BACKGROUND: • On April 16, 2001, the PCDC adopted,the Report to Council, a.public document designed to provide background.information to the PCDC and taxing entities • affected by-the proposed Amendrnentto the Redevelopment Project. ,The purpose of the'Repoi t was to: • Set forth.the-reasons Tor the selection of the projectarea; • Show blight and urbanization evidence; • Explain programs and activities the Agency intends to implement to • eliminate..blight; . • Propose financing mechanisms for such-programs!and;activities; and • Provide'adescription of how the projects will eliminate blight. Also on,April 16,•2001;the PCDC adopted the Final EIR.; A"Draft Environmental . Impact Report had been prepared and was circulated on January 12, 2001 after which there was a 45-day comment period for the public to provide comments. • The Planning Commission -reviewed and commented upon the Draft EIR , the Preliminary Report to Council and the Draft Amended and Restated •Redevelopment Plan:for the CBD Project Area at their,meeting of February 27, 2001. ;. •• • 'Pursuant to Section 33346 of The Community Redevelopment Law;.the,Planning • 'Commission found that the!proposed Second Amendment"to the Redevelopment Plan for the Central Business,District Redevelopment Project conforms to the General Plan of the City of Petaluma: Additionally, pursuant to Section,65402 of the Goveinment.Code, with respect to public activities which may be undertaken within the area added by the Second Amendment and•the original Project Area pursuant to'the Redevelopment Plan, as amended by-the Second Amendment, the Commission determined such-activities and undertakings conform to the General Plan of the City of Petaluma and forwarded the DEW to the City Council of Petaluma, including Commission comments, and authorized the preparation •of a Final ER at the end of the comment;period. • In summary, the proposed Plant Amendment will extend various time and financial limits of the Existing CBD RedevelopmenntPlan; as well as add territory (Added Area)','to•.the CBD Project Area(Existing, Area). The proposed Added Area consists,of approximately 127 acres 6f commercial, industrial and residential land uses located to the west and'east of the Existing,Area: Figure I-2 in the attached Report shows the location of the Amended'Area (the combination of the Existing Area and Added Area).- r i The Redevelopment Plan Amendment will provide the Agency withs needed 0. additional legal and financial -resources to alleviate blighting, ,conditions, itn P lament the Central .Petaluma Specific Plan, and promote- economic development in the Eiistingr Area, The Amendment is proposed to-enhance,the Agency's ability to eliminate'blight in-the:Amended Area'in .a more effective manner than is.possible under,ItheRedevelopment Plan in,place.at this:time: . . Otherwise, the;CBD Project Area(the Existing Area) consists of . approximately 98 acres'and encompasses the majority of the:historic downtown ' . core of thelCity from.D. Street'to Washington Sheet and from,Lakeville.,StreeVto Liberty and 5"' Streets: The proposed Plan,Amendment would-add approximately 127,acres'to'the Existing^,Area,;creating a225-acre-Amended-Area. , . As ,shown in'Figure 1-2 ;in the attached Report;to Council, the'proposed,Added Area is located in two areas, to the west and east of the Existing.: Area The western portion of theEAdded-Area isrgenerally bounded by Union Street, Western • Avenue, Howard Street, and L' 'ilierty Street. The eastern portion of the Added Arearis generally bounded by D ;Street, M cNear;Avenue, the Northwest Pacific Railroad, iand and Petaluma Boulevard (the western portion does not include the • McNear.Peiiinsula or McNear'Channel). 4. rFuvANGAL IMPACTS:-._ , . . '1 According to,the chart below the Added Area of the.CBD Project.Area Will have .I .a property tax 'base assessed value of approximately $49 million." Under the . proposed Plan Amendment, the timeand fiscal limitsof the proposed Added Area would be the same as the lunits-of anew plan. • 5. CONCLUSION: ' • hi 1998, the.PCDC.approved and adopted the Petaluma Redevelopment Strategy which recommended adding the portions of the Central Petaluma Specific Plan (Specific Plan) that arenot currently in either the City's Central Business District (CBD) or Petaluma Community Development (PCD) Redevelopment Project • • Areas. In. FY 2000-01, Seifel Consulting was hired to prepare a CBD Plan Amendment to, expand the,CBD Project Area On April 16, 2001, the PCDC approved a Report to Council which established the feasibility of such an - expansion and set a date for"a public hearing. All required notices-have been mailed, filed and posted. The next;step in the Plan Amendment process is for the City Council/PCDC 'is- hold_a,public_hearing.in order to • • :receive:written and oral testimony regarding the