RESOLUTION AUTHORIZING AWARD OF CONTRACT FOR ADA ACCESSIBILITY
IMPROVEMENTS AS PART OF THE LIBRARY FACILITY ENHANCEMENT AND EXPANSION
PROJECT (C11202121) TO GREG NELSON CONSTRUCTION
WHEREAS, in accordance with the City of Petaluma Charter and Municipal Code, California Public
Contract Code Section 20162, and other applicable laws, City staff prepared construction bid documents and
solicited bids for the ADA accessibility improvements as part of the Library Facility Enhancement and Expansion
project (C11202121) (“Project”); and
WHEREAS, the project was bid on August 29, 2025, and eight (8) bids were received and opened on
September 30, 2025, in accordance with applicable law; and
WHEREAS, the lowest responsive and responsible bid for the project was submitted by Greg Nelson
Construction from Petaluma, CA, for $94,210; and
WHEREAS, City staff has confirmed that Greg Nelson Construction satisfies all bidding requirements
for the Project and possesses a valid California Contractor’s License Class A (General Engineering Contractor),
No. 1082086, qualifying them to perform the required work; and
WHEREAS, no bidders protested Greg Nelson Construction’s bid, and the deadline to submit a protest
has lapsed; and
WHEREAS, the Project is categorically exempt pursuant to CEQA Guidelines Sections 15301, Existing
Facilities, as the project involves minor alterations and repairs to existing library facilities. The work includes the
installation of curb ramps, concrete pathways, concrete ADA access route, ADA parking, signs, and gas enclosure
modification at the Petaluma Library. The project will not result in increased capacity of the library, and there is
negligible or no expansion of use beyond what currently exists; and
WHEREAS, a notice of exemption was issued for the project; and
WHEREAS, the Public Works Director found this project to be substantially complex due the number
of tasks needed to complete the project; the number of resources and specialty contractor work needed to complete
the project (including ADA curb ramps, ADA parking spaces, number of days, workers, equipment and labor);
the size and impact of the project (will require partial closure of the employee parking lot); the need for carefu l
demolition of existing concrete and pavement to avoid damage to existing utilit ies. Therefore, this is a unique
project that is not regularly performed and requires a higher retention amount beyond five percent.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Petaluma as follows:
1. Finds the above recitals to be true and correct and incorporates them as findings of this Resolution.
2. Finds that this project is exempt pursuant to the California Environmental Quality Act (“CEQA”) pursuant to
Title 14, the California Code of Regulations (“CEQA Guidelines”), Sections 15301, Existing Facilities.

3. Finds that this project is substantially complex due to the number of tasks needed to complete the project; the
number of resources, specialty contractor work needed; and the size and impact of the project.
4. In accordance with the City of Petaluma Charter and Municipal Code, California Public Contract Code Section
20162, and other applicable law, waives all non-conformance in the bid of Greg Nelson Construction, for the
Library ADA Staff Entrance Project (C11202121).
5. Awards the contract for the Library ADA Staff Entrance Project (C11202121) to Greg Nelson Construction,
in the amount of $94,210, the amount of the lowest responsible and responsive bid, conditioned on Greg
Nelson Construction’s timely execution of the project contract and submitting all required documents,
including but not limited to, executed bonds, certificates of insurance, and endorsements, in accordance with
the project bid documents.
6. Approves a construction contract contingency of $10,000.
7. Directs staff to issue a notice of award to Greg Nelson Construction.
8. Authorizes and directs the City Manager to execute the project contract on behalf of the City of Petaluma
upon timely submission by Greg Nelson Construction, of the signed project contract and all other required
documents, including but not limited to executed bonds, certificates of insurance, and endorsements, in
accordance with the project bid documents.
Under the power and authority conferred upon this Council by the Charter of said City.
REFERENCE: I hereby certify the foregoing Resolution was introduced and adopted by the
Council of the City of Petaluma at a Regular meeting on the 3rd day of November
2025, by the following vote:
