Summary.Statement:
Per ,Ordinance No. 1949, the City Council is authorized to adopt- a mobile home park space rent
stabilization fee on an annual basis. The staff;recommendation is that the 2001. fee remain at $15.00 per
year/per space covered under the ordinance. This recommendation is based on a financial review which
shows there are sufficient funds in the Mobile Home Rent Stabilization fund to operate the program and
adequate reserves for unanticipated arbitrations.

8 EXECUTIVE SUMMARY: Section 6.50.160 of the,1994 City of Petaluma Rent Stabilization
9 Ordinance authorizes the City to collect an annual,fee for administration;of the Ordinance " .
10 on or before April 3011' of each and every subsequent;.year,each mobile home park owner shall
11 pay to the City.Clerk of the City of Petaluma a mobile home,park rent stabilization program
12 administration fee for mobile home space as defined herein, including both=occupiedand
13 unoccupied mobile home spaces, in the owner's mobile home park except-for those spaces
14 subject to a rental agreement in full compliance with the requirements of Civil•Code'Sections
15 798.17(a) and(b).

17 The rent stabilization program is included,in the,Housing;Program budget. The purpose of the
18 administration fee, which is assessed against the park owners and the residents on;an*equal basis, •
19 is to,cover ongoing costs of monitoring compliance with the Mobile Home Rent Stabilization
20 ordinance. hi addition, it was necessary to develop a program reserve for unanticipated'legal fees.
21 for arbitration of disputes. After seven years of operation, a predictable pattern-of revenues'and
22 expenditures has formed. In conjunction with the Sonoma County Community,Development
23 Commission, staff recommends maintaining the annual-administrative fee to.reflect that,pattern .

27 BACKGROUND AND`FINANCIAL.IMPACTS: The City has-a. five-year agreement,(Resolution.99-.
28 47) with the Sonoma County Community Development Commission (the Commission).to.
29 administer our rent stabilization program. The Commission:provides a clerk to process
30 arbitration petitions and qualified arbitrators.-for administrative hearings. The Commission also
31 administers rent control programs for three othercities and the County.

33 The first year of the=Ordinance, 1995, the administration'fee=was $65/space/year: Based on actual
34 annual expenditures, staff has recommended,decreases`over the years to`$15/space/year, an-
35 amount that will be sufficient to cover average annual costs and-retain'a reserve4'or unanticipated
36 legal fees. Staff has conferred with the;administrator of our program.who:agrees that'ample
37 reserves are available for even the worst case,scenario regarding:arbitration activity.

39 Staff annually reviews the leases at each,park. This year it was'determined that there are 124
40 spaces subject to the Ordinance. A breakdown by park is attached;Exhibit #2. •

42 ALTERNATIVES: The Council may decide to increase or decrease the fee.

44 CoNcLUSION: After City Council adoption of the resolution authorizing.the,2001
45 administrative fees,assessments will be sent to all park'owners'to be paid by April 30,2001, as •
46 required by the Ordinance

8 WHEREAS, pursuant to Ordinance No. 1949 N.C.S., the City of Petaluma adopted a Mobile home
9 Park Space Rent Stabilization Program; and
10
11 WHEREAS, pursuant to said Ordinance, the City Council is authorized to adopt:a.mobile home park
12 space rent stabilization program administration fee by Resolution or Ordinance; and
13
14 WHEREAS, the City Council desires to set said administration fee herein;

16 NOW, THEREFORE, BE IT RESOLVED that on or before April 30, 2001, 'each mobile home,
17 park owner shall pay to the City Clerk of the City of Petaluma a mobile home'park rent.stabilization
18 program administration fee in the sum of Fifteen Dollars ($15.00) per year for each mobile horne
19 space as defined herein, including both occupied and unoccupied mobile home spaces,' n the owner's
20 mobile home park except for those spaces subject to a rental agreement in fun corripliance with the
21 requirements of Civil Code Sections 798.17(a) and (b). The City Clerk of the City of Petaluma shall
22 forward these funds to the Clerk to administer the mobile home park rent stabilization Ordinance.
23 Further, the City Clerk of the City of Petaluma shall issue to each mobile home,-park owner;a•receipt
24 for payment of the fees required to be paid herein. Any person owing money to the,City under the
25 provisions of this Ordinance shall be liable to an action brought in the name of the City for the
26 recovery of such amount. A service fee equal to one and one-half percent;.(1=1/2%) per month will be
27 charged on all late payments of registration fees under this Ordinance.
