1.90.030 -Definitions.
11 For the purposes of this chapter, the following words and phrases are defined and shall
12 be construed as set forth in this section.
13 A. "Average vehicle ridership (AVR)" is the number of employees arriving or
14 leaving a work site during the peak hour period divided by the number of vehicles those
15 employees used to arrive or leave the work site averaged over the survey week excluding
16 buses, bicycles and motorcycles.
17 B. "Peak hour period" is 4:00 p.m. to 6:00 p.m. on weekdays.
18 C. "Carpool"/"Vanpool" is a motor vehicle occupied by two or more employees
1.9 traveling to a work site.
20 D. "City" shall refer to the City of Petaluma.
21 E. "Commute" is the home-to-work or work-to-home trip.
22 F. "Commute alternatives" are carpooling, vanpooling, public transit, bicycling or
23 walking, or alternative routing.
24 G. "Employee" is any person working for an employer for either wages or salary
25 80 or more hours per month on a permanent, temporary, or part-time basis who either reports
26 to or leaves work or is assigned primarily to a work site on a regular schedule during a shift
27 that either begins or ends during a peak hour period. The term excludes contract employees,
28 independent contractors, seasonal workers, and volunteers.
29 H. "Employee survey" is a form designed to provide information to calculate AVR
30 for the work site. It will ascertain how the employee travels to and from work.
31 I. "Employer" is any public or private employer, including the city, with a
32 permanent place of business in the city. "Employer" shall not include contractors and
33 businesses with no permanent place of business in the city.
34 J. "Transportation coordinator" is the person designated by the employer who is
35 responsible for daily administration of employer requirements under this chapter.

1 K. "Work site" is any place of employment, base of operation or predominant
2 location of the employer. All buildings or facilities occupied by the employer within a
3 building or facility, not separated by a public right of way, is considered a single "work site" .

5 Section 11 90 040 -Quantitative Trip Reduction Goal.
6 Average vehicle ridership is established to measure progress toward achieving an
7 increase in the use of commute alternatives and reducing peak hour vehicle trips. The
8 following are AVR goals:
9 (1) By July 1, 1993, the AVR should be 1.20.
10 (2) By July 1, 1995, the AVR should be 1.25.
11 (3) By July 1, 1997, the AVR should be 1.30.
12 (4) By July 1, 1999, the AVR should be 1.35.

17 Section 11 90 050 -Employer Responsibilities.
18 A. Employers With ®ne hundred or A~Iore Employees. Every existing or
19 future employer with one hundred employees or more at the work. site within the time period
20 for notification specified herein shall do the following:
21 (1) Information Program. Each year, post and distribute marketing and
22 informational materials regarding commute alternatives and their impact on congestion and air
23 pollution. Informational materials shall be distributed to new employees upon hire.
24 (2) Transportation Coordinator. Within 30 days following notice from the city,
25 designate a Transportation Coordinator for each work site. Within 60 days following
26 appointment, the coordinator shall complete a coordinator training course approved by the
27 city; unless the coordinator has had one year of experience as a transportation coordinator. A
28 single coordinator may serve multiple employers.
29 (3) Notification. Within 30 days of designating a Transportation
30 Coordinator, notify the City Transportation Administrator in writing of the name of said
31 designee. Notification shall include the following additional information:
32 a. Name/name of business;
33 b. Number of employees;
34 c. Business hours;
35 d. Business telephone number;
36 e. Business mailing address.

(4) Annual Employee Survey. Each year, during the month of May,
conduct an employee transportation survey at the work site. The survey form shall be
provided by the city. The survey will be conducted during a 5-day period set by the City.
The first survey will be conducted in May 1993. A 90 percent (90%) return on employee
surveys from each business is required.
(5) Annual Report. Submit to the City Transportation Administrator the
surveys conducted during the reporting period. The annual report shall be submitted by
August 1 of the reporting year. The annual report consists of the employees' completed
surveys.
(6) Certification of Compliance. If the Bay Area Air Quality
Management District adopts a Trip Reduction Rule, employers subject to this chapter and the
Bay Area Air Quality Management District Trip Reduction Rule; may file a certification of
compliance from the Bay Area Air Quality Management District with the city in lieu of
complying with this chapter.
Section 11.90.060 -City Responsibilities.
A. Transportation Administrator. City shall designate a Transportation
Administrator.
B. Technical Guidance and Support. The Transportation Administrator will
provide guidance and support to employers in complying with the provisions of this chapter.
(1) The city shall provide employers with required commute alternatives
information.
(2) The city shall provide employers employee commute survey form.
(3) The city shall survey data processing.
(4) The city shall distribute survey results to employers.
(5) The city shall coordinate local training for employers' Transportation
Coordinators.
C. City Evaluation.
(1) Annual Evaluation. The City Transportation Administrator will review
employer compliance with the requirements of this chapter. The evaluation will include a
review of annual reports (employer surveys).
(2) Report to City Council. The City Transportation Administrator will
submit an annual report to the City Council describing the results of the surveys and the
achievement of the goals of this chapter.

D. Citywide Dissemination of Information.
(1) The City Transportation Administrator will make available to all
interested parties, within the City of Petaluma, commute alternative information.
Section 2. If any section, subsection, sentence, clause or phrase or word of this
ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions of this ordinance. The City
Council of the City of Petaluma hereby declares that it would have passed and adopted this
ordinance and each and all provisions thereof irrespective of the fact that any one or more of
said provisions be declared unconstitutional.
Section 3. The Ciry Clerk is hereby directed to post/publish this ordinance for the
period and in the manner required by the Ciry Charter.
