Fergus, Fire Marshal SUBJECT: Resolution Authorizing the Fire Department to Accept a Certified Unified Program Agency (CUPA) Electronic Reporting Grant RECOMMENDATION It is recommended that the City Council approve the attached Resolution Authorizing the Fire Department to Accept a CertifierFUnified Program Agency (CUPA) Electronic Reporting Grant. BACKGROUND The California Environmental Protection Agency (Cal/EPA) oversees the Unified Program that consolidates, coordinates and makes consistent the administrative requirements, permits, inspections and enforcement. activities of seven environmental and emergency response programs. The State agencies responsible for these programs set-the standards for their program while local governments implement the standards. The Unified Program is implemented at the local level by 83 government agencies certified by the Secretary of Cal/EPA which are known as Certified Unified Program Agencies (CUPAs). The City of Petaluma became a CUPA with no "Participating Agencies" on July 1, 1997 and has been certified by Cal/EPA ever since. Assembly Bill 2286 went into effect on January 1, 2009. It requires that by March 31, 2013, all regulated businesses and local governments use the Internet to file their regulatory reports which are now being filed;bypaper. The Petaluma CUPA is required to comply with these electronic reporting requirements. The required reporting includes facility data regarding hazardous material regulatory activities, chemical inventories, underground and aboveground storage tanks and hazardous waste generation. Regulated businesses can report using Cal/EPA's California Environmental Reporting System (CERS) or report directly to Petaluma CUPA, as their local regulatory agency. CERS will also support electronic data exchange among regulated businesses, local ,;governments and the United States Environmental Protection Agency. Cal/EPA will create a public access website that allows access to the information collected from businesses and local governments. Agenda Review: City Attorney OR Finance Director City Manager 1 Creating a system for automated data exchange offers, several benefits. One of the most important is that it will provide' immediate information to first responders regarding the hazardous materials that businesses have on-site and the location where they are stored. Having this information readily available at emergency incidents will improve safety for first responders and help them to be more effective in the event of,a fire or chemical release. It will also make it easier for businesses to comply with environmental reporting requirements, particularly those witivmultiple sites in the City:of Petaluma. DISCUSSION The functionality of the database currently used by the Petaluma CUPA, CUPA DMS, has decreased over time as it has become obsolete, and therefore will eventually become unsupportable by the City's Information Technology staff. More importantly, it is simply not designed to exchange information online with CERS which is critical to the success of meeting the electronic reporting requirement. In order to become compliant with AB 2286, which requires the automated exchange of information between CUPAs and Cal/EPA, the Petaluma CUPA will need to replace CUPA DMS. Additionally, Petaluma:CUPA will need to provide outreach and training on the new system so that regulated businesses are able to successfully:file: electronic reports using the California Environmental Reporting System (CERS). Awarded grant funds will be used to replace CUPA DMS with an updated database, transfer data (including legacy data) from CUPA DMS to the new database, train Petaluma CUPA staff in using the new database, train businesses in using CERS and provide:money to support a part-time Fife Inspector working to implement various aspects of this new program. The CERS Electronic Reporting:Grant funds will provide the Petaluma CUPA with assistance in implementing electronic reporting requirements. The department has applied for, and has been awarded, $38,636 in grant-funds. The grant performance,period is July 1, 2011 to March 31, 2013. Up to 25% of the grant is authorized to be paid in advance. The grant funds will be used to purchase necessary software and licensing for the new database'program, as well as pay for support, training on the software and some related equipment. the Projected Budget is as follows (and is also laid out in-the attached Grant Award Letter): • First Year: - $12,736 Personnel Services plus $19,400 ($14;900 for implementation and development of the new database and $4,500 for the 'P year's annual maintenance fee); the first year total is $32,136 • Second Year: - $2,000 Personnel Services plus $4,500 (for the 2"d year's annual maintenance fee); the second year total is,$6,500 GRAND TOTAL: $38,636 Z Anticipated other costs will include personnel time for training businesses and new or upgraded hardware to run the application in the field, if funds allow., There will be an initial set-up cost for the new database system, including staff and user training, of $14,900. Maintenance and service of the software expects to run $4,500 annually on an ongoing basis. This service would commence in July, 2012. The annual maintenance amount will be paid by the grant for the first two (2) years (as referenced above) and may be recovered yearly after that from fees charged to businesses. Businesses already have been paying a $25/year electronic reporting.surcharge to the State for the;.past'three years which will end at the end of FY 2011/2012. After:that time, the Petaluma CUPA will be responsible for implementing electronic reporting requirements and may seek to charge an electronic reporting fee in fiscal year 2013/2014 in an amount that. is expected to be less than the $25/year surcharge that businesses are currently paying. Adding a fee of this type will require City Council approval in fiscal year 2012/2013. This item meets City Council's 'Improve and Enhance Fiscal Stabilityand Sustainability" goal by seeking and gaining outside grant funding to cover the costs of a mandatory program that would otherwise have had to have been supported by the current Fire Department budget. FINANCIAL IMPACTS The Petaluma CUPA will need to abide by this state-mandated program and AB 2286. If authorized, financial impacts will be minimal because the CERS grant will offset the cost of implementation of the new database system, plus training and some equipment and staff time. The total grant amount will equal $38,636 and the Petaluma CUPA is due to receive 25% of that amount ($9,659) in advance. Expenses will be tracked and reported to Cal/EPA on a quarterly basis via Electronic Reporting Implementation Status Reports. The last reporting due date is May 1, 2013. If acceptance of these grants funds is not authorized, the Petaluma CUPA would be required to pay for necessary equipment and programs to comply with Cal/EPA electronic reporting requirements. WITHHOLDING OF'GRANT DISBURSEMENTS:;Cal/EPA may withhold all or any portion of the allocations provided for,by this Agreement in the event the Grantee: . a Materially violates,or threatens to materially violate,any.temy,provision,condition,or commitment of • this Agreement;or b Fails to maintain reasonable progress toward Electronic Reporting,implementation. 8 FUNDS CONTINGENCY:;Cal/EPA's obligations under Grant Agreement are contingent upon the •availability of funds In the event funds are not available,.the State shall have no liability to pay any funds whatsoever to the Grantee or to furnish any other,considerations under this Grant Agreement. 9. BUDGET;REVISIONS ,Budget revisions of 15%or lei's of the total agreement allocation may be made in writing and approved by Cal/EPA without an amendment to the agreement. B. GENERAL:PROVISIONS • 1. ASSIGNMENT:This grant is not assignable by the Grantee,either in whole or in part,without the consent of the State. • 2. AUDIT Grantee agrees that the Cal/EPA,the Bureau of State Audits,or their designated representative shall have the right to review and to copy any records and supporting documentation pertaining to the expenditure of allocated moneys and performance of this Agreement; The Grantee agrees to maintain such records for a possible audit for minimum of three(3)years after term of the Agreement unless a longer period of records retention is stipulated Grantee agrees to allow the auditor(s)access to such records during normal business hours and to allow interviews of any employees who might reasonably have information related to such records.Further?the Grantee;agrees to include a similar right of the State to audit records and interview staff in any contract'related toperfonnance of this Agreement. 3. COMPUTER SOFTWARE:The Grantee certifies that it has appropriate systems arid controls in place to ensure that state funds will not be used in the performance Of this Agreement for the acquisition,operation or maintenance of computer software in violation of copyright laws. 4. CONFLICT OF INTEREST:The Grantee certifies that it is'in compliance with applicable state,and/or federal • conflict of interest laws. 5 GOVERNING LAW'.This grant is governed by and shall be interpreted in accordance with the laws of the State of California 6.
