HomeMy WebLinkAboutPLANNING COMMISSION RESOLUTION 2025-05 12/09/2025 RESOLUTION NO. 2025-05 RESOLUTION OF THE CITY OF PETALUMA PLANNING COMMISSION RECOMMENDING THAT THE CITY COUNCIL ADOPT AN ORDINANCE AMENDING THE CITY OF PETALUMA IMPLEMENTING ZONING ORDINANCE SECTION 4.030 OF CHAPTER 4 – ZONE DISTRICTS AND ALLOWABLE LAND USES, SECTION 11.060 OF CHAPTER 11 – OFF-STREET PARKING AND LOADING FACILITIES, AND SECTION 28.020 OF CHAPTER 28 – GLOSSARY, AND AMENDING SMARTCODE SECTION 3 – BUILDING FUNCTION STANDARDS, TABLE 4.10 OF SECTION 4 – URBAN STANDARDS, AND SECTION 9 – GLOSSARY TO IMPLEMENT SIXTH CYCLE HOUSING ELEMENT PROGRAM 7 PERTAINING TO ZONING REGULATIONS FOR RESIDENTIAL CARE FACILITIES WHEREAS, the City of Petaluma Implementing Zoning Ordinance (IZO) Section 25.010 provides that no amendment that regulates matters listed in Government Code Section 65850 shall be made to the IZO unless the Planning Commission and City Council find the amendment to be in conformity with the General Plan; and WHEREAS, On March 20, 2023, the City Council approved Resolution No. 2023-038 N.C.S., adopting the City’s 6th Cycle (2023-2031) Housing Element, and the State’s Department of Housing and Community Development (HCD) certified the adopted Housing Element on May 18, 2023, and Petaluma’s Housing Element aims to facilitate the production of various housing types at different income levels for diverse household and family types and through its implementation, the Housing Element supports housing production, improves and preserves existing housing in the community, and promotes fair housing practices ; and WHEREAS, City Council adopted via Resolution No. 2023-038 N.C.S., an Addendum to the Initial Study/Negative Declaration prepared for the previously adopted Housing Element (5th Cycle 2015-2023) determining that adoption of the 2023-2031 Housing Element would not result in potentially significant impacts not previously identified or analyzed nor would they increase the severity of any previously identified impacts and no alternatives previously found to be infeasible had become feasible, and none of the factors set forth in CEQA Guidelines 15162(a)(3) were found to exist. WHEREAS, the City is committed to implementing the policies and programs of the Housing Element and is required to report to HCD annually on progress achieving the City’s Regional Housing Needs Allocation (RHNA) and implementing policies and programs of the Housing Element; and WHEREAS, Program 7 is among the programs of the current Housing Element adopted in accordance with State interpretation of Affirmatively Furthering State Housing legislation and requires an amendment to the City’s zoning regulations to facilitate the development of a variety of housing types, including Residential Care Facilities (RCFs); and WHEREAS, as discussed in the Housing Element, limiting RCFs to six or fewer clients in residential zones, the requirement for placing the facility on an upper floor or behind a ground- Docusign Envelope ID: 93D0E7F5-3985-4063-87FA-3DD89BD703EA December 9, 2025 Recommendation: Residential Care Facilities Ordinance Planning Commission Resolution 2025-05 2 floor street-fronting use in commercial and mixed-use zones, and the requirement for a subjective conditional use permit process that does not provide certainty in outcomes is a constraint for development of additional types of RCFs including larger RCFs; and WHEREAS, the Housing Element requires that code modifications must at minimum allow RCFs for seven or more persons to be permitted in residential, mixed -use, and commercial zones, subject to findings for approval that are objective and provide certainty in outcomes and that the placement requirement in commercial and mixed-use zones for upper floor and behind a ground floor street fronting use will be removed; and WHEREAS, pursuant to IZO Chapter 25, the City of Petaluma Planning Director may initiate an amendment, and the City Council may adopt the amendment upon the recommendation of the Planning Commission; and WHEREAS, pursuant to IZO Sections 25.010 and 25.050.B, if the Planning Commission finds the IZO amendments to be in conformance with the Petaluma General Plan, and consistent with the public necessity, convenience, and general welfare, it may recommend amendment of the IZO to the City Council; and WHEREAS, the draft revisions to the IZO and SmartCode were presented to the Planning Commission at a Study Session on October 14, 2025; and WHEREAS, on November 28, 2025, the City’s Notice of Public Hearing to be held on December 9, 2025, before the City of Petaluma Planning Commission, was published; and WHEREAS, the Planning Commission held a duly noticed public hearing on December 9, 2025, at which time all interested parties had the opportunity to be heard. NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF PETALUMA AS FOLLOWS: 1. The foregoing recitals are true and correct and incorporated herein by reference as findings of the Petaluma Planning Commission. 