Summary Statement:
• This project involves a Rezoning of the subject property from Light.Industrial (ML) to Planned
" Community.District (PCD) with site-specific development standards to`allow for a mixed-use
development including commercial, residential, and office type uses. The City Council reviewed this
proposal at its meeting of May 21. 2001 and,voted to introduce the Ordinance and approve the project.

9 REZONING A 20.63-ACRE PARCEL,APN 005-040-049, FROM LIGHT INDUSTRIAL
10 TO PLANNED COMMUNITY DISTRICT (PCD),TO ALLOW FOR DEVELOPMENT
11 OF A MIXED USE PROJECT INCLUDING COMMERCIAL, RESIDENTIAL AND
12 OFFICE, TO BE KNOWNAS PARK CENTRAL, LOCATED AT THE CORNER OF
13 CASA GRANDE ROAD AND LAKEVILLE HIGHWAY

15 BE IT ORDAINED BY THECOUNCIL OF THE CITY OF PETALUMA AS FOLLOWS:

17 Section 1. The City Council finds that the Planning Commission filed with the City Council its
18 report set forth in its minutes.of April 10, 2001!. recommending the adoption of an amendment to
19 Zoning Ordinance Section 1072 N.C.S., as amended, by reclassifying and rezoning certain lands
20 being more particularly described as Assessor's Parcel,No. 0054)40-049, a 20.63-acre site
21 located at the corner of Casa Grande Road and Lakeville Highway.

•23 Section 2. The City Council.further finds that said•Plannine Commission held a public hearing
24 on said proposed amendment on April 10, 2001, after giving notice of said hearing, in the
25 manner, for the period, and in the form required,by said.Ordinance No. 1072 N.C.S., as
26 amended.

28 Section 3. Pursuant to the provisions of Zoning Ordinance No: 1072 N.C.S., as amended, the
29 City Council finds as follows:

31 1. The proposed Amendment to Zoning Ordinance No. 1072:N.C.S., to classify and rezone
32 the subject parcel from ML -.Light Industrial to PCD - Planned Community District will
• 33 result in a more desirable use of land and a better physical environment than would be
34 possible under any single zoning district or combination of zoning districts.

36 The proposed uses comply with the Mixed Use General Plan designation, which allows
37 for a combination of'residential, commercial or retail uses on one parcel. Additionally,
38 this proposal incorporates the policies and guidelines of the PCD-Planned Community
39 District of Article 19A of the Zoning Ordinance.

41 2. The,public necessity, convenience and welfare clearly permit and will be furthered by the
42 proposed. Amendment to the Zoning Ordinance, reclassifying and rezoning the Park
43 Central site to Planned ConimunityDistrict.

045 The Planned Community District Guidelines/Development Standards describe permitted
46 and conditional uses as well as those which would not otherwise be allowed to be
47 established at this location. This specific list of uses prevents the creation of any
48 nuisance to the existing surrounding•uses.

• 1 3. The requirements of the California Environmental Quality Act (CEQA) have been
2 satisfied through the preparation of an Initial Study and the drafting of a Mitigated
3 Negative Declaration to avoid or reduce to a level of insignificance, potential impacts
4 generated by the proposed Park Central Planned Community District.

6 In compliance with the requirements of the California Environmental Quality Act, an
7 Initial Study was prepared for the rezoning of the site from ML-Light Industrial to
8 Planned Community District. Based upon the Initial Study, a determination was made
9 that no significant environmental effects would result. A copy of this notice was
10 published in the;Argus-Courier and provided to residents and occupants within 500 feet
11 of the site, in compliance with CEQA requirements.

13 Section 4. Pursuant to the.provisions of Zoning Ordinance No. 1072 N.C.S., and based upon the
14 evidence it has received and in'accordance with the findings made,the City Council hereby
15 adopts an amendment to said Zoning Ordinance No. 1072 N.C.S.,so as to reclassify and rezone
16 said property herein referred to, in accordance with the recommendation of the Planning
17 Commission.

19 Section 5. The City Clerk is hereby directed to post this Ordinance for the period and in the
20 manner required by the City-Charter.

62, IF ANY SECTION, subsection, sentence, clause or phrase or word of this Ordinance is for any
reason held to be unconstitutional, unlawful,or otherwise invalid by,a court of competent
24 jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance.
25 The City Council of the City of Petaluma hereby declares that-it would have passed and adopted
26 this Ordinance and each and all provisions thereof irrespective of the fact that any one or more of
27 said provisions be declared unconstitutional, unlawful or otherwise invalid.
