Seconded by Councilman John Balshaw AN ORDINANCE AMENDING ZONING ORDINANCE NO. 1072 NC5 BY RECLASSIFYING AND REZONING CERTAIN LANDS KNOWN AS ADOBE CREEK GOLF AND COUNTRY CLUB, UNIT 2 RESIDENTIAL PROJECT FROM P.C.D. (PLANNED COMMUNITY DISTRICT) TO P.U.D. (PLANNED UNIT DEVELOPMENT) LOCATED ON THE EAST SIDE OF ELY BOULEVARD SOUTH BETWEEN CASA GRANDE AND FRATES ROADS BE IT ORDAINED BY THE COUNCIL OF THE CITY OF PETALUMA AS FOLLOWS: Section 1. The City Council finds that the Planning Commission filed with the City Council on October 16, 1989, its report as set forth in its minutes of September 26, 1989, recommending the adoption of an amendment to Zoning Ordinance No. 1072 N.C.S. , by reclassifying the rezoning certain. lands being more particularly described below from P.C.D. (Planned Community District) to P.U.D. (Planned Unit District) : a portion of A.P. No's. 170-050-07 and 08 consisting of approximately 96 acres between Casa Grande and Frates Roads, east of Ely Boulevard South. Section 2. The City Council further finds that said Planning Commission held public hearings on said proposed amendment to Zoning Ordinance No. 1072 N.C.S., on September 12 and 26, 1989 after giving notice of said hearings in the manner, for the period and in the form required by said Ordinance No. 1072 N.C.S. Section 3. Pursuant to the provisions of Zoning Ordinance No. 1072 N . C . S . , the City Council finds as follows 1 Ord. 1779 NCS ,~. 1. The proposed plan, clustering residential units, with golf course open space surrounding, clearly results in a more desirable use of land and abetter physical environment than would be possible under any single zoning district or combination of zoning districts. 2. The proposed PUD is on property which has the ability to provide a suitable relationship to thoroughfares (Ely Boulevard South, Frates and Casa Grande Roads) ; and that said thoroughfares will be adequate to carry any additional traffic generated by the development. 3. The plan for the proposed development will present a unified and organized arrangement of residential units which are appropriate in relation to adjacent or nearby properties and roadways and; as conditionally recommended for approval, that adequate public and private area landscaping and screening will be included to insure compatibility . 4. The scenic qualities of the improved site will be protected, with adequate available public and private spaces designated on the Unit Development Plan, through the provision of pathways along the frontages of Casa Grande and Frates Roads, and the dedication of permanent open space over the golf course area to insure perpetual preservation of urban separator open space. 5. The development of the subject property, in the manner proposed and conditionally approved, will not be detrimental to the public welfare, and will be in the best interest of the City. 6. That the proposed rezoning is in conformance with the general intent and spirit of the zoning regulations and the Petaluma General Plan by providing density in conformance with the site's land use designation; and further, that the public interest, convenience and general welfare will be furthered by the proposed amendment . 2 Ord. 1779 NCS 7. That the requirements of the California Environmental Quality Act Guidelines have been satisfied and hereby incorporates by reference the Subsequent Environmental Impact Report certified by the City Council in January, 1985. 8. That the requirements of the California Environmental Quality Act Guidelines Section 15091 are hereby satisfied by the incorporation of mitigation measures to address identified adverse impacts associated with the approved project. Those .mitigation measures being set forth in conditions of approval for the unit development plan and tentative map for the Adobe Creek Golf and Country Club, Unit 2. Section 4. Pursuant to the provisions of Zoning Ordinance No. 1072 N.C.S. , and based upon the evidence it has received and in accordance with the findings made, the City Council hereby adopts an amendment to said Zoning Ordinance No. 1072 N. C. S . , so as to reclassify and rezone said property hereinbefore referred to in accordance with the recommendation of the Planning Commission. Section 5. The City Clerk is hereby directed to post this Ordinance for the period and in the manner required by the City Charter. INTRODUCED and ordered posted this 16th day of October, 1989.
