Introduced By John Balshaw Seconded By Michael Davis AN ORDINANCE ESTABLISHING A PRECISE PLAN LINE OVER CERTAINPROPERTY HERINAFTER DESCRIBED FOR THE RESERVATION OF FUTURE RIGHTS -OF -WAY FOR THE PROPOSED REALIGNMENT OF SONOMA,MOUNTAIN PARKWAY AND ELY BOULEVARD NORTH BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section,1. That the City Council finds that the Planning Commission filed with the City Council on the 10th day of April, its reports and affirmative recommendation relative to the establishment of precise plan lines along the planned realignment of Sonoma Mountain Parkway, Ely Boulevard North, and that said recommended precise plan lines are further_designated and,shown..on that certain description attached hereto, designated Exhibit "A" and by reference made a part hereof. Section 2. The City Council further finds that said Planning Commission held hearings on said proposal to establish precise plan lines on April 1.0, 1990, after having received the report and recommendation of the Department of Public Works, and after having given notice of the hearing in the manner,. for the period and in the form required by Ordinance No. 597 N.C.S. Ord. 1824 N.C.S. Section 3. The City Council further finds that Notice of the public hearing required to be held by the City Council upon receipt of the Planning Commission report and recommendation and as set forth in Resolution No. 90-109 duly adopted by this Council on April 16, 1990,.was given in the manner, for the period and in the form required by Ordinance No. 597 N.G.S. Section 4. The City Council further finds that, after public hearing on May 7, 1990, no protests or objections to said proposed precise plan lines which should be sustained were received; and that changes and modifications were made to said proposed precise plan line and that the public safety, comfort, convenience, interest and welfare required by the adoption of the recommended precise plan lines hereinbefore described, and that the recommendation of the Planning Commission as aforesaid, is consistent with the purposes of Ordinance No. 597. Section 5. That pursuant to Ordinance No. 597 the City Council hereby orders the establishment of the Precise Plan Lines described above, and further designated on Exhibit "A" attached hereto and by reference made a part hereof.
