CONSTRUCTION CONTRACT FOR THE. AIRPORT YINDERGRUUND STORAGE TANK REMOVAL PROJECT

RECOMMENDATION:
Adopt a resolution accepting completion of the construction contract for the Airport
Underground Storage Tank Removal Project No. 000.100208.
2. DACKGROUND:
The Airport_ Underground Storage Tank Removal Project, as first approved in the FY 08/09
CIP Budget, .included the removal and disposal of three, 12,000-gallon underground storage
fuel tanks, testing for soil contamination, site work excavation, associated electrical and utility
work, and restoration of concrete and asphalt surfaces at the Petaluma Municipal Airport.
Removal of the three tanks was mandatory per State regulations.
The Notice Inviting Bids was issued on November 25, 2008, and bids were received and
opened on December 18, 2.008. City Council awarded the construction contract to Bay Pacific
Pipelines, Inc. on January 26; 2009, who has satisfactorily completed. the work.
Per contract requirements; the 10% retention will be released sixty days after Council
acceptance of the project.
DISCUSSION:
Staff recommends accepting completion .of the construction contract for the Airport
Underground Storage Tank. Removal Project, since the contractor has fulfilled all contract
requirements. Approval of this resolution will assure release of retention to the contractor.
Due to contamination found through pre-construction. ground sampling and during the
removal of the three tanks, the County of Sonoma's Department of Health Services. has placed
the removal. site in the .State's Leaking Underground Storage Tank Program. Additional soil
and groundwater investigation will continue~beyond completion of this project, upon approval
of a work .plan provided by a consultant. Sonoma County, who is the overseer of the
additional. investigation and closure of clean-up sites, will guide the City through the process.
.In addition, the City is eligible to apply for the State Clean-up Fund; staff is already in the
process of applying for the funding, as suggested by the County.

WIl<EItEAS, in accordance with Seetiori 68 of Article X of the City of Petaluma
Charter, Section 20162 of the California Public Contract Code and other applicable law,
the City of Petaluma.solcted bids for the Airport Underground Storage Tank Removal
Project ("Project"); and
WIiEItEAS, bids for the Project were opened on December 18, 2008 in
accordance with California Public Contract Code Section 4104.5 and other applicable
law; and
WIIEEIZEAS, the apparent low bid for the Project was the bid of Bay Pacific
Pipelines, Inc. in the amount of $83;000; and
WHEREAS, by Resolution No. 2009-010 adopted on January 26, 2009 the City
Council of the City of Petaluma found the bid of $83;OOO:for the Project to be the lowest
responsive bid and awarded the Project to Bay Pacific Pipelines, Inc. in the amount of
$83,000, conditioned on Bay Pacific Pipelines, Inc. timely executing the Project contract
and submitting all required documents, and authorized .and directed the City Manager to
sign the Project contract on behalf of the City upon such timely submission and to
execute on behalf of the City any change orders and.other amendments to the Project
contract that were necessary to effectively complete the project and/or to realize the
Project and/or cost benefits for the City so long as such change orders or amendments did
not result in an increase in excess of $20,750; and
WHEREAS, the following change orders affecting the Project amount have been
approved:

WIiEItEAS, City staff have inspected. the Project .and determined that it has been
substantially completed in accordance with the contract requirements subject to the
Contractor's continuing warranty and other obligations pursuant to the contract; and
WII~Elt>Et~S, based on the foregoing, staff recommends acceptance of the Project
on behalf of the City.

Petaluma as follows:
1. The Airport Underground Storage Tank Removal Project No. 000100208, with a
final contract amount of $82;000, is accepted as complete, subject to the Contractor's
completing, the punch Gist work. prior to release of the. retention, continuing warranty and
other obligations pursuant to the contract.
2. The City Clerk/Recording Secretary is hereby authorized and directed to file a
Notice of Completion concerning ;the Project with the Sonoma County Clerk's Office
within ten (10) days of the date of this Resolution.
3. Staff are hereby authorized and directed to release all undisputed retention not
subject to pending change orders within sixty (60) days of the date of this Resolution and
in accordance with the terms of the Project contract, California Public Contract Code
Section 7107 and applicable. law.
