AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING
ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND
REZONING THAT PORTION OF THE TWIN CREEKS RESIDENTIAL PROJECT
OUTSIDE OF THE FLOODWAY (APN 007-221-19, 136-100-26 AND A PORTION OF
21, 33 AND 34) FROM R-1-6,500/FP-C TO PUD/FP-C
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
Section L The City Council finds that the Planning Commission filed with the City
Council on December 16, 1991 its report set forth in its minutes of December 10, 1991
recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., as
amended, by reclassifying and rezoning certain lands being more particularly described as
Assessor's Parcel Numbers 007-221-19, 136-100-26 and a portion of 21, 33 and 34

Flood Plain- Combining.
Section 2. The City Council further finds that said Planning Commission held public
hearings on said proposed amendment on November 12 and December 10, 1991, after
giving notice of said hearing, in the manner, for the period and in the form required by said
Ordinance No. 1072 N.C.S.; as amended.
Section 3. Pursuant to the Provisions of Zoning Ordinance No. 1072 N.C.S., as
amended the City Council finds as follows:
1. By providing the secondary access to Ellis Street, the Twin Creeks PUD district
creates a suitable relationship to adjacent thoroughfares; and Traffic analysis of the
area has indicated that said thoroughfare is adequate to carry the additional traffic
generated by the development.
2. The proposed development plan modified to provide a single loaded street and as
conditioned to increase the number of single story homes parallel. to the Wilmington
Avenue homes, varying setbacks or providing landscaped screens, presents a unified
and organized arrangement of buildings and service facilities which are appropriate
in relation to adjacent or nearby properties and that a landscaping plan and/or
screening will be presented for review and approval by Site Plan and Architectural
Review Committee to insure compatibility.

3. The natural and scenic qualities of the site are protected, through the development
of the single loaded street with the twenty foot buffer, the open space area between
the site and the Petaluma River at the Intersection of Twin Creeks Court and Holly
Street, and the open space at the conflux of Lynch Creek and the Petaluma River to
provide adequate available public and private open spaces.
4. The development of the property as proposed by the applicant, as mitigated by the
FEIR and the FSEIR and as conditioned below will not be detrimental to the public
welfare, will be in the best interest of the City, and will be in keeping with the
general intent and spirt of the Zoning regulation of the City of Petaluma, with the
Petaluma General Plan, by improving access to the river and providing a secondary
access for the residents of Holly street.
IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
any reason held to be unconstitutional by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this ordinance. The City Council of
the City of Petaluma hereby declares that it would have passed and adopted this ordinance
and each and all provisions thereof irrespective of the fact that any one or more of said
provisions be declared unconstitutional.
