AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PETALUMA AUTHORIZING THE
ACQUISITION AND ACCEPTANCE OF PERMANENT PUBLIC RECLAIMED WATER LINE
EASEMENTS ASSOCIATED WITH THE ADOBE ROAD RECYCLED WATER PIPELINE TO
SUPPORT THE CITY’S RECYCLED WATER SYSTEM EXPANSION
WHEREAS, the City of Petaluma is expanding its recycled water distribution system to improve water supply
resiliency, reduce reliance on groundwater pumping, and support agricultural and urban users consistent with the
City’s adopted water resource and climate action strategies; and
WHEREAS, as part of the recycled water system expansion, the City installed a segment of recycled water
pipeline along and adjacent to Adobe Road (C66501936), a portion of which crosses two privately owned parcels
requiring permanent easements to ensure long-term access, operation, and maintenance of the pipeline facilities;
and
WHEREAS, City staff prepared an alternatives analysis during project design, which concluded that routing
portions of the pipeline across private property avoided substantial safety risks, reduced traffic control impacts,
and prevented damage to mature roadside trees within the right-of-way; and
WHEREAS, the owners of the affected parcels—identified as the Pronzini and Oxfoot properties—agreed to
grant the City the required permanent reclaimed water line easements at no cost; and
WHEREAS, the easements have been fully executed by the respective property owners and include surveyor-
prepared legal descriptions and maps, attached hereto as Exhibits A and B; and
WHEREAS, under Section 46 of the Petaluma City Charter, the acquisition of permanent interests in real
property must be approved by ordinance of the City Council; and
WHEREAS, acceptance of the easements is an administrative action that does not constitute a project under
the California Environmental Quality Act pursuant to CEQA Guidelines section 15378(b)(5), and therefore no
further environmental review is required; and
WHEREAS, the City Council now desires to authorize acquisition and acceptance of the permanent
easements and direct the City Clerk to record the necessary documents; and
WHEREAS, the City Council unanimously passed the introduction of this ordinance with a 7-0 vote on
January 5, 2026.

NOW THEREFORE BE IT ORDAINED by the City Council of the City of Petaluma, as follows:
Section 1. The City Council hereby finds that the above recitals are true and correct and are incorporated into this
ordinance as findings of the Council.
Section 2. The City Council finds that acceptance of the permanent easements is an administrative activity not
constituting a project under CEQA Guidelines section 15378(b)(5), and therefore no further environmental review
is required.
Section 3. The City Council authorizes the acquisition and acceptance of two permanent public reclaimed water
line easements across portions of the following privately owned parcels:
• Pronzini Property, APN 017-120-015, as described in Exhibit A, and
• Oxfoot Property, APN 017-120-001, as described in Exhibit B.
The easements grant the City the permanent rights necessary to access, operate, maintain, repair, and replace the
recycled water pipeline and appurtenant facilities located within the easement areas.
Section 4. The permanent easements, along with the legal descriptions and maps attached thereto, are
incorporated herein by reference and made part of this ordinance as Exhibit A (Pronzini Easement) and Exhibit
B (Oxfoot Easement).
Section 5. If any section, subsection, sentence, clause, phrase, or word of this Ordinance is for any reason held
to be unconstitutional, unlawful, or otherwise invalid by a court of competent jurisdiction or preempted by State
legislation, such decision or legislation shall not affect the validity of the remaining portions of this Ordinance.
The City Council of the City of Petaluma hereby declares that it would have passed and adopted this Ordinance
and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared
unconstitutional, unlawful other otherwise invalid.
Section 6. This Ordinance shall become effective thirty (30) days after the date of its adoption by the Petaluma
City Council.
Section 7. The City Manager, or her designee, is authorized and directed to execute all needed documents to
effectuate acquisition and acceptance of the easements. The City Clerk is further directed to publish or post this
Ordinance or a synopsis for the period and in the manner provided by the City Charter and any other applicable
law.

LEGAL DESCRIPTION
All that real property situated in the County of Sonoma, State of California, and being a
portion of the Lands of Pronzini, APN 017-120-015, as described in the Grant Deed 2015-
032679, Official Records of Sonoma County, described as follows:
A 20-foot-wide public reclaimed /recycled water easement;
Beginning at a point on the common boundary of the said Lands of Pronzini, and the
Lands of Oxfoot Associates LLC, APN 017 -120-001, in the Grant Deed 2010-119437,
Official Record of Sonoma County, said point is 63.00 feet northeast, measured at right
angles, from station 100+67.66, more or less, as determined from the County of Sonoma
Department of Public Works Department drawing of Abode Road, microfiche image
number 002753.All the Lands of Pronzini lying southerly of the following described line:
Thence from the Point of Beginning South 7632’34”East, 124.95 feet, parallel with the
northern right of way for Abode Road, Being the Point of Termination of the herein
description.
Containing 2593 Sq Ft more or less.
Basis of Bearings:North 3527’00” East,798.11 feet between centerline monuments
along Adobe Road as shown on County of Sonoma Department of Public Works

CERTIFICATE OF ACCEPTANCE
This is to certify that the obligation in real property APN 017-120-001 (portion) conveyed by the
Grant Deed dated December 30, 2010, recorded under Document No. 2010-119437, Sonoma
County Records, for all purposes necessary including, but not limited to, construction, installation,
reconstruction, maintenance, and repair of a public reclaimed water line easement, and
appurtenant facilities, and to perform any other work necessary and incidental to such installations
and maintenance, over and upon that certain real property situated in the unincorporated area of
the County of Sonoma, State of California, as described in Exhibit ‘A’ and diagrammed on the
corresponding Exhibit ‘B’ attached to said Grand Deed to the City of Petaluma, a California
municipal corporation, is hereby accepted by the undersigned official on behalf of the Petaluma
City Council, pursuant to authority conferred by the resolution of the City Council adopted January
18, 1965, and the City of Petaluma consents to recordation thereof by its duly authorized officer.