proposed Amendment, • consider certifying the adequacy of the EIR,,and • approve a resolution.ado_pting Owner Participation.and Business Re-Entry' Preference Rules for the CBD Redevelopment Plan. • At the next.regular'City Council meeting of June 4, 2001, the,City Council will adopt written findings to written objections and_introduce the first reading of an ordinance to approve.and adopt-the CBD Plan Amendment. • • • • 6. AND BUSINESS'REENTRY PREFERENCE RULES FOR THE CENTRAL BUSINESS REDEVELOPMENT AREA • WHEREAS, proceedings in connection with the preparation and adoption of a Second -Amendment to the•RedevelopmentiPlan for the Central Business District Redevelopment Area (the "Project Area"),'.have been commenced-and • WHEREAS, Community Redevelopment Law ("CRL"), requires that before adoption of a redevelopment plan, the City must adopt and make available.for ;public inspection rules to implement, in connection with the Redevelopment Plan, the participation and assistance.in the redevelopment of property in the Redevelopment Area by owners of all Or part of that property if • the owners agree to participate in conforinity_with the Redevelopment Plan adoption by the City Council of the City/of ("City C f. ouncil");and WHEREAS, CRL requires that,the City adopt business'reentry preference rules: for businesses ; wishing to reestablish themselves in the Project Area after redevelopment of property has been • completed. • WHEREAS, in furtherance of the above requirements, the Commission has caused to be prepared, and has reviewed and considered, and now desires to adopt, the owner Participation Rules and Business Reentry Rules for• the Central Business District Redevelopment Area • attached hereto as Exhibits Arndt, inclusive. NOW, THEREFORE, BE IT RESOLVED by the Petaluma Community Development Commission does hereby,reselve as follows: 1. RULES OF THE PETALUMA-COMMUNITY DEVELOPMENT COMMISSION • GOVERNING'PARTICIPATION'BY OWNERS IN THE CENTRAL BUSINESS`DISTRICT REDEVELOPMENT.PROJECT-AREA SECTION 1. GENERAL. These.Rules are promulgated:to implement the provisions of the Redevelopment Plan, for the central Business District Redevelopment Project (the ``Redevelopment Plan") regarding participation by owners in the redevelopment of the redevelopment project area of the Central Business District Redevelopment Project (the "Project Area'') in 'conformity with the • Redevelopment Plan. 'These Rules set forth the procedures-governing:such activities.. - . The Petaluma Community Development Commission ';(the `PCDC) desires and urges • participation',.in the growth and development of the Project ,Area in conformity with the Redevelopment Plan,'by as :many owners' as possible. Successors in interest of original ' " participantsowners-may become participants at any stage with the`written approval of the PCDC. • SECTION 2. PARTICIPATION BY°OWNERS • • The Redevelopment Plan authorizes°the PCDC to permit persons who are owners of residential,, business and other types of real property iin the Project Area'to be given an opportunity to participate in the redevelopment of the Project Area by the.PCDC. Such participation in the • redevelopment of the Project Aremincludes,,in the appropriate circumstances, rehabilitation or demolition of existing, improvements, construction ..of new development, and acquisition of property<that is adjacent`to thealand of a current':owner for approved development, in accordance with the Redevelopment,Plan and the applicable development•and land;use standards of the,City of Petaluma, Californi •;(the "City").• However, these Rules<shall-not be deemed'to confer a right or expectation ,upon any existing property',owner within the. Project Area to obtain the permission; authorization or assistance.from the PCDC to participate in the redevelopment within the.Project Area The PCDC expressly reserves the discretion to evaluate competing proposals for redevelopment within the Project Area and in appropriate 'circumstances,. to withhold or not offer owner participation opportunities for existing owners of property in connection with redevelopment proposals of third parties as approved.by the,PCDC. Participation iiiaaii`Existing Location In appropriate circumstances, an Owner-may-participate in the redevelopment of the Project Area by the PCDC in substantially the sante location either by retaining all,or portions of his property and purchasing adjdeent property from the PCDC or from other existing owners. An owner who participates in the same,location maybe required;to demolish all or part of his existing structures: In some instances,the PCDC•may purchaseand demolish such-structures. Such participation:shall,be.subject to an evaluation_by the PCDC of the economic.feasibility of such.a • proposal and the benefits which such-a proposal shall confer upon the Project Area. • • Participation at Different Locations • • In appropriate circumstances; the PCDC jmay buyland and improvements from exrstmgowners, .