Introduced by Councilman rlichael Davis Seconded by Councilman Lynn Woolsey AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S, AS AMENDED, BY APPLYING AN OVERLAY HISTORIC ZONING DISTRICT TO PARCELS WITHIN THE OAK HILL/BREWSTER HISTORIC DISTRICT BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: 26 Section 1. The City Council finds that the Planning Commission filed with the 27 City Council on March 19, 1990, its report as set forth in its minutes of February 27, 28 1990, recommending the adoption of an amendment to Zoning Ordinance No. 1072 29 N.C.S., as amended, by applying an overlay zoning district on certain lands being 30 more particularly described as set forth on the attached map, Exhibit "A", to create 31 an Historic Overlay District (H-2). 32 33 Section 2. The City Council further finds that said Planning Commission held a 34 public hearing on said proposed overlay zoning amendment to Zoning Ordinance 35 No. 1072 N.C.S., as amended, on February 27, 1990, after giving notice of said 36 hearing in the manner, for the period and in the form required by said Ordinance 37 No. 1072 N.C.S., as amended. 38 39 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as 40 amended, the City Council finds the proposed overlay zoning amendment in 41 conformity with the Petaluma General Plan and further, that the public interest, 42 convenience and general welfare will be furthered by the proposed overlay zoning 43 amendment. 44 Ord 1796 N.C.S. 1 .~. rJ 1 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as 2 amended, and based upon the evidence it has received and in accordance with the 3 findings made as follows: 4 5 1. The intent of Article 17 of the Zoning Ordinance has been met by the 6 incorporation of Preservation Guidelines and Standards for the Oak 7 Hill/Brewster Historic District and by the preparation of an architectural g inventory of existing buildings. 9 10 2. The proposed map amendment designating the Oak Hill/Brewster Historic 11 District is consistent with the City of Petaluma Zoning Ordinance. 12 13 3. The proposed map amendment is consistent with the City of Petaluma 14 General Plan and its goals, policies, and objectives. 15 16 4. The public convenience and general welfare require or clearly permit the 17 adoption of the proposed historic district overlay designation. 18 19 Section 5. The City Council hereby adopts said amendment to said Zoning 20 Ordinance No. 1072 N.C.S. so as to designate an overlay Historic Zoning District on 21 said property hereinbefore referred to in accordance with the recommendation of 22 the Planning Commission. 23 24 Section 6. The City Council finds that the requirements of California 2S Environmental Quality Act Guidelines, Section 15083 have been satisfied. and 26 hereby incorporate by reference the Negative Declaration adopted by Resolution 27 9n-R s N.C.S. 28 29 Section 7. The City Clerk is hereby directed to post this ordinance for the period 30 and in the manner required by the City Charter. 31 32 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for 33 any reason .held to be unconstitutional by a court of competent jurisdiction, such decision 34 shall not affect the validity of the remaining portions of this ordinance. The City Council of 35 the City of Petaluma hereby declares that it would have passed and adopted this ordinance Ord. 1796 N.C.S. 2 and each and all provisions thereof irrespective of the fact that any one or more of said provisions be declared unconstitutional. 1 INTRODUCED and ordered Posted/Published this 19th day of March 1990.