2. Based on the staff report, staff presentation, comments received, and the public hearing, the Planning Commission makes the following findings based on substantial evidence in the record: a. California Environmental Quality Act Finding: The Residential Care Facility Zoning Code and SmartCode amendments implement the 2023-2031 Housing Element, which the City Council adopted via Resolution No. 2023-038 N.C.S. and relies on the environmental review prepared for the 2023-2031 Housing Element. As a part of Resolution No. 2023-038 N.C.S, the City Council incorporated an Addendum to the Initial Study/Negative Declaration prepared for the Docusign Envelope ID: 93D0E7F5-3985-4063-87FA-3DD89BD703EA December 9, 2025 Recommendation: Residential Care Facilities Ordinance Planning Commission Resolution 2025-05 3 previously adopted Housing Element (5th Cycle 2015-2023). The Addendum determined that adoption of the 2023-2031 Housing Element would not result in potentially significant impacts not previously identified or analyzed nor would they increase the severity of any previously identified impacts. In addition, no alternatives previously found to be infeasible had become feasible, and none of the factors set forth in CEQA Guidelines 15162(a)(3) were found to exist. b. General Plan Finding: The Residential Care Facility Ordinance is consistent with the adopted 2025 City of Petaluma General Plan and with adopted elements of the 2025 City of Petaluma General Plan (2023-2031 Housing Element), including the following goals, policies, and programs, in that: • Program 7 - Zoning Amendments: Program 7 includes a specific action to amend zoning regulations to permit Residential Care Facilities (RCFs) for seven or more people in residential, mixed-use, and commercial zones, subject to objective standards that provide certainty in outcomes and to allow Residential Care Facilities in ground-floor street-fronting spaces in all zoning districts where the use is permitted. Program 7 is among the programs of the current Housing Element adopted in accordance with the State's interpretation of Affirmatively Furthering State Housing legislation. The RCF Ordinance implements Program 7 by allowing RCFs by right in all residential, commercial, and mixed-use districts, subject to objective standards that provide certainty of outcomes, including for RCFs located on ground-floor spaces in commercial and mixed-use zones. The Ordinance amends the City’s zoning regulations to facilitate the development of a variety of housing types, including RCFs consistent with Affirmatively Furthering State Housing legislation. • Housing Element Goal 1: Provide opportunities for residential development to accommodate projected residential growth and diverse housing needs of all existing and future Petalumans, and related Policy 1.4 Establish flexibility in the City’s standards and regulations to encourage a variety of housing types, including mixed -use and flexible-use buildings, and affordable housing development. The RCF Ordinance expands the locations in which RCFs are allowed, streamlines the development review process for development of RCFs by removing the conditional use permit requirement for RCFs in commercial and mixed-use zones, establishes parking standards, and consolidates the definitions of RCFs, thus providing greater flexibility for the development of a variety of housing types, including mixed-use and flexible-use buildings, and affordable housing. Docusign Envelope ID: 93D0E7F5-3985-4063-87FA-3DD89BD703EA December 9, 2025 Recommendation: Residential Care Facilities Ordinance Planning Commission Resolution 2025-05 4 • Housing Element Goal 2: Remove or mitigate constraints on housing development to expedite construction and lower development costs while avoiding impacts on environmentally sensitive areas, and associated Policy 2.2 - Streamline the City’s review and approval process for residential and mixed-use projects to ensure objective evaluation and greater certainty in outcomes to facilitate affordable housing production, and associated Policy 2.3 - Develop incentives such as streamlined review, fee adjustments, and objective design standards to encourage residential development that is affordable and environmentally appropriate. Amendments to the regulations for RCFs remove the requirement for a conditional use permit, expand the locations in which housing for seniors, persons in need of assistance, and multifamily housing are allowed, streamline the development review process, and reduce land use application fees. Maintaining neighborhood compatibility and avoiding environmentally sensitive areas will be achieved through the Site Plan and Architectural Review process and through compliance with the California Environmental Quality Act. c. The proposed Zoning Text Amendment