Phase III includes extending a pedestrian/bike path from Shollenberger Park to the Petaluma Marina: The City was successful in obtaining the grant, but over the following months the Coastal Conservancy was able to increase the size of the grant to $450,000.:The requested City Council action is to authorize the City Manager to sign the new grant agreement, which expands' the size of the grant amount to $450,000. EXECUTIVE.SUMMARY: • 13 The City Council authorized the City to apply fora Coastal Conservancy Grant of$350,000,,to 14 implement PhaseIIl'of.the Petaluma Marsh Enhancement Plan:The City was successfdl?imobtaining 15 the grant`and has'been working on;the`project. The'Coastal'Conservancy notified the City that 16 additional,inomes were available for the project;;and.a;new grant agreement,has been•prepared.for a 17 tota of$450,000:,Requested'City Council action,is to approve the new agreement and authorize•th l e 18 city Manager to sign the agreement. • 19 20 2: BACKGROUND: - . 21 IN 1992 THE CITY COUNCIL APPROVED:THE'PETALUMA'MARSH ENHANCEMENT PLAN: THEPLANNING 22 AREA INCLUDES 150 ACRES OF UNDEVFLOPED LAND BORDERING THE SIDE Of HIGHWAY 23 101 AND THE'PETALUMA RIVER, NEAR THE LAKE INTERCHANGE. THE STUDY SITE' 24 LIES;IMMEDIATELLY SOUTH OFTHE'PETALUMA MARINA,AND EXTENDS,BEYOND'THE SOUTH 25 BOUNDARY OF THE RIVER DREDGE DISPOSAL SITE 26 In 1995-96, the City:implemented phases I and-II of the Petaluma Marsh Enhancement Plan,which i 27 . included development of Shollenberger'Park,(restoration of Adobe Creek, bicycle;connector trails' - 28 from Lakeville Highway to Shollenberger Park, urban forestry improvements along Adobe Creek, 29 and the capping of the old City Landfill'(Rocky Park)_, . 30 In the Spring of 2000;the,City was awarded'a_grant through,the Coastal Conservancy for$350,000, 31 to,extend the:traitfrom Shollenberger Park.to.the,Petaluma Marina: At the,time ofthe grant award, 32: Coastat Conservancy staff had indicated that pending;the?approval of Proposition 42.(Park'Bond), 33 there might be additional dollars available•for the projedt,fto meet the;original grant"request oftlie 34 City. Early in 2001, CoastalConservancy"staffnotified theCity that additional funds were available 35 for the.project.,A'new grant;agreement;was drafted CO include'the new grant amount'of$450000, 36 , and requires City'Council approval in�order for the City Manager to sign. • 37 The agreement calls fora match by the•City. Funds previously expended by the City($320,000) 38 • meet the;requirement. FINANCIAL'IMPAC--TS7 • 50 The Coastal Conservancy grant is for�$450,000:.The five-year Capital Improvement Budget 51 identifies.two applicable projects, Whiich are=part of the'Marsh Enhancement:Plan: Shollenberger' • r l' Restroorn and•Fishing Pier ($41,000),and Van De,Mark'Marsh Iinprovements ($30,000).Both, 2 projects musvbe 3 4 implemented as part%ofprior;agreements with.the:Gounty of Sonoma. Improvements made at 10, Shollenberger Parkin°the past„and with the current projects mentioned above, the City more than =meets,the match-required-by,theiCoastal Conservancy. The‘anticipated project to extend the path 7 from ShollenliergerrPark.to the Petaluma Marina wiThcost $450,000: The additional $100,000 8 provided by the Conservancy will be usedcfor_needed dike repairalong;the Petaluma River,between . 9 Rocky Dog Park and the Marina, and to meettrising construction costs which have occurred over 10 recent years. 11 12 • 13 , 5. CONCLUSION; 14 • The addition of$100;000 by the Coastal”Conservancy allows the Shollenberger bike/pedestrian 15 path extension to be completed-as originally expected. This is especially true with added flood 16 damage over the last few years`to the Petaluma River dike, between Rocky Dog Park and the 17 Petaluma River, and increased construction costs. 18 1.9 20 6. OUTCOMES OR''PERFORMANCE MEASUREMENTS THAT WILL IDENTIFY SUCCESSOR 21- COMPLETION: 22 . Construction of the Shollenberger bike;/'pedestrian path is expected to start late this spring, and to be 23 completed by early next calendar year Much of the work is to bercompleted by the Civilian 24 Conservation Corps (CCC). The additional:funding will allow for earlier completion of the project 25 and additional repairs to-thePetaluma.River bank 26 • 7. I2 focusing on public access pathways andienhancement of lower Adobe Creek; including riparian 13 and tidal marsh restoration at Shollenbergerfark; and 114 • •1j5 WHEREAS,the success of Phases 1,and,Il of the,enhancement plan has proven to be extremely 1'6 popular with-the;Petaluma community, with,access trails used by,recreationaljoggers and 1;7 walkers, bird watchers, nature photographers:and educational programs; and 18 19 WHEREAS,without the further financial assistance of the Coastal Conservancy grant program 20 further implementation of the Petaluma Marsh Enhancement Plan would.bedelayed for many 21 years; and 22 23 WHEREAS, throughthe assistance of the Coastal,Conservancy grant program and City 210 matching funds where required, the City of Petaluma can implement Phase III of the Petaluma 25 Marsh Enhancement Plan for the'Petaluma marsh;,allowing the City to further expand and 26 preserve valuable marsh:enhancement areas,for the education and enjoyment of local citizens, 27 and the improvement of marsh enhancement areas; and 23 RCS •,o.,.:::,0.0.-.2.1_ ags. The project budget shall describe all labor and materials costs to be incurred`to complete:each;component ofthe project. The,grantee shall review the plans on-site with Conservancy staff.. ' If any portion of the construction to be funded under,this agreement will be'performedby third parties ("contractors") under contract with the°grantee,prior to initiating any request for contractor bids,the grantee shall submitfor review and written approval,of the Executive Officer the bid package including,construction plans.and specifications whichrhave'been,certified or approved as described above. Upon approval by the Executive Officer, the grantee shall proceed with the bidding process. The grantee assumes all operation and maintenance costs of these facilities and structures.;the Conservancy.shall not be liable for any cost of such maintenance, management, or operation. The grantee may be excused from its obligations for operation and maintenance during the term of this agmettient only upon the written approval of the Executive Officer. • • - For purposes of this agreement, "operation costs" include direct costs incurred for material and labor needed for operations,utilities, insurance, and expenses necessary to produce gross revenues. "Maintenance costs" include ordinary repairs and replacements of a recurring nature necessary to prolong the life of capital,assets and basic structures, and the expenditure of funds necessary to replace or reconstruct capital assets or basiestructures. MITIGATION. Without written pennission of the,Executive Officer, the granted shall not use or allow the use for mitigation(in other words, to compensate for adverse changes to the environment elsewhere) of any portion ófreaF property on which the Conservancy has funded construction.
