City's 13 legal fight with Council Member Moynihan .over alleged campaign contribution 14 limit violations, continues. City began litigation after he refused to admit 15 wrongdoing or pay fine. Council Member Moynihan has cost community $40K 16 while "fhumbing .his n-ose a.t the community." PUBLIC COMMENT ,. Geoff Cartwright, Petq umq, spoke about interim study districts. Lots ofdevelopers "banging on the door in Pe aluma." Some already -approved.. _All this anal impacts, from past developments riot yet assessed -although; alre:a,dy °felt by commuhity. Do not have up-to-date FENA flood ;insurance reaps. Traffic study scheduled. to come before Council this fall; Surface 'Water S~tu_dy- should be complete next winter. The County .General, 'Plan process is lo:okirg at similar issues. Was disturbed that the Press Democrat ,placed. an article. on the front page,, granting it more ~ important than the. fact that an '18=year-old Petaluma resident was fatally shot at a party-:.She will talk to the: Press Democrat. .Next. winter would like to see Public Facilities and :services seal cracked asphalt so there won't be as much seepage leading to potholes.. •3 Vice. Feels citizens are skeptical because "they are told ~ they can't trust City Nall." - to look at budget', financing options. Public skeptical. because they are being told,. not to trust City Hall. Will allow Council to go voters down the road.. • CounciF Member AAagure: Would also like such committee to look dt benefit distric"fs -could do without being tied to election schedule.. David Keller. says can be leveraged you :can spend 25 years repaying -discuss by committee and Council. • Council Member Torliatt: Did riot receive e-mail from Keller -would Vice Mayor Healy share it? (Vice Mayor Healy agreed.) Think very difficult for staff with positions unfilled. •:• Council Member Cader-Thompson: As far as General Plan, would like. to see than two more years. RESO. 2002-102A N.C.S. RECRUITMENT AND:SELECTION OF`_FUTURE CITY MANAGER Discussion and."Possible Direction/Action Regarding Recruitment and Selection of Future City Manager. Mayor Thompson -The intent this evening is to .authorize Heather Renschler of Ralph .Andersen & Associates to recruit for interim and permanent City Manager. Motion to adopt Reso. 2002-102A N.C.S., authorizing City Manager to enter into agreement wifh Heather Renschler, President/CEO of Ralph Andersen Vol. 38, Page 90 July 8, 2002 Associates, to conduct the search for'Interim City Manager and City Manager. Ivl/S Torliatt/Gader=Tf;ompson. AYES: C'ader-Thompson, Mayor Thompson, NQ:ES: None ABSENT: Moynihan ABSTAIN: None Vice Mayor Healy, Maguire, O'Brien, Torliatt Ms. Renschler-Has enjoyed working with Council so far. 'Will work with'staff to find appropriate .date to present potential interim candid'ates.. In terms of candidates they:migh.t have nfigrmation on,-she asked Council to get iri touch. with her~directly. She will .also work with Human Resources [director Dennis Morris. In regard to permanentCity Manager search, she asked if Council wanted' search to be national, regional, or within California.. Council Member Cadet-Thompson -Preferred to look~,within California because candidates need fo be familidr with: Brown Act, redevelopment laws, Ms. Renschler = O:n`e advantage of using recruiter-Council will see resumes from out-o.f-state and can review. Important for Council to decide if California experience imperative, Council Member O"Brie,n -Definition of "regional" search? ,Ms_. Renschler- Regio;n'al would include California, Washin'c~ton, Oregon, Nevada, Arizo,n:a, Council Member Torliatt- Prefers natio,n.al search =wants largest pool to choose from. Pointed out that present City Manager is'fcom outside California. Council Member Maguire - His.preference:would be western, regional search.. Can become laborious and expensive to fly people out from faraway. People in. western region :enough working familiarity°with California k~w. Ms. Renschlec -The search will get national recognition. Her question is whereto put focus. Council Member Maguire -Contact International City Managers Association. (ICMA),, Western Cities, etc. Ms. Rensch'ler- Y'es> and question -will Counci want to take recruitmentto :a certain point before election or are will Interim City Manager sit in and develop criteria with new Council: Vice Mayor Healy -Election is in early November -new Council. not seated. tilt early January.. Hopeful that process`will be pretty-far.along,. if not compaete by then. In terms of outreach nece"ssciry for nationdl, regiondl, California search -asked about time constraints. Ms. Renschler - In Fall in Philadelphia is the ICMA meeting -opportunity for'her to go one place and meet multiple candidates. She will work dates up and go over them with Counci_I. Candidates will feel there is a .little bit of uncertainty in not knowing who new Council Member s wilt be. Chosen candidate would be appointed to an at-will. position by a Council that will. no longer be seated shortly thereafter. This can be mitigate by dgreeing that there will be no change to the City Manager's position for a certain amount of time - just so 'they know they won't immediately be asked to resign by the new Council. Council Member Maguire -How many candidates would we lose if we tried to make a decision before- the election? Ms. Renschler - A fair number just because of uncertainty. .,. . Council Member Maguire -That .being. the case, Council should ask for asix- month commitment from Interim City Manager. Council Member Torliatt -Will also know by August 9 or August 14 who potential new Council Member s/Mayor could be. Would, like to proceed as soon as possible. She is concerned with key positions in this city not being filled. Ms. Renschler - In thinking about your fnterim City Manager position -asked if she would be correct in fhirikng anyone who applies for Interim cannot apply for permanent position. Vice Mayor Healy -Asked for Ms. Renschler's recommendation. Ms. Renschler -Recommends Council stick to whatever they decide. Important for candidates to know up front where they stand. Council MemberTorliatt-Would like to know if individual applying for Interim was interested in permanent position. Mayor Thompson -Ask them in interview process. Ms. Renschler - If she knows that up front she can tell candidates they may be competing with someone already in position. Council Member Maguire -Would prefer Interim. not be able to be permanent. Wants to maximize pool. Would like six-month commitment from Interim. Vice Mayor Healy -Inclined to agree but did not want to make that decision tonight. Vol. 38, Page 92 July 8, 2002 1 Council.
