Summary Statement: In October 2007, the Petaluma Police Department began plans to take over the_ county- wide Office of Traffic Safety Avoid the 13 anti-DUI campaign from the City of Santa Rosa. In January of_2008, the City of Petaluma applied for and .received a three year Avoid the 13 grant for $659,000 (refer to Attachment 4 ). Thin grant included $224,000 for the City of Petaluma to purchase a DUI Mobile Command Vehicle (MCV) ;for Avoid the 13 operations. The Police Department recognized this one-time funding opportunity could also help meet the long-.term .emergency preparedness needs for the entire City of Petaluma. Currently, the City of :Petaluma .does not have a MCV. A MCV will facilitate in the field primary command and communications during natural disasters (EOC), .critical incidents (SWAT/HNT/Fire Incidents) and special events. A MCV also provides emergency communications in the event the public safety communications center at the Police Department is not able•to function due to a natural. disaster or a system failure. To meet the needs.of the grant and the City, the Police Department is requesting., to purchase a $363,327.52 MCV from LDV, Inc. utilizing the OTS grant funds and $139,327.52 in Asset Seizure Funds. RECOMMENDATION: Adopt a Resolution Authorizing the Police Department to purchase a Mobile Command Vehicle for the City of Petaluma with Office of Traffic Safety Grant and Asset Seizure Funds. 2. DACKGROUND: Sonoma County Avoid the 13 anti-DUI campaign began in 2002. Avoid the 13 is comprised of the 13 local law enforcement agencies in Sonoma County. In each county, there is a lead agency designated to administer the county-wide grant from the Office of Traffic Safety. The City of Santa Rosa Police Department has been the lead agency for the past six years. Due to budget constraints, the City of Santa Rosa elected to discontinue administering the grant. The California Office of Traffic Safety asked the City of Petaluma to become the lead agency for Sonoma County. In January of 2008, the City of Petaluma applied for and received a three year Avoid the 13 DUI grant for $659,000. This grant included $224,000 for the City of Petaluma to purchase a DUI Mobile Command Vehicle (MCV) for Avoid the 13 operations. The Police Department recognized this one- time funding opportunity could also help meet the long-term emergency preparedness needs for the entire City of Petaluma. Currently, the City of Petaluma does not have a MCV. A MCV will allow for a command and communication post to be set up in the field instead of at the Police Department. The MCV will serve as an Emergency Operations Center during natural disasters, critical incidents that utilize the Police Department's special response teams (SWAT/HNT) or at major fire incidents. Lastly, it provides an emergency command and communications center in the event the primary public safety communications center at the Police Department is not able to function due to a natural disaster.or a system failure. Currently, the City does not have a backup public safety communication system. If the Police Department's communications center became disabled, the Police Department has to switch over to the local Sheriff's Department. OTS grant funds became available October 1, 2008. In. November 2008, the Police Department began the process identifying vendors who produce MCV for public safety agencies. The search included local, in state, and national vendors. The Police Department then determined the specific needs of the DUI MCV to meet the grant objectives. Additionally, we identified the needs for the City of Petaluma for emergency preparedness and response. Based on the needs of the OTS grant, the specific long term needs for the City's Emergency Operations Center (EOC), and the specialized use of this resource, the Police Department could not find a local vendor to produce the MCV. When a local vendor could not be located, the Police Department submitted a request to the California Chief's Association for all. agencies to respond that had purchased a MCV in the previous five years identifying their vendor and project coordinator. The Police Department received responses from all over the state. From these responses, the Police Department identified a list of eight vendors from throughout the country. There was only one California vendor identified, who had since gone out of business. Each vendor was asked to provide a list of their last ten public safety projects. Extensive research was conducted with each agency, including site visits to eight different public safety agencies. Through months of research and evaluation one vendor was consistently rated above all other vendors. This national vendor, LDV, Inc., based out of Wisconsin, has provided this type of specialty vehicle to public safety agencies throughout the United States. LDV, Inc. has been awarded the Government Services Agreement (GSA) contract for MCV's. The GSA pricing provides for a considerable cost savings to the City of Petaluma when compared to other vendors. Based on cost and the specific needs of the OTS Grant and the City's EOC preparedness, the Police Department is requesting to use LDV, Inc. as the sole source vendor for this project pursuant to local ordinance. (Refer to Attachment 2 of this Agenda Report for the Sole Source Letter.) The Police Department has identified acity=wide multi-use MCV that also meets. the specific objectives of the OTS grant. (Refer to Exhibit A of the Resolution for details on the MCV specifications). The total cost for this project is $363,327.52. To purchase this MCV, the City of Petaluma will use California OTS AVOID the 13 Grant funds in the amount of $224,000.00 and fund from the City's Asset Seizure Fund account in the amount of $139,327.52. The use of the Asset Seizure Funds complies with Department of Justice rules and regulations related to the use of seized funds. No funds from the Cities' general fund budget will be used for the purchase of this vehicle. 3. DISCUSSION: The Police Department has applied for and received grant funding from OTS for $224,000 to be used to purchase the mobile command vehicle for this project. The grant was previously authorized by the Council and city staff is requesting authorization to use such funds for the purchase this vehicle. This authorization is being requested due to the total project cost. The remaining balance of $139,327.52 for this project will come from the City's Asset Seizure Fund account. If the council chooses not to spend Asset Seizure Funds, the Police Department does not have the funds available to cover the remaining balance for this fully equipped mobile command vehicle.. 4. FINANCIAL IMPACTS: This allocation of funding will be totally utilized for the purchase of a fully equipped mobile command vehicle. To purchase this MCV, the City of Petaluma will use the $224,000 from the California OTS AVOID the 13 Grant and $139,327.52 from the City's Asset Seizure Fund account. The use of the Asset Seizure Funds complies with Department of Justice rules and regulations related to the use of seized funds.
