AN ORDINANCE OF THE CITY OF PETALUMA AMENDING ZONING
ORDINANCE NO. 1072 N.C.S. AS AMENDED, BY RECLASSIFYING AND
REZONING THE SOUTHPOINT BUSINESS PARK (AP NOS. 048-080-21, 30, 31, 32;
007-401-11, 12, 14, 15, 16, 27, 31, 34, 35, 36, 38, 39, 40, 41, AND 42)

BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:

29 Section 1. The City Council finds that the Planning Commission filed with the City
30 Council on November 18, 1991 its report set forth in its minutes of October 29, 1991 (file
31 REZ91009) recommending the adoption of an amendment. to Zoning Ordinance No. 1072
32 N.C.S., as amended, by reclassifying and rezoning certain lands being more particularly
33 described as Assessors Parcel Numbers 048-080-21, 30, 31, 32; 007-401-11, 12, 14, 15, 16,
34 27, 31, 34, 35, 36, 38, 39, 40, 41, and 42 from Light Industrial-Flood Plain Combining
35 (ML/FP-C) to Planned Unit Development-Flood Plain Combining.

37 Section 2. The City Council further finds that said Planning Commission held a public
38 hearing on said proposed amendment on October 29, 1991, after giving notice of said
39 hearing in the manner, for the period and in the .form required by said Ordinance No. 1082,
40 N.C.S., as amended.

42 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended
43 the City Council finds as follows:

45 1. The proposed PUD will result in a more desirable use of land and a better
46 physical environment than would be possible under any single zoning district
47 or combination of zoning districts by permitting necessary accessory
48 commercial uses in close proximity to the industrial park uses.

1 2. The circulation pattern and traffic impacts of the proposed Planned Unit
2 Development have been reviewed by the City Traffic Engineer who has
3 determined that the project will have- no impact on the level of service at
4 adjacent thoroughfares and that said thoroughfares are adequate to carry
5 additional traffic generated by the development.

7 3. The plan for the proposed development, as conditioned, presents a unified
8 and organized arrangement of buildings and service facilities which are
9 appropriate in relation to adjacent properties.

11 4. The approved Design Guidelines limit building coverage to SO%, and require
12 20' or 25' landscaped setbacks along the streets. A master landscape plan has
13 been approved for the site. Through these established standards, the scenic
14 qualities of the site, will be protected and adequate open spaces will be
15 provided.

17 5. The development is in general conformity with the General Plan Land Use,
18 Community Health and Safety and Community Character Chapters.

20 6. Public necessity, convenience, and general welfare clearly permit the
21 adoption of the proposed amendment by permitting a more viable and
22 efficient mix of uses for the business park.

24 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
25 any reason held to be unconstitutional by a court of competent jurisdiction, such decision
26 shall not affect the validity of the remaining portions of this ordinance. The City Council of
27 the City of Petaluma hereby declares that it would have passed and adopted this ordinance
28 and each and all provisions thereof irrespective of the fact that any one or more of said
29 provisions be declared unconstitutional.
