AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 N.C.S.
BY AMENDING THE ZONING MAP FLOODWAY AND FLOODPLAIN DISTRICT
BOUNDARIES AND DESIGNATING ZONE DISTRICTS FOR THOSE
PROPERTIES REMOVED FROM FLOODWAY
BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS
FOLLOWS:
Section 1. The City Council finds that the Planning Commission filed with
the City Council on October _, 1989, its report as set forth in its minutes
of September 12 and 26, 1989, recommending adoption of Floodway and
Floodplain zone district boundaries that conform to floodway and floodplain
boundaries adopted by the Federal Emergency Management Agency (FEMA)
as shown on the Federal Insurance Rate Maps (FIRM) , effective September
29, 1989, and adoption of zoning districts for those properties removed from
the Floodway.
Section 2. The City Council further finds that said Planning Commission held
public hearings on said proposed amendment culminating on September 26,
1989 after giving notice of said hearings in the manner and in the form
required by Ordinance No. 1072 N.C.S., as amended, and has received
written information from staff and interested parties. Minutes of the public
hearings as well as all written information have been received and reviewed
by the Council.
Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S.,
as amended, the City Council finds the proposed amendment in general
conformity with the Petaluma General Plan, and further, that the public
interest, convenience and general welfare will be furthered by the proposed
amendment.
Section 4. The City Council further finds that zone designations were
applied to those properties removed from the floodway in a manner
consistent with sound planning principals and compatible with existing uses
and neighborhood composition.
Section 5. The City Council finds that potential significant effects of
these zone map amendments are mitigated to a level of insignificance by the
following actions:

1. Designation of large portions of the "Denman Flat" area as
"Agricultural",
2. Adoption of FIRM floodway and floodplain boundaries to insure
continued participation in the NFIP,
3. Continued enforcement of the City's "no net fill" policy in special flood
hazard areas, and
4. Subsequent environmental review of development and grading proposals
in a manner consistent with CEQA and local guidelines.
Section 6.Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S.,
as amended, and based upon the evidence it has received and in accordance
with the findings made, the City Council hereby adopts Floodway and
Floodplain zone district boundaries that conform to the Floodway and
Floodplain boundaries adopted by FEMA as shown on the Flood Insurance
Rate Maps effective September 29, 1989, and Zoning designations for those
properties removed from the floodway as depicted on Exhibits A-F, attached
hereto and incorporated by reference.
Section 7. The City Council finds that future changes to the floodhazard
areas should be treated as follows:
1. Map amendments approved by FEMA based on new or corrected
information (e.g., more accurate topographic maps) will be
automatically amended by staff on the applicable General Plan and
Zoning Maps.
2. Map amendments approved by FEMA resulting from a physical change
(e.g., diversion channel or channelization of a creek) will be
processed as a Zoning/General Plan amendment prior to approval.
3. Total periodic review/revision of the maps by FEMA will be processed
as a Zoning/General Plan amendment.
Section 8. The City Council finds that the requirements of California
Environmental Quality Act Guidelines Section 15083 have been satisfied and
hereby incorporates by reference the Negative Declaration approved by
Resolution No. 89-350 N. C. S.
Section 9. The City Clerk is hereby directed to publish this ordinance for
the period and in the manner required by the City Charter.
