26 Vince Landof, 12 Cordelia Drive, spoke regarding weeds behind the Albertson's
27 (formerly Lucky's) on Petaluma Boulevard North and Payran Street. He asked Council
28 Members Healy, Moynihan and O'Brien to issue a statement that neither they nor any of
29 their business interests will benefit from any decisions they make as Council Members.

31 Joe DeVito, 249 Kentucky Street, Council for Community Television, distributed copies
32 of "Petaluma's Sixth Grade Students Illustrate Water Conservation,' published by the-
33 Argus-Courier May 2, 2001 . He,explained that Council,`for Community Television • .
34 provides content for airing on PetalumaCommunity,Access, the goal of which is to
35 encourage youth to,:become involved in positive community projects. He'provided the

42 commuter parking lot. He expressed concern about improperly pruned trees and
43 asked Mr: Noriel if the;Tree Advisory Committee provided any information to the
public about pruning'. He mentioned the possibility of requiring permits to prune
trees in public right-of-ways.

21 1.2. Status Report Regarding Payran Flood Management Project Financing and
22 Budget. (Hargis) .
0 Water Resources and Conservation Director Tom Hargis provided a status report
• 25 on the Payran Flood Management Project. He noted that City ManagerStouder,
26 Director of Economic Development and Redevelopment Marangella and he had
27 met with Steve Stockton, Division Director of the Army:Corps of Engineers. Mr.
28 Stockton will attend a meeting'in St. Louis on May 11 and will ask for
29 reprogramming of $2.1 million. Mr. Hargis added that the Corps rintends.to begin,
30 construction of the transition'channel on July 16.

32 City Manager Stouder thought that the "worst case scenario" would involve
33 delays to the project if the reprogramming of funds did not.occur.

35 Council Member Torliatt mentioned that she had received complaints from
36 citizens regarding damage to Burlington Drive caused by equipment being used
37 in the project.

29 Ann Morrissey, 201 S. McDowell:Boulevard, and owner of the"'Wherehouse" building on
30 the corner of East Washington Street and McDowell Boulevard, asked Council to
31 consider lowering the height of the trellis feature proposed for that corner, as she -
32 thought it would obstruct citizens' view of the Wherehouse: She suggested a tasteful
33 sign with the name of the shopping center to replace the large;neon"Wherehouse" sign.
: 34 A number of trees would be,removed on that corner to,make way for construction of the
35 trellis; Ms. Morrissey offered these trees to the City,;adding that she would make
36 arrangements to have them transported to their new:Jocation.

38 Steve Geney, North Bay;Construction, noted that construction costs were not going
39 down and urged Council to approve the project.

8 - Council Member Healynoted that Council had received The amended resolution
9 language for Item 14B that day-He thought some language changes were
10 needed. He realized the necessity of moving'forward;with the matter so that
11 construction could begin:this summer. He wondered if Council;could authorize •
12 the project without specifying funding sources. His concern was with section 3 of
13 the resolution, which'implied that this project was possible only because the
14 Rainier Cross-Town Connector and US Highway 191 Interchange Project had -
15 • been eliminated from the•priority,listof Capital Improvement Projects and Traffic
16 Circulation Improvements.

18 Mr..Evert noted that,this project would mitigate some.of the same traffic
19 circulation problems as the Rainier project. ■

21 City Attorney Rich Rudnansky mentioned that Council Member Moynihan had
22 questioned the use of Traffic Impact Fee funds.for this project.
40 Council Member Moynihan asked,if there was a breakdown, by project, of how ,
25 . -Traffic Impact Fee funds had been used. '

27 Finance Director Bill Thomas replied in the negative.

29 City Manager Fred:Stouder noted that Traffic Impact,Fee funds were not
30 earmarked for-specific projects: Funds were used for projects as they became
31 available.

33 Council,Member Moynihan said that he did not doubt the.worthiness.of the •
34 •project. He-thought the City would be at risk-for litigation if.4a full accounting were
' 35 • not made of the funds collected and how they were used.Herthought this project
36 would be effectively taking money from other projects, and that the resolution, as
37 worded; would inot adequately protectthe City.

39 Mayor Thompson added that he was also unhappy with the language of the
40 resolution.

42 Council,Member Maguire asked,Mr..Rudnansky if the resolution presented any
43 legal liabilitiesifor the City. He thought that the interpretation-of "correct use" •
44 was, by definition, subjective. He believed the projecfwas an appropriate use of
`6 traffic mitigation•fees. -

15 reform. He was in favor of third reporting period, and reasonable limits on campaign
16 contributions. He was not in favor of public financing. He noted that self-financed
17 candidates are not limited by'theiordinance.

19 Council Member Maguire believed that a modest amount of public financing would be of
. 20 enormous benefit in "leveling the playing field."

22 Vice Mayor Cader-Thompson described the amount'of money spent on some
etcampaigns as "obscene." She supported"literature disclosure requirements.

26 candidates from accepting contributions after a certain:point in the election cycle_
