AN ORDINANCE OF THE COUNCIL OF THE CITY OF PETALUMA
ADDING CHAPTER 8.30, MUNICIPAL AMBULANCE SERVICE,
TO THE PETALUMA MUNICIPAL CODE
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:
Section 1. The City Council finds that provision of ambulance services is a traditional
municipal function authorized by law.
Section 2. The City Council further finds that the provision of emergency ambulance
services is of the utmost importance to the health, safety and welfare of the residents of City.
Section 3. The City Council further finds that the Petaluma Fire Department has been the
exclusive and continuous provider of emergency ambulance services to all locations within the city
limits of City since before January 1, 1981.
Section 4. The City Council further finds that the Petaluma Police Department and Petaluma
Fire Department jointly provide a 911 dispatch service, which makes possible the coordinated use of
emergency resources city-wide and provides a more efficient and more effective emergency response
service because of said coordinated resources.
Section 5. The City Council further finds that City presently subsidizes a portion of the cost
of emergency ambulance services as a municipal function.

1 Section 6. The City Council further finds that it is in the best interests of the City and its
2 residents to continue the provision of emergency ambulance services by the Petaluma Fire
3 Department and that to do so by adoption of this ordinance supports Goal 1 as set forth in Section
4 11.1 of the community health and safety element of the Petaluma General Plan.

6 Section 7. Petaluma Municipal Code Chapter 8.30 is hereby added as follows:
7 CHAPTER 8.30
8 MUNICIPAL AMBULANCE SERVICE

10 8.30.010. Purpose.
11 It is the purpose and intent of the City Council to continue to provide the highest
12 reasonable level of emergency ambulance services to such persons within City who
13 may be in need of such care. It is further the intent of the City Council to ensure that
14 such care shall be provided in a timely and professional manner on a continuous 24-
15 hour basis by the Petaluma Fire Department as a municipal function.

17 8.30.020. Definitions.
18 As used in this chapter, unless the context clearly indicates otherwise, the following
19 definitions shall apply:

21 A. "Ambulance" shall mean any vehicle that is constructed, equipped, and
22 regularly provided or offered to be provided for transportation in the recumbent
23 position of persons suffering from any physical or psychological illness, injury,
24 disability, or infirmity.
25
26 B. "Advanced Life Support" shall mean and include special services designed to
27 provide definitive prehospital emergency medical care, including, but not limited to,
28 cardio-pulmonary resuscitation, cardiac monitoring, cardiac defibrillation, advanced
29 airway management, intravenous therapy, administration of specified drugs and other
30 medicinal preparations, and other specified techniques and procedures administered by
31 authorized personnel at the scene of an emergency, during transport to an acute care
32 hospital, during inter-facility transfer, and while in the emergency department of an
33 acute care hospital until responsibility is assumed by the emergency or medical staff
34 of that hospital.

36 C. "City limits" or "Corporate limits" includes all areas which are physically
37 located within the corporate limits of City as of the effective date of this ordinance

1 and any later areas subsequently annexed so as to become a part of the corporate
2 limits of City.

4 D. "Emergency" shall mean a condition or situation in which an individual has a
5 need for immediate medical attention, or where the potential for such need is
6 perceived by emergency medical personnel or a public safety agency.
7 E. "Person" means any individual or entity as defined in Section 1.04.010 of the
8 Petaluma Municipal Code. For the purposes of this chapter, "person" shall include
9 all individuals, firms or principals having a fmancial interest in an ambulance or
10 ambulance service whose operations are subject to this chapter.

12 8.30.030. Right to Provide Emergency Ambulance Services Vested in City.
13 The exclusive right to provide emergency ambulance services within City shall be
14 vested in City. The standard operating level for emergency ambulance services within
15 City shall be advanced life support on a continuous 24-hour basis. Resources beyond
16 or in addition to the standard operating level may be provided at less than an
17 advanced life support level.

19 8.30.040. Exceptions.
20 The provisions of this chapter shall not apply to the following activities:
21
22 A. Operation of an ambulance owned by or operated under contract to the United
23 States Government, when providing service directly to the United States Government
24 or any agency thereof.

26 B. Operation of an ambulance within City which does not normally serve City,
27 but has been requested by City to provide assistance during periods when multiple
28 requests for emergency ambulance services have been received, and the assistance is
29 necessary for the timely provision of emergency ambulance services.

3.1 C. Operation of an ambulance during a declared state of emergency when such
32 operation is in cooperation with the emergency mitigation efforts being conducted by
33 City.

35 D. Any ambulance passing through City when that ambulance's point of departure
36 and destination are not within the corporate limits of City.

8.30.050. Violations.
It is unlawful for any person to provide emergency ambulance services within City
contrary to the provisions of this chapter. Any such person violating or causing the
violation of any provision of this chapter shall be guilty of a misdemeanor and upon
conviction thereof shall be punished by a fine not exceeding $1,000 for each day of
violation, or by imprisonment in the County Jail not exceeding six months, or both.
Section 8. If any provision of this ordinance or the application thereof to any person or
circumstance is held to be invalid by the decision of a court of competent jurisdiction, such
invalidity shall not affect other provisions or applications of this ordinance which can be given effect
without the invalid provision or application thereof, and to this end the provisions of this ordinance
are severable.
Section 9. This ordinance shall take effect 30 days from the date of its passage.
Section 10. The City Clerk is hereby directed to post/publish this ordinance for the period
and in the manner required by the City Charter.
