Page 1 of 2 Resolution No. 2026-006 N.C.S. of the City of Petaluma, California RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PETALUMA APPROVING THE PURCHASE OF CALIFORNIA STREAM GAGE IMPROVEMENT PROGRAM (CALSIP) FUNDED STREAM GAGE EQUIPMENT AND ASSOCIATED ON-SITE TECHNICAL SERVICES FROM XYLEM, INC., AND AUTHORIZING THE CITY MANAGER TO EXECUTE ALL DOCUMENTS NECESSARY TO COMPLETE THE PURCHASE WHEREAS, the City of Petaluma Public Works and Utilities Department is implementing the California Stream Gage Improvement Program (CalSIP) Stream Gage Network authorized by City Council to expand real - time monitoring of stage, flow, and water-quality conditions on the Petaluma River and key tributaries; and WHEREAS, CalSIP grant funding was awarded to the City to support installation, commissioning, and initial operation of stream gages that provide near real-time public data through the California Data Exchange Center (CDEC), and the proposed purchase is fully funded by this grant; and WHEREAS, the City has confirmed final gage sites through field evaluation and must procure CalSIP compliant equipment and specialized vendor technical services in order to install and bring the stations online within required State grant deadlines; and WHEREAS, Xylem Inc. has submitted a quote to provide a turnkey, CalSIP ready stream gage equipment package, telemetry and data hosting subscriptions, calibration supplies, shipping, and two on -site engineering trips for a total not-to-exceed cost of $285,601.53; and WHEREAS, the City Charter requires competitive bidding for acquisitions above the Charter threshold, and those procedures are implemented through Petaluma Municipal Code Chapter 4.04; and WHEREAS, Petaluma Municipal Code Section 4.04.050 and California Public Contract Code Section 3400(c)(3) allow the City to dispense with formal competitive bidding when a commodity or service can be obtained from only one practicably available supplier; and WHEREAS, it has been determined that a sole source procurement is necessary because Xylem Inc. is the only practicably available vendor capable of providing the fully integrated CalSIP stream gage solution required for the City’s network and the telemetry/data platform configured to transmit directly to California Data Exchange Center; and WHEREAS, this action is exempt from the California Environmental Quality Act (CEQA) under CEQA Guidelines Section 15378(b)(5) because it is an administrative activity that will not result in a direct or reasonably foreseeable indirect physical change in the environment. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Petaluma as follows: 1. Finds and determines that the sole source procurement of CalSIP stream gage equipment and associated technical services from Xylem Inc. is justified pursuant to California Public Contract Code Section 3400(c)(3) and Petaluma Municipal Code Section 4.04.050. Approves the purchase from Xylem, Inc. in a total not-to-exceed amount of $285,601.53 for CalSIP stream gage equipment, telemetry and data services, calibration supplies, shipping, and on-site technical support. 3. Authorizes the City Manager to execute all documents necessary to complete the purchase and to take all administrative actions required to implement this Resolution. Under the power and authority conferred upon this Council by the Charter of said City.
