Page 1 Resolution No. 2025-126 N.C.S. of the City of Petaluma, California RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR THE FY 25/26 PAVEMENT PREVENTATIVE MAINTENANCE PROJECT (E16102555) TO DRYCO CONSTRUCTION, INC. WHEREAS, the City of Petaluma is responsible for maintaining 393 lane miles of paved streets, and the City Council adopted Resolution No. 2024-140 N.C.S. approving the Five-Year Paving Plan (FY25/26–FY29/30) on November 4, 2024, which identified preventative maintenance as a core strategy for extending pavement life and improving overall roadway conditions; and WHEREAS, the FY25/26 Pavement Preventative Maintenance Project (E16102555) is included in the adopted Five-Year Paving Plan and the City’s FY2025-2026 Adopted Capital Improvement Program Budget under CIP-77; and WHEREAS, staff prepared construction bid documents and issued a Notice Inviting Bids on June 20, 2025, and three (3) bids were received and opened on July 24, 2025, in accordance with applicable law; and WHEREAS, the lowest responsible and responsive bid for the project was submitted by Dryco Construction, Inc. in the amount of $821,821.00; and WHEREAS, staff has verified that Dryco Construction, Inc. possesses a valid Class A California Contractor’s License (No. 540379) and has successfully performed similar work for the City and other agencies; and WHEREAS, no bid protests were received and the protest period has lapsed; and WHEREAS, the engineer’s estimate for the project was $580,828. In light of recent cost escalation in labor, materials, and contractor availability, the project budget must be increased to a revised estimated total of $992,000; and WHEREAS, sufficient funds are available within the Five-Year Paving Plan program budget (FY25/26– FY29/30), and project allocations will be adjusted within the current fiscal year to fully fund this contract without delaying other paving priorities; and WHEREAS, this project is categorically exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Sections 15301(c) and 15302 as the maintenance and replacement of existing public streets with negligible or no expansion of use; and no exceptions to the exemption, as set forth in Section 15300.2, apply. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Petaluma as follows: 1. Finds the above recitals to be true and correct and incorporates them as findings of this Resolution. 2. Finds that the bid submitted by Dryco Construction, Inc. is the lowest responsive bid, and that Dryco Construction, Inc. is the lowest responsible bidder for the FY25/26 Pavement Preventative Maintenance Project (E16102555). 3. Awards the contract for the FY25/26 Pavement Preventative Maintenance Project (E16102555) to Dryco Docusign Envelope ID: 7EAC5EF1-5222-402E-9B92-8A505B9B36AA Resolution No. 2025-126 N.C.S. Page 2 Construction, Inc., in the amount of $821,821.00, conditioned on Dryco Construction, Inc.’s timely execution of the project contract and submission of all required documents, including but not limited to executed bonds, certificates of insurance, and endorsements, in accordance with the project bid documents. 4. Directs staff to issue a Notice of Award to Dryco Construction, Inc. 5. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma upon timely submission by Dryco Construction, Inc. of all required documentation in accordance with the bid specifications. 6. Approves a construction contract contingency in the amount of $100,000 to be used by the City Manager or their designee for unforeseen conditions and necessary change orders. 7. Declares that the project is categorically exempt from CEQA pursuant to Guidelines Section s 15301(c) and 15302, and directs staff to file a Notice of Exemption. Under the power and authority conferred upon this Council by the Charter of said City.
