AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S,
AS AMENDED, BY RECLASSIFYING AND REZONING ASSESSOR'S
PARCEL NUMBERS 7-102-03; 7-111-01, 17, 51 THROUGH 57;
7-171-13, 14, 17; 5-060-15, 21, 30 THROUGH 33, 39, 40;
5-020-41, 42, 43, 45; 7-111-12 THROUGH 16, 18, 23
THROUGH 32 38 THROUGH 41, 43, 44, AND 45
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
32 Section 1. The City Council finds that the Planning Commission filed with the City Council
33 on May 7, 1990, its report as set forth in its minutes of February 13, and Apri124, 1990 (File
34 No.'s 3.405 and 3.407), recommending the adoption of an amendment to Zoning Ordinance
35 No. 1072 N.C.S., as amended, by reclassifying and rezoning certain lands being more
36 particularly described as:

38 1. Assessor's Parcel Numbers 007-102-03; 007-111-01, 17, 51 through 57 from Light
39 Industrial (M-L) to Highway Commercial (GH); and
40 2. Assessor's Parcel Numbers 7-163-17; 7-171-13, 14 and 17; 5-060-15, 21, 30 through
41 33, 39 and 40; 5-020-41, 42, 43 and 45 from Light Industrial (M-L) to Highway
42 Commercial (C-H); and
43 3. Assessor's Parcel Numbers 7-111-12 through 16, 18, 23 through 32, 38 through 41,
44 43, 44 and 45 from Light Industrial (M-L) to Compact Residential (R-C).

3 Section 2. The City Council further finds that said Planning Commission held public
4 hearings on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., as amended,
5 0,l Fe'~rua'Y 13, and April 24, 1.990, after giving notice of said hearing in the manner, for
6 the period and in the form required by said Ordinance No. 1072 N.C.S., as amended.

8 Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S., as
9 amended, the City Council finds as follows:
10 1. That the proposed rezoning will make the zoning consistent with the General Plan.
11 2. That state law and local policy call for consistency between zoning and General Plan
12 land use designations.
13 3. That public necessity, convenience, and general welfare permit the adoption of the
14 proposed amendments.
15 4. That no further environmental review is necessary for these amendments.

17 Section 4. Pursuant to the provisions of Zoning Ordinance No. 1074 N.C.S., as
18 amended, and based upon the evidence it has received and in accordance with the findings
19 made, the City Council hereby adopts amendments to said Zoning Ordinance No. 1072
20 N.C.S. so as to reclassify and rezone said property hereinbefore referred to in accordance
21 with the recommendation of the Planning Commission.

23 Section 5. The City Clerk is hereby directed to post this ordinance for the period and in
24 the manner required by the City Charter.

27 IF ANY SECTION, subsection, sentence, clause or phrase or word of this ordinance is for
28 any reason held to be unconstitutional by a court of competent jurisdiction, such decision
29 shall not affect the validity of the remaining portions of this ordinance. The City Council of
30 the City of Petaluma hereby declares that it would have passed and adopted this ordinance
31 and each and all provisions thereof irrespective of the fact that any one or more of said
32 provisions be declared. unconstitutional.
