OF THE CITY COUNCIL OF THE CITY OF PETALUMA APPROVING THE LOT LINE ADJUSTMENT AND VACATION OF MADISON STREET RIGHT OF WAY FOR A PORTION OF WIZARD OF METALS PROPERTY ALONG THE PETALUMA RIVER (APN 007-071-011) AT 92 LAKEVILLE STREET WHEREAS, Section 46 of Article VII of the Petaluma City Charter provides, in pertinent part, that no City action providing for the sale or lease of real property having a value of $3,000 or more may be taken except by ordinance or pursuant to a general law of the State; and WHEREAS, Vacation (also known as abandonment) of streets and public service easements is governed by California Streets and Highways Code, Division 9, Part 3, Sections 8300 et seq., while this action is a land swap and not a vacation per se, the City is able to make the requisite findings to vacate the property; and WHEREAS, the City of Petaluma Portion of APN 007-071-007 and 008 with Madison Street and Wizard of Metals (Lakeville Development LLC) and portion of APN 007-071-011 located between the Petaluma River and Madison Street have requested approval of a land swap where the City of Petaluma would acquire an approximately 15,439 square foot (0.35 acres) portion of APN 007-071-011 from Wizard of Metals (Lakeville Developments LLC) and Wizards of Metals would acquire a 9,116 square foot (0.21 acres) portion of APN 0007-071-007 & 008 with a portion of Madison Street from the City of Petaluma as shown in Exhibits A and B attached hereto; and WHEREAS, the property is currently owned by Lakeville Developments LLC, also known as Wizard of Metals, and is to be acquired by the City of Petaluma, traversed by the Lynch Creek Trail, providing non-vehicular access from Lakeville Street to the Water Street and public parking area at the terminus of Water Street. The property to be dedicated also serves as an area to maintain the flood wal l of the Petaluma River Park; and WHEREAS, the property currently owned by the City of Petaluma and to be acquired by Wizard of Metals is presently utilized by Wizard of Metals as sole access to the property of Lakeville Street; and WHEREAS, the proposed land swap does not propose any change to the existing use of either property, and it does not propose a change to the land use designation of the General Plan; and EFFECTIVE DATE OF ORDINANCE December 17, 2025 Docusign Envelope ID: 045B7D01-1274-4336-ACEF-BEB171775505 2 Ordinance No. 2913 N.C.S. WHEREAS, the land exchange would support the implementation of the Petaluma General Plan 2025 in that it would allow for and expand public access on the existing Lynch Creek Trail path across APN 007-071-011 between Lakeville Street and the pedestrian bridge at Water Street; and WHEREAS, the land swap is consistent with major objectives for the Central Petaluma Specific Plan planning sub-area as identified in the General Plan 2025, in that it supports ongoing connection to the Petaluma River through maintaining public access along the river while maintaining traditional industrial waterfront activities; and WHEREAS, the land swap is in conformance with General Plan Policy 2-P-12, which calls for the establishment of pedestrian access to the Petaluma River; and WHEREAS, the land swap is in conformance with General Plan Policy 5-P-15, which calls for the implementation of the bikeway system as outlined in the Bicycle and Pedestrian Plan (General Plan Exhibit 5- 2) and expands and improves the bikeway system as the opportunity arises; and WHEREAS, the land swap supports associated General Plan Policy 6-P-2-A, which calls for the provision of public access and recreational opportunities along the length of the Petaluma River and its tributaries, to the very extent possible; and WHEREAS, the City of Petaluma would acquire an approximately 15,439 square foot (0.35 acre) portion of APN 007071-011 (Wizard of Metals) in exchange for 9,116 square foot (0.21 acre) portion of APN 007-071-007 & 008 and a portion of Madison Street (City property) to Wizard of Metals (Lakeville Developments LLC) and are attached hereto and incorporated into this ordinance as Attachment 2 and Attachment 3 respectively; WHEREAS, on November 3, 2025, the City Council held a regular public meeting during which it duly received and considered evidence, including the staff report and any comments from staff and the public and introduced the Ordinance by a vote of 7-0. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. Recital Finding. The City Council hereby finds and determines the foregoing recitals to be true and correct and hereby incorporates them into this ordinance as findings and determinations of the City Council. Section 2. CEQA Finding. Pursuant to the California Environmental Quality Act (“CEQA”), City staff determined that the Project is covered by the general rule that CEQA applies only to projects that have the potential for causing a significant effect on the environment. Staff found that there is no possible significant effect directly related to the land swap as proposed, as there is no proposed change in existing conditions with the exception of ownership; therefore, no further action is required under CEQA pursuant to Section 15061(b)(3) Docusign Envelope ID: 045B7D01-1274-4336-ACEF-BEB171775505 3 Ordinance No. 2913 N.C.S. of the State CEQA Guidelines (14 CCR Section 15061(b)(3)), and independently, the Project is categorically exempt (class 5) pursuant to Section 15305 of the State CEQA Guidelines (Minor Alterations in Land Use). None of the exceptions to Categorical Exemptions set forth in the CEQA Guidelines, Section 15300.2, apply to this project. Section 3. Summary Vacation Findings. The City Council is able to make the summary vacation findings pursuant to Streets and Highways Code Sections 8330, 8331, and 8334 to dispose of the portions of the City’s property dedicated in Exhibit A and Exhibit B, respectively. Section 4. Approval of the Land Exchange. In accordance with Section 46 of Article VII of the Petaluma City Charter and other applicable law, the City Manager is hereby authorized and directed to sign the survey documents made a part of this ordinance as Exhibit A and Exhibit B and any other agreements necessary to acquire and dispose of the portions of property dedicated in Exhibit A and B, respectively. Section 5. Severability. If any section, subsection, sentence, clause, phrase, or word of this ordinance is for any reason held to be unconstitutional, unlawful, or otherwise invalid by a court of competent jurisdiction or preempted by state legislation, such decision or legislation shall not affect the validity of the remaining portions of this ordinance. The City Council of the City of Petaluma hereby declares that it would have passed and adopted this ordinance and each and all provisions thereof, irrespective of the fact that any one or more of said provisions be declared unconstitutional, unlawful, or otherwise invalid. Section 6. Effective Date. This ordinance shall become effective thirty (30) days after the date of its adoption by the Petaluma City Council. Section 7. Posting/Publishing of Notice. The City Clerk is hereby directed to publish or post this ordinance or a synopsis for the period and in the manner provided by the City Charter and other applicable law.