• and offer parcels of land for.purchase by'other•participants•or third parties as approved.by the • PCDC prior to offering sn'at property for sale to)the•gener`alMubliC. In such event, an existing owner:may participate`in•the redevelopment ofthe Project Area by the PCDC'at a'different, location within the PrOject Area Suchiparticipation shall be`:subject to an'evaluation by the PCDC of the•economic)feasibility`ofsuch,a.proposal and the benefits which such,a;proposal shall confer upon the PrOjebt Area. • SECTION 3 OWNEWPARTICIPATION:AGREEMENT Each,owner desiring-to participate:Will berequiredto enter into?an Owner Participation. Agreement with the'•PCDC: Each Owner:,Participation Agreement•will contam,provisions•, necessary ito;insurethat the Redevelopment•Participation Proposal (as hereinafter.defined)`sill • be'carried out, and that the subject,property will bedeveloped or•used in accordance with.the• . • conditions;.restrictions,trules and regulations.of the`RedeveloprrientP..lan and'the Owner .Participation Agreement. In the Owner Participation Agreement, a participating owner shall agree to remove, demolish, alter,simprove:or rehabilitate existing''structures and improvements on the propertyinvolved'and'to thereafter use and maintain,the--same in such manner as shall be required by the Redevelopment.Plan. In the Owner Participation Agreement, a participating;owner shall agree to make a part of any lease,rental;agreement, occupancy permit, use or sales agreement pertaining to the property involved or any other document, a provision that there shall be;no.restrictions imposed thereon because of race,.color, creed,.religion, sex,`rnarital;status;national origin, or ancestry. If a.participating owner agrees to remove, demolish,:alter, improve or rehabilitate existing structures and improvements on the property involved in the Owner Participation Agreement,,the participating owner shall.also-agree.to do-so within:-specified time limits established'by.the PCDC. If the participating owner;agrees to construct new structures and/or improvements on the property involved or to remove, demolish, alter, improve or rehabilitate existing property,the participating ownerjshall agree to do so only after,plans, specifications and artist's renderings,-of the building;have been presented to and approved by the PCDC. In order to be eltgibleforareentry preference, a business must file<a-Statement of Interest with the PCDC, identifying the redeveloped property where the business is interested in reestablishing itself. Dwelling Units, • In complianceawiththe Health;andSafety Code Section 3-3331(c), and as provided in Sections B, C and D of this Part,1V, the maximum number of dwelling;units in the Project°Are - shall be regulatedd as provided in the General Plan, the Specific>Plan, and the Zoning Ordinance, as they now exist or may hereafter be/amended. 14. However, conforming owners maybe required by the PCDC to enter into an owner participation agreement with PCDC, in,the event that such owners desire to (1) construct any additional improvements or substantially,alter.or modify existing structures on any of the real property described above as conforming,or (2)acquire additional property within the Project Area. • E. Refusal to Participate, . In the event an owner-participants fails or=refuses to:rehabilitate or newly develop his real property pursuant to this Plan and the participation agreement, the real'property or any interest herein, may acquired by the PCDC. Furtherfhore,'in-accordance with applicable state laws, the PCDC shall provide relocation payments to displacedpersons or families. B. Assistance to Busrness;and Industry Relocation advisory assistance for business or-industry Will-be made available through PCDC. In thoseinstances where'business concerns:and other entities who do not reenter need to be relocated, PCDC shall'/assist m fmding suitable,locations which will allow these business concerns and other entities to continue with minimum'impact on their activities. In all instances, the PCDCshall use its best efforts to provide comparable; alternate locations,which • provide adequate•space,:access,visibilityexposure, parking and functional utility, at occupancy costs which•are within-the financialmeanscof thosebusuness;concerns and entities which are relocated. In the event-that it becomes necessary to relocate a'business and the business cannot be relocated without a:substantial loss.of patronage,.and the business is;not a part of a commercial enterprise having at,lest,one other establishment engaged in the same or similar . abusiness, the PCDC is.required to pay to such-business a relocation:payment as provided in Section 7262 of the Government,Code.
