AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING
ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND
REZONING LANDS ADJACENT TO THE PETALUMA MARINA AND OFFICE
PARK (APN 005-060-44 AND A PORTION OF 005-060-60) FROM CH/FP-C TO
PCD/FP-C
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
Section 1. The City Council finds that the Planning Commission filed with the City
Council on December 2, 1991 its report set forth in its minutes of November 26, 1991 (File
3.351) recommending the adoption of an amendment. to Zoning Ordinance No. 1072
N.C.S., as amended, by reclassifying and rezoning certain lands being more particularly
described as Assessor's Parcel Number 005-060-44 and that portion of Assessor's Parcel
number 005-060-60 adjacent to the Petaluma Marina and Office Complex (attached as
"Exhibit A") from Commercial Highway/Flood Plain-Combining to Planned Community
District/Flood Plain Combining.
Section 2. The City Council further finds that said Planning Commission held a public
hearing on said proposed amendment on October 29, 1991, after giving notice of said
hearing, in the manner, for the period and in the form required by said Ordinance No. 1072
N.C.S.; as amended.
Section 3. Pursuant to the Provisions of Zoning Ordinance No. 1072 N.C.S., as
amended the City Council finds as follows:
1. The development proposed is in substantial harmony with the General Plan of the
City of Petaluma, because it represents a continuation of the established land use
pattern and will provide an opportunity for the development of a coordinated,
attractive, quality commercial project at an important entrance to the City. The
development can be coordinated with existing and planned development of the
surrounding areas through SPARC review.
2. The traffic impacts of the proposed project have been analyzed and the City traffic
Engineer has determined that the streets and thoroughfares proposed are suitable
and adequate to serve the proposed uses as conditionally approved, and the
anticipated traffic which will be generated thereby.

3. Building permits for the second stage of the project (Building B and associated
parking lot) have been issued and the development of the PCD will be initiated
within a reasonable time by submittal of development plans for the next stages of
the project.
4. The proposed development program is to be administered by the City Planning
Department and SPARC, and will insure that development will be appropriate in
area, location, and overall planning to the purpose intended; and that such
development will be in harmony with the character of the surrounding areas. The
requirement that specific sensitive uses be Conditional Uses, requiring review by the
Planning Commission, will insure that these uses to not detract from the purpose
and objectives of the PCD program..
IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
any reason held to be unconstitutional by a court of competent jurisdiction, such decision
shall not affect the validity of the remaining portions of this ordinance. The City Council of
the City of Petaluma hereby declares that it would have passed and adopted this ordinance
and each and all provisions thereof irrespective of the fact that any one or more of said
provisions be declared unconstitutional.
