Introduced by Councilman Seconded by Councilman Jack Cavanagh Michael Davis AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S. BY RECLASSIFYING AND REZONING ASSESSOR'S PARCEL NUMBERS 137-011-01, 02, 13, 14 and 50-53; 137-160-01 and 02-20 KNOWN AS REDWOOD BUSINESS PARK PHASE ONE, FROM M-L (LIGHT INDUSTRIAL) AND C-H (HIGHWAY COMMERCIAL) TO PCD (PLANNED COMMUNITY DISTRICT), LOCATED IN THE VICINITY OF OLD REDWOOD HIGHWAY AND REDWOOD WAY BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: 28 Section 1. The City Council finds that the Planning Commission filed with the City Council 29 on January 7, 1991, its report as set forth in its minutes of November 13, 1990, 30 recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., by 31 reclassifying and rezoning Assessor's Parcel Numbers 137-O11-01, 02, 13, 14 and 50-53; 137- 32 160-01 and 02-20, from M-L and C-H to PCD (Planned Community District). 33 34 Section 2. The City Council further finds that said Planning Commission held a public 35 hearing on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., on November 36 13, 1990, after giving notice of said hearing in the manner, for the period and in the form 37 required by said Ordinance No. 1072 N.C.S. 38 39 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., the City 40 Council finds that the proposed amendment is in general conformity with the Petaluma 41 General Plan, and further, that public necessity, convenience and general welfare permit 42 the adoption of the proposed amendment. 43 44 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as amended, 45 and based upon the evidence it has received and in accordance with the findings made, the Ord. 1838 N.C.S. 1 t 0 =r . I 1 City Council hereby adopts amendment to said Zoning Ordinance No. 1072 N.C.S. so as to 2 reclassify and rezone said property hereinbefore referred to in accordance with the 3 recommendation of the Planning Commission. 4 5 Section 5. The City Council finds that the requirements of California Environmental 6 Quality Act Guidelines have been satisfied and hereby incorporated by reference the 7 Environmental documentation adopted by Resolution No. g 1-7, N.C.S. on January 2~,~1991. 8 9 Section 6. The City Clerk is hereby directed to post this Ordinance for the period and in 10 the manner required by the City Charter. 11 12 Section 7. If any section, subsection, sentence, clause or phrase or word of this ordinance is 13 for any reason held to be unconstitutional by a court of competent jurisdiction, such 14 decision shall not affect the validity of the remaining portions of this ordinance. The City 15 Council of the City of Petaluma hereby declares that it would have passed and adopted this 16 ordinance and each and all provisions thereof irrespective of the fact that any one or more 17 of said provisions be declared unconstitutional. 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 INTRODUCED and ordered Posted/Published this 7th day of Jani,ary 199 .
