Introduced by Councilperson Seconded by Councilperson Nancy Read Michael Davis AN ORDINANCE AMENDING ORDINANCE 1072 N.C.S., ARTICLES 19, 19A, AND 21 PERTAINING TO PUD/PCD, ACCESSORY USES BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: WHEREAS, on June 25 and July 9, 1991, the Planning Commission held duly noticed public hearings on proposed amendments to the City of Petaluma Zoning Ordinance; and WHEREAS, upon completion of said hearings, the Planning Commission recommended that the City Council adopt said amendments to the Zoning Ordinance; and, WHEREAS, the City Council has adopted a negative declaration of environmental impact pursuant to Section. 15074 of CEQA Guidelines, finding no significant negative impact on the environment; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby amends Ordinance 1072 N.C.S. as follows: 1. Add Section 19-302.1 as follows: 19-302.1 As deemed appropriate by the Director, to illustrate or highlight the overall project or a specific aspect thereof, special graphic information may be required such as project models, video tape simulations, photomontages, perspectives, renderings, etc. 2. Add Section 19A-202.1 as follows: 19A-202.1 As deemed appropriate by the Director, to illustrate or highlight the overall project or a specific aspect thereof, special graphic information may be required such as project models, video tape simulations, photomontages, perspectives, renderings, etc. 1 Ord 1869 N.C.S. 3. Add Section 21-201.4 as follows: 21-201.4 Patios not exceeding ten (10) feet in height shall maintain at least a three (3) foot side yard and a five (5) foot rear yard setback. Deck structures not exceeding thirty (30) inches in height at any point, excluding required handrails or guardrails, shall not be required to maintain any side or rear yard setbacks. IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for any reason held to be unconstitutional by a court of competent jurisdiction, such decision shall not .affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional.