to expand the locations in which residential care facilities are allowed and to streamline the land use entitlement process by removing the requirement for a conditional use permit for residential care facilities is consistent with the public necessity, convenience, and general welfare in that: The RCF Ordinance is in conformance with the City of Petaluma Housing Element in that it creates objective standards to allow the development of RCFs throughout Petaluma and removes the requirement for a conditional use permit for RCFs in the MU2, C1, and C2 zones, and it removes the prohibition of placing RCFs in ground-floor spaces. By removing land use restrictions, the Ordinance creates clear, objective standards for applicants to ensure objective evaluation, provide greater certainty in outcomes, and facilitate a streamlined review of qualifying residential projects. Adoption of the RCF Ordinance is in the public interest and supports the convenience and general welfare of the public by creating parking standards for RCFs and for senior housing units that are part of an RCF, and by simplifying and clarifying the definitions of multiple types of RCFs into one consolidated definition. 3. All new structures in industrial zones shall provide no less than 35 spaces per acre of land. Chapter 24 – Administrative Procedures Section 25.050 Site Plan and Architectural Review A. Purpose. The purpose of site plan and architectural review (SPAR) approval is to secure compliance with this Zoning Ordinance and to promote the orderly and harmonious development of the City. It is the intent of this section to achieve a satisfactory quality of design in individual buildings and sites, appropriateness of buildings to their intended use, mitigate the environmental impacts of buildings and sites, and facilitate harmony between developments and their surroundings. No City permit or license shall be issued for any of the following uses until site plan and architectural approval has been granted: 1. Public buildings and grounds; 2. Public and private schools, colleges, libraries, art galleries and museums; 3. Public and private hospitals and other institutions; 4. Churches and other religious buildings and grounds; 5. Clubs, lodges, mortuaries, meeting halls, and other places of public assembly; 6. Motels and hotels; 7. Office buildings; 8. All commercial and industrial uses; 9. Mobile home parks; 10. Parking lots; 11. Public utilities, structures and installations, except poles and towers carrying overhead lines; 12. Chapter 28 – Glossary Section 28.020, Definitions, “R” Residential Facilities, Adult (ARF). Facilities of any capacity that provide 24-hour non- medical care for adults ages 18 through 59, who are unable to provide for their own daily needs. Adults may be physically handicapped, developmentally disabled, and/or mentally disabled. Residential Care Facilities for the Chronically Ill (RCFCI). Facilities with a maximum licensed capacity of 25. Care and supervision is provided to adults who have Acquired Immune Deficiency Syndrome (AIDS) or the Human Immunodeficiency Virus (HIV). Residential Care Facilities for the Elderly (RCFE). Provide care, supervision and assistance with activities of daily living, such as bathing and grooming. They may also provide incidental medical services under special care plans. The facilities provide services to persons 60 years of age and over and persons under 60 with compatible needs. RCFEs may also be known as assisted living facilities, retirement homes and board and care homes. The facilities can range in size from six beds or less to over 100 beds. The residents in these facilities require varying levels of personal care and protective supervision. Because of the wide range of services offered by RCFEs, consumers should look closely at the programs of each facility to see if the services will meet their needs. Residential Care Facility – Facilities that provide 24-hour non-medical care, supervision and assistance with activities of daily living, such as bathing, grooming, and feeding to persons, regardless of age, who are unable to provide for their own daily needs, and facilities that care for minors unable to live with their parents or guardians. Residents may be physically handicapped, developmentally disabled, and/or mentally disabled, and incidental medical services under special care plans may be provided. Included in the definition of Residential Care Facility are Residential Care Facilities for the Elderly (RCFE), Adult Residential Care Facilities (ARF), Residential Care Facilities for the Chronically Ill (RCFCI), Continuing Care Retirement Communities (CCRC), Community Crisis Homes, Social Rehabilitation Facilities, Group Homes, Foster Family Homes, and Crisis Nurseries as defined and licensed by the State of California. Skilled Nursing Facilities are not included in the definition of Residential Care Facility.
