AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S.,
AS AMENDED, BY RECLASSIFYING AND REZONING ASSESSOR'S PARCEL
NUMBERS 007-574-16, 18, 21 AND 15, FROM R-1, 6500 TO PUD
BE IT ORDAINED by the Council of the City of Petaluma as follows:
23 Section 1. The City Council finds that the Planning Commission filed with the City
24 Council on August 6, 1990 .its report as set forth in its minutes of July 10, 1990,
25 recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S., as
26 amended, by reclassifying and rezoning certain lands being more particularly described as
27 Assessor's Parcel Numbers 007-570-16, 18, 21 and 15 (see Exhibit "A") from R-1, 6500 to
28 PUD (Planned Unit District).

30 Section 2. The City Council further finds that said Planning Commission held a public
31 hearing on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., as amended,
32 on July 10, 1990 after giving notice of said hearing in the manner, for the period and in the
33 form required by said Ordinance No. 1072 N.C.S., as amended.

35 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as
36 amended, the City Council finds the proposed amendment in general conformity with the
37 Petaluma General Plan, and further, that the public interest, convenience and general
38 welfare will be furthered by the proposed amendment.

40 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as
41 amended, and based upon the evidence it has received and in accordance with the findings
42 made, the City Council hereby adopts amendment to said Zoning Ordinance No. 1072

1 N.C.S. so as to reclassify and rezone said property hereinbefore referred to in accordance
2 with the recommendation of the Planning Commission.

4 Section 5. The City Council .finds that the requirements of California Environmental
5 Quality Act Guidelines, Section 15083, have been satisfied and hereby incorporates by
6 reference the Negative Declaration prepared and approved for the project site.

8 Section 6. The City Clerk is hereby directed to post this Ordinance for the period and in
9 the manner required by the City Charter.

11 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
12 any reason held to be unconstitutional by a court of competent jurisdiction, such decision
13 shall not affect the validity of the remaining portions of this ordinance. The City Council of
14 the City of Petaluma hereby declares that it would have passed and adopted this ordinance
15 and each and all provisions thereof irrespective of the fact that any one or more of said

provisions be declared unconstitutional.
